AUGUST 19, 2003 EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, August 19, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, and Welte. Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel. The Board appointed Maurice Welte as Chairman Pro-tem.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Boykin second by Clausen to approve the Board minutes of August 12, 2003 as submitted. Carried 4-0.
Motion by Batcheller second by Boykin to approve the minutes of the Executive Session of August 12, 2003 as submitted. Carried 4-0.
The Board approved the end of leave of absence for Paul A. Prather, Maintenance Technician, Building Services Dept., effective 8-11-03. Copy filed.
The Board approved the reclassification of Nancy M. Carstensen, P/T Clerk M.V. Dept., County Treasurer Dept., @$11.82, effective 8-26-03. Per AFSCME Cthouse. Contract agreement, from Grade 4, Step 2 to Grade 4, Step 3. Copy filed.
The Board approved the reclassification of Dawn R. Anderson, Clerk III Vital Statistics, County Auditor/Recorder Dept., @$14.02/hour, effective 9-04-03. Per AFSCME Cthouse. Contract agreement, from Grade 6, Sep 2 to Grade 6, Step 3. Copy filed.
Motion by Boykin second by Batcheller to approve and authorize the Chairman Pro-tem to sign Resolution No. 9690 approving tax suspension for B.M.T. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES
WHEREAS, Berniece M. Temoshek, as titleholder of property located at 607 S. Westcott Street., Sioux City, Woodbury County, Iowa, and legally described as follows:

South 39 1/2 Feet North 79 Feet East 134 Feet North 1/2 Block 35 CB Rustin & Co Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Berniece M. Temoshek as titleholders of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Clausen to approve and authorize the Chairman Pro-tem to sign a resolution approving tax suspension for P.M. The motion was withdrawn. Motion by Batcheller second by Clausen to table signing the Resolution. Carried 4-0.
Motion by Batcheller second by Clausen to authorize the Chairman Pro-Tem to sign list of applications for impoundment structure property tax exemption for 2003 exemption file as submitted by Kathy Sands, Woodbury County Assessor. Carried 3-0; Welte abstained. Copy filed.
Motion by Batcheller second by Clausen to authorize Chairman Pro-tem to sign letter of support for Woodbury County Landfill transfer station. Carried 4-0. Copy filed.
Tim Stiles, United Way President, made a presentation of a plaque of appreciation to Woodbury County.
Motion by Batcheller second by Boykin to authorize Chairman Pro-tem to sign Utility Accommodation Permit submitted by Long Lines, Sergeant Bluff, Iowa, for installation of underground telephone line along a section of 290th Street between Dallas and Eastland Avenues, per recommendation of the county engineer. Carried 4-0. Copy filed.
Bid letting was held for 2003-04 propane.

Motion by Clausen second by Batcheller to receive the bids for 2003-04 propane and submit to the county engineer for review and recommendation. Carried 4-0. Copy filed.
The Chairman Pro-tem asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Discussion with Kevin Alexander of K and L Landscaping, and John Pylelo, County Zoning Administrator, regarding the use, grandfather rights and use of equipment on his present home. Kevin would like to construct a new shop building on South Ridge Road, with a projected completion date of May 15, 2004. Boykin requested a written agreement from Kevin stating May 15, 2004 as the completion date, to be voted upon at the next regular Board of Supervisors meeting.
The Board adjourned the regular meeting until August 26, 2003.
