DECEMBER 9, 2003 TWENTY-FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, December 9, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Welte to approve the Board minutes of December 2, 2003 as submitted. Carried 4-0, Walish abstained.

Motion by Clausen second by Batcheller to approve the minutes of the Executive Sessions of November 25, 2003 as submitted. Carried 5-0.

Motion by Welte second by Boykin to approve the minutes of the Executive Session of December 2, 2003 as submitted. Carried 4-0, Walish abstained.

The Board approved the separation of Dorrine F. Norby, Temporary Election Clerk, County Auditor /
Recorder Dept., effective 11-13-03. End of Temporary Work. Copy filed.

The Board approved the appointment of Cynthia L. Foxhoven, Custodian, Building Services Dept., @$9.63/hour, effective 12-15-03. Job Vacancy Posted: 8-29-03. Entry Level Salary: $9.63/hour. Copy filed.

The Board approved the reclassification of David D. Bridenbaugh, Custodian, Building Services Dept., @$10.62/hour, effective 12-27-03. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

Motion by Batcheller second by Welte to receive recommendation of Richard J. Storm, County Engineer, but approve the bid of Steffen Inc., Sioux City, in the amount of $16,097.00 to furnish and install dump box, hoist, and hydraulics. Carried 5-0. Copy filed.

The Board discussed the consideration of appointment to Woodbury County Zoning Commission with John Pylelo, Zoning Administrator.

Motion by Batcheller second by Boykin to postpone for one week action on the reappointment of Dwight Rorholm of 4431 Country Club Blvd., Sioux City, to Woodbury County Zoning Commission for a five-year term beginning January 1, 2004. Carried 5-0.

Motion by Clausen second by Boykin to approve preliminary plats submitted by Kenneth and Kelly Boyle for Boyles Addition Subdivision, Parcel #801045, and refer to the zoning commission for review and recommendation. Carried 5-0. Copy filed.

The third reading was held of county ordinance establishing an area of U.S. Highway 20 prohibiting the use of compression brakes.

Motion by Batcheller second by Clausen to approve and receive for signatures the third reading of Woodbury County Ordinance establishing an area of U.S. Highway 20 prohibiting the use of compression brakes or braking adjacent to the City of Moville, Woodbury County, Iowa. Carried 5-0. Copy filed.

The third reading was held of county ordinance establishing restricted parking adjacent to the City of Moville.

Motion by Welte second by Boykin to approve and receive for signatures the third reading of Woodbury County Ordinance establishing restricted parking adjacent to the City of Moville. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign a resolution approving petition for suspension of taxes for B.C.L. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Bernice Christine Painter NKA Bernice Christine Lodahl, as titleholder of property located at 4400 Tyler Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 306675

LOTS 11-12 BLK 27, 3510 Leeds Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Bernice Christine Painter NKA Bernice Christine Lodahl as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9; and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Board discussed approval to pay the increase expense of Siouxland Paramedics.

Motion by Boykin second by Clausen to approve to pay the increase expense of Siouxland Paramedics. Carried 5-0. Copy filed.

Dennis Butler, Budget/Tax Analyst, discussed Budget Amendment #1 for FY 04 with the Board.

Motion by Batcheller second by Boykin to set a public hearing on January 6, 2004 at 10:30 a.m. for Budget Amendment #1 for FY 04. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Clausen second by Boykin to go into Executive Session per Iowa Code Section 20.17(3). Carried 5-0 on roll call vote.

Motion by Batcheller second by Clausen to go out of Executive Session. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until December 16, 2003.
