OCTOBER 21, 2003 - SEVENTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 21, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy Recorder/Clerk to the Board, and John Sullivan, Board Legal Counsel.

Motion by Boykin second by Clausen to approve the Board minutes of October 14, 2003 as submitted. Carried 4-0. Batcheller abstained.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES
WHEREAS, Debbie Hartsock, as titleholder of property located at 3019 Melrose Ave., Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Eleven (11) Block Six (6) Kelly Park Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Debbie Hartsock as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

A RESOLUTION THANKING AND COMMENDING
JOHN L. BEARDSHEAR, SR.
FOR HIS SERVICE TO WOODBURY COUNTY
WHEREAS, John L. Beardshear has capably served Woodbury County as an employee of the Woodbury County Building Services Department from January of 1990 to November 2003; and
WHEREAS, the service given by John L. Beardshear as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thank and commend John L. Beardshear for his years of service to Woodbury County; and
BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, John L. Beardshear; and

A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY
WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.10 (Code of Iowa 2003) as amended has determined that a portion of the roadway right-of-way, described as follows and shown on the attached Plat of Survey, and incorporated herein by reference, is no longer needed for roadway purposes:
A parcel of land described as being a part of the Southeast Quarter of the Southeast Quarter (SE SE ) and a part of the Southwest Quarter of the South East Quarter (SW SE ) of Section 12, Township 88 North, Range 43 West of the 5th P.M., Woodbury County, Iowa , further described as follows:
Commencing at the Southeast (SE) corner of the SE of said Section 12; thence S 891225 W for 926.82 feet along the south line of SE of said Section 12 to a point on the centerline of an existing paved county highway (now known as Osceola Avenue), said point also being the point of beginning; thence continuing S 891225 W for 531.85 feet along the south line of the SE of said Section 12 to a point on the centerline of an existing public road; thence N 331512 E for 182.87 feet along the centerline of said public road; thence N 301522 E for 151.81 feet along the centerline of said public road; thence northeasterly along the centerline of said public road for 304.16 feet along the arc of a 1759.97 foot radius curve concave northwesterly and having chord length of 303.78 feet bearing N 251818 E; thence N 202115 E for 253.91 feet along the centerline of said public road; thence northeasterly along the centerline of said public road for 241.59 feet along the arc of a 447.62 foot radius curve concave southeasterly having a chord length of 238.67 feet bearing N 355225 E; thence N 493116 E for 44.65 feet along the centerline of said public road; thence northeasterly along the centerline of said public road for 48.64 feet along the arc of a 50.00 foot radius curve concave southeasterly, and having a chord length of 46.75 feet bearing N 772340 E; thence S 744356 E for 20.56 feet along the centerline of said public road to a point of intersection with the centerline of said paved county highway; thence S 151605 W for 38.54 feet along the centerline of said paved county highway; thence southerly along the centerline of said paved county highway for 988.62 feet along the arc of a 2864.79 foot radius curve concave easterly, and having a chord length of 983.72 feet bearing S 052255 W to the point of beginning. Said described parcel contains a total of 6.44 acres, inclusive of Public roadway easements of 2.29 acres. Said described parcel is also subject to any and all easements apparent or of record.
NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors, in accordance with Section 306.10 (Code of Iowa) hereby vacates that excess right of way identified on the Plat of Survey attached hereto and incorporated herein by this reference reserving therefrom public roadway easement rights for Osceola Avenue, which was previously referred to as paved county highway, and for Newton Path, which was previously referred to as the public road. From and after the date this resolution is recorded, the identified property, exclusive of the retained public roadway easements as shown on the attached Plat of Survey, shall no longer constitute a street, highway, or public right of way, but shall revert to private ownership pursuant to operation of law.

The Board discussed purchase of equipment for snow plow truck with the county engineer.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until October 28, 2003.
