JULY 8, 2003 SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 8, 2003 at 9:00 a.m. Board members present were Batcheller, Clausen, Walish and Welte, Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Mr. Batcheller excused himself at 9:55 a.m.

Meeting called to order.

Motion by Welte second by Clausen to approve the Board minutes of July 1, 2003 as submitted. Carried 3-0.

The Board approved the reclassification of Carrie A. Stamm, Correctional Officer, County Sheriff Dept., @$16.80/hr., effective 07-05-03. Per DSA contract agreement, from Class 3 to Sr. Class, due to 4 years service plus BS Degree. Copy filed.

The Board approved the reclassification of Sara J. Miller, Correctional Officer, County Sheriff Dept., @$16.80/hr., effective 07-07-03. Per DSA contract agreement, from Class 1 to Sr. Class, due to 6 years service plus AAS Degree. Copy filed.

The Board approved the reclassification of Ryan L. McCrory, Correctional Officer, County Sheriff Dept., @$16.80/hr., effective 07-07-03. Per DSA contract agreement, from Class 1 to Sr. Class, due to 6 years service plus AAS Degree. Copy filed.

The Board approved the appointment of Anthony J. Fitch, Correctional Officer, County Sheriff Dept., @$14.18/hr., effective 07-15-03. Job Vacancy Posted: 05-13-03. Entry Level Salary: $14.18/hour-04 FY. Copy filed.

The Board approved the separation of Timothy W. Kimpson, Correctional Officer, County Sheriff Dept., effective 07-17-03. Resignation. Copy filed.

Motion by Welte second by Clausen to approve and authorize the Chairman to sign the authorization to initiate hiring process for (1) Male Correctional Officer, County Sheriff Dept. DSA Entry: $14.18/hr. Carried 3-0. Copy filed.

Motion by Clausen second by Welte to receive the Sheriffs Report of Condemnation funds for fiscal year ending June 30, 2003. Carried 3-0. Copy filed.

Motion by Welte second by Clausen to authorize the Chairman to sign an agreement for engineering services with HGM Associates, Omaha, NE, for preliminary design of bridge replacement on Route D-38 over Wolf Creek, per recommendation of the county engineer.

Motion by Clausen second by Welte to authorize the Chairman to sign an agreement for engineering services with HGM Associates Inc., Omaha, NE, for preliminary design of bridge replacement on Route D-38 over east branch of Wolf Creek, per recommendation of the county engineer. The Board discussed a request for the County to vacate a portion of excess right-of-way in Section 12 of Kedron Township.

Motion by Welte second by Clausen to approve and authorize the Chairman to sign final plats for Reinholdts Subdivision, submitted by Mrs. Violet Reinholdt, per recommendation of the Zoning Commission. Carried 3-0.

RESOLUTION NO. 9670

RESOLUTION ACCEPTING AND APPROVING REINHOLDT SUBDIVISION, WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 8th DAY OF JULY, 2003, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS REINHOLDT SUBDIVISION, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IWOA, THAT THE PLAT OF REINHOLDT SUBDIVISION, WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRPERSON AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVIOSRS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

Motion by Clausen second by Welte to approve the preliminary plats for Russells Addition Subdivision and refer to the Zoning Commission. Carried 3-0. Copy filed.

Motion by Clausen second by Welte to approve tax abatements, per recommendation of the County Treasurer, for Danbury Elevator Co., Inc., which is for a grain tax that has not been assessed since 1997, Parcel #9100010; for Gordon D. or Dawn R. Brown, a building on leased land for a junked mobile home, Parcel #981319; and for TA Escrow, for an erroneously created parcel and a duplication of other parcels, Parcel #563025. Carried 3-0. The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

State Senator Ron Wieck and Mark Pottorff, 113 Pioneer Valley Drive, Sergeant Bluff, addressed the Board with concerns about the Board of Adjustment process.

The Board adjourned the regular meeting until July 15, 2003.
