JULY 1, 2003 FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 1, 2003 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Clausen to approve the Board minutes of July 24, 2003 as submitted. Carried 5-0.

The Board approved the separation of Debbie R. Cooper, Correctional Officer, County Sheriff Dept., effective 7-9-03. Resignation. Copy filed.

The Board approved the reclassification of Michael R. Clayton, First Deputy M.V. Dept., County Treasurer Dept., @$45,971/year, effective 7-01-03. Per County Treasurer for Percentage Appointed Deputy. Copy filed.

The Board approved the reclassification of Linda G. Shelton, License Deputy M.V. Dept., County Treasurer Dept., @$41,231/year, effective 7-01-03. Per County Treasurer for Percentage Appointed Deputy. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Female Correctional Officer, County Sheriff Dept. DSA Entry: $14.18/hour. Carried 5-0. Copy filed.

Motion by Welte second by Boykin to approve the request of retiree Georgia V. Schieffer to remain on Woodbury County health insurance plan. Carried 5-0. Copy filed.

Motion by Clausen second by Welte to approve lifting tax suspension for E.V. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve re-appointment of Ronald Kerr to the Commission of Veteran Affairs. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and receive for signatures a Resolution No. 9661 thanking and commending Georgia V. Schieffer, MSW, for her years of service to Woodbury County. Carried 5-0.

A RESOLUTION THANKING AND COMMENDING

GEORGIA V. SCHIEFFER, MSW

FOR HER SERVICE TO WOODBURY COUNTY

WHEREAS, Georgia V. Schieffer has capably served Woodbury County as an employee of the Woodbury County General Relief Department from September of 1980 to September 2003; and

WHEREAS, the service given by Georgia V. Schieffer as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Georgia V. Schieffer for her years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Georgia V. Schieffer; and

BE IT SO RESOLVED this 1st day of July, 2003.

The Public Hearing and Sale of Real Estate Parcel #435915 also known as 1829 W. 1st Street, Sioux City, IA, was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #435915 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #435915. Miguel Ramos bid $1,048.00 plus recording fees. There were no further bids.

Motion by Batchller second by Boykin to accept Miguels bid for $1,048.00 plus recording fees on Real Estate Parcel #435915. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Miguel Ramos in the sum of One-Thousand and Forty-Eight Dollars ($1,048.00)

For the following described real estate, To Wit:

Parcel #435915

Riverview 2nd Addition, City of Sioux City, Woodbury County
Lot 8 Block 5
(1829 W 1st St, Sioux City IA 51101)

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Boykin second by Welte to approve the re-organization and transition of the General Relief Department to the Woodbury County Community Action Agency to provide general relief services to residents of Woodbury County. Carried 5-0. Copy filed.

Motion by Welte second by Boykin to authorize the Chairman to sign Utility Accommodation Permit submitted by Qwest, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Welte second by Boykin to recess the regular meeting to convene a meeting of trustees for the drainage districts under the direct control of the Woodbury County Board of Supervisors as trustees. Carried 5-0.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign a resolution levying special assessment of $2,000.00 for the Hackley Lateral drainage district for FY 2003-04. Carried 5-0.

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Hackley Lateral Drainage District of Woodbury County, Iowa; and
WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Hackley Lateral Drainage District, that a special tax and/or assessment in the sum of $2,000 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Pumping District.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District, that a special tax and/or assessment in the sum of $10,000 be levied against all the tracts of land, lots, railroad companies and public highways within said Pumping District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

The Board discussed the consideration of application for refund of erroneous tax for Parcel #369998.

Motion by Clausen second by Boykin to deny the request based on the advice of Board Legal Counsel. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to authorize the Chairman to sign Memorandum of Understanding with the Iowa Department of Public Health. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Clausen second by Batcheller to go into executive session under Iowa Code Section 20.17 (3). Carried 5-0 on a roll call vote.

Motion by Boykin second by Clausen to go out of executive session. Carried 5-0 on a roll call vote.

The Board adjourned the regular meeting until July 8, 2003.
