OCTOBER 14, 2003 - SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 14, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy Recorder/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Boykin second by Batcheller to amend the agenda to include an item recognizing an employee for years of service to the County. Carried 5-0.
Motion by Welte second by Boykin to approve the Board minutes of October 7, 2003 as submitted. Carried 5-0.
Motion by Clausen second by Boykin to approve the Board minutes of the Special Meeting of October 9, 2003 as submitted. Carried 5-0.
Motion by Batcheller second by Clausen to approve the Board minutes of the Executive Session of October 7, 2003 as submitted. Carried 5-0.
The Board approved the separation of John L. Beardshear, Sr., Lead Custodian, Building Services Dept., effective 11-21-03. Retirement. Copy filed.
Motion by Welte second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Motor Vehicle Clerk II, County Treasurer Dept., AFSCME Cthouse./Grade 4-$10.77/hour (corrected amount from 10-07-03), and for Case Manager (two new positions) for Social Services Dept., $29,300/year per position. Carried 5-0. Copy filed.
There was a discussion of social services compensation and caseload increases.
Motion by Boykin second by Batcheller to approve the recommendation to proceed with a change to the wage scale for the social services position retroactive to October 6, 2003. Carried 5-0.
Motion by Boykin second by Batcheller to approve retiring employee, John L. Beardshear, Sr., to remain on county health insurance plan at his own expense. Carried 5-0. Copy filed.
Motion by Batcheller second by Clausen to receive Auditors Quarterly Report for the first quarter ending 9-30-03. Carried 5-0. Copy filed.
The Public Hearing to adopt an integrated solid waste comprehensive plan for Woodbury County Landfill was held at 10:10 a.m. The Chairman called on anyone wishing to be heard on said comprehensive plan.
Motion by Boykin second by Batcheller to close the Public Hearing on the comprehensive plan for Woodbury County as there was no one present wishing to be heard. Carried 5-0.
Motion by Welte second by Boykin to approve and authorize the Chairman to sign Resolution No. 9706 approving and adopting an integrated solid waste comprehensive compliance plan update for the county of Woodbury County. Carried 5-0.

RESOLUTION APPROVING AND ADOPTING AN INTEGRATED SOLID WASTE COMPREHENSIVE COMPLIANCE PLAN UPDATE FOR THE COUNTY OF WOODBURY COUNTY
WHEREAS, Section 455B.302 of the Code of Iowa requires every city and county of this state to provide for the establishment and operation of a comprehensive solid waste reduction program consistent with the waste management hierarchy under Section 455B.301A, and a sanitary disposal project for final disposal of solid waste by its residents; and
WHEREAS, Section 455B.306(1) of the Code of Iowa requires that all cities and counties file with the Director of the Department of Natural Resources a comprehensive plan detailing the method by which the city or county will comply with the requirements of Section 455B.302 to establish and implement a comprehensive solid waste reduction program for its residents; and
WHEREAS, a comprehensive plan, as described in Section 455B.306 of the Code of Iowa has been prepared at the direction of and in participation with the County of Woodbury County, Iowa, entitled Integrated Solid Waste Comprehensive Compliance Plan Update, by the Department of Natural Resources, and dated October 14, 2003, a copy of which is attached hereto and made a part hereof; and
WHEREAS, the Woodbury County Board of Supervisors has determined that the adoption and implementation of the proposed comprehensive plan is in the best interest of the County with respect to satisfying the County's statutory duties.
NOW, THEREFORE, BE IT RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, that the proposed comprehensive plan is hereby adopted as the comprehensive solid waste reduction plan of Woodbury County, Iowa.
AND BE IT FURTHER RESOLVED that the County shall implement and participate in the programs set forth in the comprehensive plan.
AND BE IT FURTHER RESOLVED that the comprehensive plan shall be submitted to the Iowa Department of Natural Resources, on behalf of Woodbury County in satisfaction of Section 455B.306(1) of the Code of Iowa.

Motion by Welte second by Clausen to authorize the Chairman to sign Farm-to-Market Voucher to reimburse Iowa Department of Transportation for materials inspection on Projects FM-CO97(47)55-97, FM-CO97(48)55-97, and STP-S-CO97(49)5E-97 in the total amount of $7,390.29 to be paid from the Farm-to-Market fund, per recommendation of the county engineer. Carried 5-0. Copy filed.
Bid letting was held at 10:20 a.m. for Project L-EWP 03(1)73-97, a stream stabilization project on a branch of Wolf Creek.

