SEPTEMBER 2, 2003 - TENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 2, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Welte to approve the Board minutes of August 26, 2003 as submitted. Carried 4-0, Walish abstained.

Motion by Batcheller second by Welte to approve the minutes of the Executive Session of August 26, 2003 as submitted. Carried 4-0, Walish abstained.

The Board approved the separation of Robert K. Hicks, Correctional Officer, County Sheriff Dept., effective 9-11-03. Resignation. Copy filed.

Motion by Welte second by Clausen to approve and authorize the Chairman to sign the authorization to initiate hiring process for a male Correctional Officer, County Sheriff Dept., Entry Level: $14.18/hour. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign Resolution No. 9696 approving tax suspension for B.D. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Beulah J. Dunkelberger, as titleholder of property located at 512 4th Street, Correctionville, Woodbury County, Iowa, and legally described as follows:

Parcel # 594000

North West 60 feet Lot One (1) and West 36 feet North Half Lot Three (3) Block Two (2) East Correctionville Addition, City of Correctionville, Woodbury County, Iowa

WHEREAS, Beulah J. Dunkelberger as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Welte second by Boykin to approve and authorize the Chairman to sign Request for Right of Entry and Indemnity Agreement allowing Eneco Tech to install a new water line to the Secondary Roads maintenance shed in Climbing Hill, per recommendation of the county engineer. Motion by Clausen second by Boykin to receive and approve Plans for Project L-PR 02(1)--73-97, per recommendation of the county engineer. Carried 5-0. Copy filed.

The Chairman deferred action to approve 28E Agreement between Woodbury County, Iowa, and the Iowa Department of Human Services for partial funding of the Sanford Gang Prevention Program until next week.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign Local Hazard Mitigation Planning Grant Application through the Pre-Disaster Mitigation Grant Program. Carried 5-0. Copy filed.

The Board reviewed Department of Justice grant expenditures submitted by Gary Brown, Director Woodbury County Emergency and Disaster Services.

Motion by Boykin second by Clausen to approve Department of Justice grant expenditures. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 20.17(3). Carried 5-0 on a roll call vote.

Motion by Boykin second by Welte to go out of Executive Session. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until September 9, 2003.
