APRIL 1, 2003THIRTY-NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 1, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen and Walish; Welte was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
The Board canvassed the Sergeant Bluff-Luton Community School District Special Election held on the 25th day of March, 2003, with the following official results.
Victoria L. Ritz, Deputy Commissioner of Elections, announced there were no after election absentee ballots or special challenged ballots received or added to the tally.
For the special proposition, upon the public measure Question A: Shall the Board of Directors of the Sergeant Bluff-Luton Community School District, in the County of Woodbury, State of Iowa, be authorized to levy a tax of not to exceed thirteen and one-half cents (13.5 cents) per thousand dollars of assessed valuation in the School District for public educational and recreational activities and community education purposes?
There were Five-hundred three, (503) ballots cast as follows:
For the question there were One-hundred forty, (140) votes cast.
Against the question there were Three-hundred sixty-three, (363) votes cast.
We therefore declare the public measure Question A not to be adopted.
Motion by Batcheller second by Boykin to accept the official canvass for the Sergeant Bluff-Luton Community School District Special Election held on March 25, 2003. Carried 4-0. Copy filed.

Motion by Boykin second by Clausen to approve the Board minutes of March 25, 2003 as submitted. Carried 4-0.
Motion by Batcheller second by Boykin to approve the minutes of the Executive Session of March 25, 2003 as submitted. Carried 4-0.
The Board approved the reclassification of Mat R. Cook, Correctional Officer, County Sheriff Dept., @$14.22/hour, effective 4-10-03. Per DSA Contract agreement, from Class 1 to Class 2. Copy filed.
The Board approved Sonya D. Pierce, Interim General Assistance Administrator, Board Administration, @$17.86/hour, effective 3-31-03. 4-6 weeks Interim Administrative duties for General Assistance Dept. Copy filed.
There was a discussion of IPERS benefits to Woodbury County Mental Health Advocate.
Motion by Boykin second by Clausen to approve proceeding with writing a procedure to provide IPERS benefits for Woodbury County Mental Health Advocate. Carried 4-0. Copy filed.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign Class C Liquor License renewal application, Outdoor Services and Sunday Sales Privilege for HooHaa, Inc., d/b/a Twenty Seven Flags Golf Course, 2299 Alicia Ave., Sergeant Bluff, IA. Carried 4-0. Copy filed.
Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign Resolution No. 9631 for interfund operating transfer from the General Supplemental to the General Basic Fund during the FY 2003 budget year. Carried 4-0.
Resolution for Interfund Operating Transfer # 9631
Whereas, it is desired to authorize the Auditor to periodically transfer sums from the General
Supplemental to the General Basic Fund during the Fiscal Year 2002-03 budget year, and
Whereas, said transfers must be in accordance with Section 331.432 Code of Iowa,
Whereas, the purpose of the transfers are to fund the appropriations for the matching FICA, IPERS, Health Insurance, Life Insurance and LTD costs expended from the General Basic Fund.
Now, therefore be it resolved by the Board of Supervisors of Woodbury County, Iowa, as follows:
The total maximum transfers from the General Supplemental Fund to the General Basic
Fund for the fiscal year beginning July 1, 2002, shall not exceed the sum of $ 2,212,064.
The Auditor is directed to correct his books when said operating transfers are made and to notify
the Treasurer of the amounts of said transfers.
The above and foregoing resolution was adopted by the Board of Supervisors of Woodbury County

Whereas, it is desired to authorize the Auditor to periodically transfer sums from the Rural Basic
Services Fund to the County Library Fund during the Fiscal Year 2002-03 budget year, and
Whereas, said transfers must be in accordance with Section 331.432 Code of Iowa,
Whereas, the purpose of the transfers are to move the taxes, levied on the township valuations, to
The County Library Fund to pay the their share of the expenses of the County Library.
Now, therefore be it resolved by the Board of Supervisors of Woodbury County, Iowa, as follows:
The total maximum transfers from the Rural Basic Services Fund to the County Library Fund
for the fiscal year beginning July 1, 2002, shall not exceed the sum of $ 107,461.
The Auditor is directed to correct his books when said operating transfers are made and to notify
The Treasurer of the amounts of said transfers.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign Resolution No. 9633 for interfund operating transfer from the General Basic Fund to the Debt Service Fund during the FY 2003 budget year. Carried 4-0.
Resolution for Interfund Operating Transfer # 9633
Whereas, it is desired to authorize the Auditor to periodically transfer sums from the General Basic
Fund to the Debt Service Fund during the Fiscal Year 2002-03 budget year, and
Whereas, said transfer must be in accordance with Section 331.432 Code of Iowa,
Whereas, the purpose of the transfer is to fund the Sheriff's law enforcement software package,
the 3rd payment of 5, out of the Debt Service Fund.
Now, therefore be it resolved by the Board of Supervisors of Woodbury County, Iowa, as follows:
The total maximum transfers from the General Basic Fund to the Debt Service Fund for the
fiscal year beginning July 1, 2002, shall not exceed the sum of $ 97,406.
The Auditor is directed to correct his books when said operating transfers are made and to notify
the Treasurer of the amounts of said transfers.

Services Fund to the Secondary Roads Fund during the Fiscal Year 2002-03 budget year, and
Whereas, said transfers must be in accordance with Section 331.432 Code of Iowa,
Whereas, the purpose of the transfers are to move the taxes, levied on the township valuations, to
the Secondary Roads Fund to pay their share of the expenses of the Secondary Roads Fund.
Now, therefore be it resolved by the Board of Supervisors of Woodbury County, Iowa, as follows:
The total maximum transfers from the Rural Basic Services Fund to the Secondary Roads Fund
for the fiscal year beginning July 1, 2002, shall not exceed the sum of $ 705,000.
The Auditor is directed to correct his books when said operating transfers are made and to notify
the Treasurer of the amounts of said transfers.

The Board discussed Change Order #3 Courthouse Restoration Phase V.
Motion by Batcheller second by Boykin to approve Change Order #3 Courthouse Restoration Phase V to decrease contract sum by $45.00. Carried 4-0. Copy filed.
Motion by Boykin second by Clausen to approve the appointment of Cheryl M. Spear to the Woodbury County Community Action Agency Board of Directors, representing the northeastern area of Woodbury County. Carried 4-0. Copy filed.
Gary Niles of Juvenile Court Services and the Board discussed Memorandum of Understanding to participate in Drug Court Grant.
Motion by Batcheller second by Boykin to authorize the Chairman to sign Memorandum of Understanding to participate in Drug Court Grant. Carried 4-0. Copy filed.
The Board had a discussion of a proposal for cellular services from Verizon Wireless.
Motion by Batcheller second by Boykin to approve the proposal for cellular services from Verizon Wireless. Carried 4-0. Copy filed.
There was a discussion on proposal for statewide tax increment renewal plan.
Motion by Clausen second by Boykin to authorize the Chairman to sign a letter in support of a statewide Tax Increment Financing (TIF) renewal plan. Carried 4-0. Copy filed.
Richard Storm, Woodbury County Engineer, gave a presentation on draft of Five-Year Secondary Roads Construction Program.
County engineer presented a signed petition to upgrade 220th Street to the Board.
Russ Olson, 1445 220th, Bob Rogers, 1455 220th, Garrett Anfinson, 1488 220th, Arland Freiberg, 2287 Buchanan, Roy Chrisman, 1371 220th, Elaine Thompson, 1493 200th, and Beth Hickey, 1503 220th discussed the petition to upgrade with the Board.
The Board discussed the Zoning Department vacancy.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until April 8, 2003.
