AUGUST 26, 2003 - NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, August 26, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, and Welte. Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Victoria L. Ritz, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Boykin second by Clausen to approve the Board minutes of August 19, 2003 as submitted. Carried 4-0.
The Board approved the appointment of Gerad W. Lukken, Correctional Officer, County Sheriff Dept., @$14.18/hour, effective 8-26-03. Job Vacancy Posted: 7-02-03. Entry Level Salary: $14.18/hour. Copy filed.
The Board approved the reclassification of Michael A. Wingert, Deputy Sheriff, County Sheriff Dept., @$21.25/hour, effective 9-11-03. Per DSA Contract agreement, from Class 1 to Senior Class. Copy filed.
The Board approved the reclassification of Randy D. Robinson, Jail Custodian, County Sheriff Dept., @$10.62/hour, effective 9-12-03. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.
The Board approved the separation of Vincent T. McDonald, District Foreman, Secondary Roads Dept., effective 12-31-03. Retirement. Copy filed.
Motion by Clausen second by Boykin to approve request of retiree, Vincent T. McDonald, Secondary Roads Department District Foreman, to remain on Woodbury County health insurance plan at his own expense. Carried 4-0. Copy filed.
Board tabled to approve and authorize the Chairman to sign the authorization to initiate hiring process for a District Foreman, Secondary Roads Dept. Entry Level: $18.23/hour until the county engineer could be present.
J.D. Pellersels, Human Resources Director, and the Board discussed risk management and safety committee and proposed policy.
Motion by Boykin second by Clausen to approve the implementation of the proposed Risk Management /Safety Committee Policy as submitted. Carried 4-0. Copy filed.
After discussion with County Engineer Richard Storm, the Board postponed authorization to initiate the hiring process for a District Foreman, Secondary Roads Department, indefinitely.
Motion by Boykin second by Clausen to approve and authorize the Chairman to sign Resolution No. 9692 approving petition for suspension of taxes for H.M.F. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES
WHEREAS, Harriet M. Fox, as titleholder of property located at 1418 W. 16th St., Sioux City, Woodbury County, Iowa, and legally described as follows:
Parcel # 467325
East 60 FT West 110 FT LOTS 5 & 6 Block 7, Smiths Villa Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Harriet M. Fox as titleholders of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SHIRLEY K. WRIGHT
FOR HER SERVICE TO WOODBURY COUNTY
WHEREAS, Shirley K. Wright has capably served Woodbury County as an employee of the Woodbury County Library from July of 1978 to August 2003; and
WHEREAS, the service given by Shirley K. Wright as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Shirley K. Wright for her years of service to Woodbury County; and
BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Shirley K. Wright; and

RESOLUTION ACCEPTING AND APPROVING FOLSOM ADDITION TO WOODBURY COUNTY, IOWA.
WHEREAS, THE OWNER AND PROPRIETOR DID ON THE 26TH DAY OF AUGUST, 2003, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS FOLSOM ADDITION TO WOODBURY COUNTY, IOWA; AND
WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND
WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND
WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

Motion by Boykin second by Welte to receive recommendation and approve acceptance of the bid of Johnson Propane Inc., at $0.8295/gallon for 2003-04 propane, per recommendation of Richard Storm, County Engineer. Failed 2-2. Clausen and Batcheller nay.
Action was postponed on the bid until next week for a response to add the Sheriff Department.
Motion by Boykin second by Clausen to receive the quotes for Project LP-02(1)73-97 and accept the quote of Rohlin Construction Co., Estherville, Iowa, in the amount of $44, 473.67, per recommendation of the county engineer. Carried 4-0. Copy filed.
Motion by Boykin second by Clausen to approve and receive for signatures Resolution No. 9695 to add a locally funded project, Project No. L-EWP 03(1)73-97, to the current construction program, per recommendation of the county engineer. Carried 4-0.

BE IT RESOLVED: That the Board of Supervisors of Woodbury County, Iowa, initiates and recommends that the following project be approved by the Iowa Department of Transportation (Iowa DOT) for improvement with the funds as shown below for the period covering the current secondary road construction program.

Motion by Batcheller second by Clausen to authorize the Chairman to sign a Utility Accommodation Permit submitted by Qwest to install an underground telephone line along a section of Osceola Ave. north of 300th Street, per recommendation of the county engineer. Carried 4-0. Copy filed.
The Public Hearing on the status of funded activities for the alterations to the office building for Siouxland District Health Department at 1014 Nebraska Street, Sioux City, was held at 10:30 AM. The Chairman called on anyone wishing to be heard.
Mike Neswick, RML Architects, reported on the building progress.
Motion by Clausen second by Batcheller to close the Public Hearing on the status of funded activities for the alterations to office building (Project No. 0032) for Siouxland District Health Department as there was no one present wishing to be heard. Carried 4-0. Copy filed.
Fran Sadden of District Health reported on the building status.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Marvin Norby requested a second opinion of the Board regarding refunding the money for Ag Land Credit which was omitted on his real estate taxes last year. Mr. Norby reported the Ag Land Credit was not on this years or last years tax statement. The Board pointed out that the error was being corrected for this year but could not refund anything for last year.
Motion by Batcheller second by Clausen to accept the bid from Winkler Roofing of $11,888.00 for emergency repair of the Climbing Hill gymnasium roof. Carried 4-0.
John Pylelo, Zoning Director, presented a copy of zoning issues received from Kevin Alexander.
Board took a five minute recess.
Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 21.5(1) (c). Carried 4-0 on roll call vote.
Motion by Boykin second by Clausen to go out of Executive Session. Carried 4-0 on roll call vote.
Motion by Batcheller second by Boykin to approve the recommendation of the attorney as presented in Executive Session. Carried 4-0.
The Board adjourned the regular meeting until September 2, 2003.