A RESOLUTION THANKING AND COMMENDING
Vincent T. McDonald
FOR His SERVICE TO WOODBURY COUNTY
WHEREAS, Vincent T. McDonald has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 36 years, from January of 1967 to December 2003; and
WHEREAS, the service given by Vincent T. McDonald as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thank and commend Vincent T. McDonald for his thirty six years of service to Woodbury County; and
BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Vincent T. McDonald; and
BE IT SO RESOLVED this 14th of October, 2003.

The Public Hearing and Sale of Real Estate Parcel #621285, Parcel #621300, and Parcel #621315 to Woodbury Central Community Schools was held at 10:30 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Boykin second by Clausen to close the Public Hearing on the sale of Real Estate Parcel #621285, Parcel #621300, and Parcel #621315 to Woodbury Central Community Schools as there was no one present wishing to be heard on said sale. Carried 4-0.
Chairman called for bids on Real Estate Parcel #621285, Parcel #621300, and Parcel #621315. Woodbury Central Community Schools bid $40,000 plus recording fees. There were no further bids.
Motion by Clausen second by Welte to accept the offer of $40,000.00 plus recording fees from Woodbury Central Community Schools for Real Estate Parcel #621285, Parcel #621300, and Parcel #621315. Carried 4-0.

RESOLUTION
At a meeting held on the 14th day of October, 2003, the following Resolution was presented to the Board of Supervisors of Woodbury County, Iowa:
WHEREAS, by Resolution duly adopted this Board of Supervisors did on the 14th day of October, 2003, propose to sell to the Woodbury Central Community School for the sum of Forty Thousand and no/100 Dollars ($40,000.00) the following described property, to-wit:
Parcels # 621285, # 621300, # 621315, described as:
North Five Feet (N 5) Lot Two (2), Block One (1) and Lots Ten Twenty-Two (10-22), Block One (1), Sunrise View Addition, City of Moville, Woodbury County, Iowa.
WHEREAS, pursuant to said Resolution, notice of said proposal has been published in the Sioux City Journal, a weekly newspaper for over two years last past in the City of Sioux City, Iowa, said notice having been published on the 7th day of October, 2003, and which Resolution and Notice fixed the 14th day of October, 2003, at 10:30 a.m. at the Woodbury County Board of Supervisors, Sioux City, Iowa, as the time and place of final action on said Resolution, and
WHEREAS, the time so originally fixed for final action has arrived and passed and no objections have been made to the proposal, the Woodbury County Board of Supervisors having fully considered the same and it appearing to the Woodbury County Board of Supervisors that the proposed sale should be made.
IT IS THEREFORE HEREBY RESOLVED, by the Woodbury County Board of Supervisors that certain real property above described be and the same is hereby sold to the Woodbury Central Community School, Moville, Iowa, for the sum of Forty Thousand and no/100 Dollars ($40,000.00) and it is further resolved that the Board President and the Board Secretary be and they are hereby authorized to execute a Quit Claim Deed on behalf of Woodbury County conveying said real property and that said deed when so executed shall be presented to the Board of Supervisors for approval.

There was a discussion of the sale proceeds.
Motion by Boykin second by Welte to approve letting the Woodbury County Fair keep the proceeds from the preceding sale of real estate property in the amount of $40,000.00 and not budget any funding for the Fair for FY 05, with beyond funding non-existent due to Re-Inventing Government Legislation. Carried 4-0. Copy filed.
The Board discussed with Patty Erickson-Puttmann a request from the Courts for second floor signage.
The Board discussed proposed changes to the General Relief Policy manual with Attorney John Sullivan, LaRae Lyons, and Jean Logan.
Motion by Boykin second by Welte to approve proposed changes to the General Relief Policy Manual. Carried 4-0. Copy filed.
Motion by Boykin second by Clausen to approve Project Safe Neighborhoods Grant, Grant No. 03-ND03. Carried 4-0. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Welte second by Boykin to allow a fireworks display at Theos Steakhouse on October 25, 2003. Carried 4-0.
Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 4-0 on a roll call vote.
Motion by Clausen second by Boykin to go out of Executive Session. Carried 4-0 on a roll call vote.
Motion by Boykin second by Welte to approve the recommendation of the attorney in the Executive Session. Carried 4-0.
The Board adjourned the regular meeting until October 21, 2003.
