APRIL 29, 2003FORTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 29, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

Meeting called to order.
Motion by Batcheller second by Clausen to approve the Board minutes of April 22, 2003 as submitted. Carried 5-0.
The Board approved the appointment of Mary E. Peters, P/T Youth Worker, Juvenile Detention Dept., @$12.03/hour, effective 4-30-03. Job Vacancy Posted: 3-12-03. Entry Level Salary: $12.03/hour. Copy filed.
The Board approved the appointment of Brent R. Eickholt, Correctional Officer, County Sheriff Dept., @$13.70/hour, effective 4-30-03. Job Vacancy Posted: 3-05-03. Entry Level Salary: $13.70/hour. Copy filed.
The Board approved the reclassification of John J. Sullivan, Assistant County Attorney-Civil Division, County Attorney Dept., @$45,312/year, effective 5-01-03. Wage Plan Anniversary Increase per comparison to AFSCME Attorney Contract, from Step 3 to Step 4 level. Copy filed.
The Board approved the appointment of Joseph P. Bukovich, Correctional Officer, County Sheriff Dept., @$13.70/hour, effective 5-03-03. Job Vacancy Posted: 3-05-03. Entry Level Salary: $13.70/hour. Copy filed.
The Board approved the reclassification of Christopher A. Persinger, Deputy Sheriff, County Sheriff Dept., @$19.56/hour, effective 5-12-03. Per D.S.A. Contract agreement, from Class 2 to Class 1. Copy filed.
Ms. Cathy Mengel from First Administrators, Inc. gave an update and recommendations pertaining to the Countys self-funded health insurance program.
Motion by Boykin second by Batcheller to approve a stop loss policy of $100,000.00 for health insurance as recommended. Carried 5-0. Copy filed.
Motion by Welte second by Boykin to approve a premium increase of fifteen percent for the countys self-insured health insurance program as of July 1, 2003. Carried 5-0.
Motion by Clausen second by Batcheller to receive the County Recorders Report of Fees Collected for the period of 1/1/03 through 3/31/03. Carried 5-0. Copy filed.
Gary Brown, Director, Woodbury County Disaster & Emergency Services, discussed Community Emergency Response Team (CERT) training for county employees.
Motion by Boykin second by Batcheller to approve CERT training for county employees. Carried 5-0. Copy filed.
The Board discussed Emergency Medical Services loan for Danbury Ambulance.
Motion by Welte second by Boykin to approve Danbury Ambulance loan, per recommendation of the EMS Loan Fund Board. Carried 5-0. Copy filed.
Motion by Welte second by Boykin to approve and authorize the Chairman to sign Resolution No. 9648 establishing weed destruction program for 2003. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION NO. 9648
WEED DESTRUCTION ORDER
WHEREAS, it is the responsibility of each of Iowa Countys Board of Supervisors to enforce the provisions of Chapter 317 of the Code of Iowa as amended with regard to the destruction of weeds, and
WHEREAS, under Chapter 317 of the Code of Iowa as amended each county Board of Supervisors must prescribe and order a program of weed destruction to be followed by landowners, tenants, and other persons in possession or control of land, and
WHEREAS, it has been determined by the Woodbury County Board of Supervisors that a program of weed destruction for the year 2003 is necessary,
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that each landowner, tenant or other person in possession or control of private land shall on or before the dates stated below, destroy the below-listed noxious weeds on their land by spraying them with a suitable herbicide in a strength sufficient to kill such weeds.
1. May 25, 2003 - for musk, thistle, sow thistle, bull thistle, leafy spurge, perennial pepper grass, sour dock perennial, smooth dock perennial, and sheep sorrel perennial.
2. June 1, 2003 - for Canada thistle, Russian knapweed, buckhorn perennial, wild mustard annual, horse nettle, and teasel biennial.
3. June 10, 2003 - for field bindweed, wild carrot biennial, and quack grass.
4. June 15, 2003 - for butterprint annual, puncture vine annual, and cocklebur annual.
5. July 15, 2003 - for wild sunflower annual and poison hemlock.
6. October 1, 2003 - all thistles in the rosette stage.
BE IT FURTHER RESOLVED AND ORDERED that all weeds on county trunk and local roads and between the fence lines of such roads, whether they be noxious weeds or other weeds, shall be cut or otherwise destroyed, to prevent seed production, by the owner of the land adjoining the road on or before June 25, 2003.
BE IT FURTHER RESOLVED that weeds that are not destroyed in compliance with the above order may be destroyed by the Weed Commissioner, and the costs of destruction by the Weed Commissioner, including the cost of serving notice, plus a penalty of twenty-five percent of total costs shall be assessed against the property upon which the weeds were destroyed, in the case of private lands, or against the adjoining land, in the case of weeds on county roads. Landowners are to contact Weed Commissioner and notify him if there are areas that should not be sprayed with herbicides.

Social Services Coordinator Patty Erickson-Puttmann and the Board discussed Change Order #4 of Courthouse Restoration
Motion by Batcheller second by Boykin to approve Change Order #4, excluding item 3, of Courthouse Restoration Phase V Renovation. Carried 5-0. Copy filed.
Motion by Clausen second by Batcheller to approve a request from Paul Dunn for an extension until September 1, 2003 to comply with the county zoning ordinance. Carried 5-0. Copy filed.
Motion by Batcheller second by Boykin to adjourn the Board meeting to convene a Wolf Creek Drainage District meeting. Carried 5-0.
There was a discussion concerning the intersection of 320th Street and Hancock Avenue drainage tube replacement.
Motion by Boykin second by Welte to adjourn Wolf Creek Drainage District Meeting. Carried 5-0.
The Chairman called the regular meeting to order.
The Board discussed Proposed House File 691 by State Legislature and the effect it will have on Woodbury County.
Motion by Batcheller second by Boykin to approve a resolution asking the Governor to veto the reinvention bill and to authorize the Chairman to sign an accompanying letter. Carried 5-0.
RESOLUTION #9649
WHEREAS, the Iowa Legislature has passed Senate File 453 and presented it to Governor
Vilsack, so that unless the Governor vetoes the bill it will become law; and
WHEREAS, the $70 million in funding cuts proposed by this misnamed Reinventing
Government bill would have a disastrous effect on the services provided by local governments
across Iowa; and
WHEREAS, Senate File 453 breaks promises that the state made to local governments, and
would result in cuts to locally provided services such as parks, libraries, law enforcement and
fire protection; and
WHEREAS, the Gronstal Amendment and the Miller/Brunkhorst amendment were workable,
realistic amendments to Senate File 453 that would have balanced the budget but used state
resources to spare some of the cuts to local governments:
THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY that the board urges Governor Vilsack to veto Senate File 453.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Jim Jung, 2222 Jackson Street, Sioux City addressed the Board with concerns about tax dollar expenditures.
The Board adjourned the regular meeting until May 6, 2003.
