NOVEMBER 18, 2003 TWENTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, November 18, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Jean Jessen, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Welte second by Boykin to approve the Board minutes of November 12, 2003 as submitted. Carried 5-0.

Motion by Batcheller second by Clausen to approve the minutes of the Executive Session of
November 12, 2003 as submitted. Carried 5-0.

The Board approved the reclassification of Gregory J. Stallman, Deputy Sheriff, County Sheriff Dept., @$21.25/hour, effective 11-15-03. Per D.S.A. Contract agreement, from Class 1 to Sr. Class, due to 4
year college degree + 4 years service. Copy filed.

The Board approved the promotion of Thomas P. Handke, District Foreman, Secondary Roads Dept., @$18.22/hour, effective 11-19-03. Job Vacancy Posted: 10-02-03. Entry Level Salary: $18.22/hour.

The Board approved the promotion of Charles T. Hertz, Deputy Lieutenant, County Sheriff Dept., @$26.17/hour, effective 11-24-03. Promotion from Deputy Sergeant to Deputy Lieutenant, per Board approval on 9-30-03. Copy filed.

Motion by Boykin second by Welte to approve and authorize the Chairman to sign Resolution No. 9722 approving petition for suspension of taxes for R.A.O. on Parcel #155340. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Ruth A. Oppenheim, as titleholder of property located at 2452 Boies Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 155340

Lots Thirty-one Thirty-two (31-32) Block Twenty-one (21) Edgewater 2nd Addition,
City of Sioux City, Woodbury County, Iowa

WHEREAS, Ruth A. Oppenheim as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9; and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Boykin to authorize the Chairman to sign an agreement with Iowa Department of Transportation to receive a grant from Living Road Trust Fund for Project
No. 90-97-LRTF-401, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Welte second by Boykin to receive and accept the quote of Murphy Tractor in the amount of $8,286.00 to furnish Henke one-way reversible snow plow to be installed on County Unit #207, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to authorize the Chairman to sign contract amendment of Project FY2004 Contract # 5884CO97 with Iowa Department of Public Health, decreasing Home Care Aide
allocation by $5,574.00 and Public Health Nursing allocation by $1,708.00. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to table discussion of County Medical Examiners budget.
Carried 5-0.

Motion by Boykin second by Batcheller to authorize the Chairman to sign a real estate listing agreement
with Century 21 Davenport & Associates, Inc., subject to reserving two names. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on
the agenda or Supervisors concerns.

The Board adjourned the regular meeting until November 25, 2003.
