MARCH 25, 2003THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 25, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen and Walish, Welte was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Boykin second by Batcheller to approve the Board minutes of March 18, 2003 as submitted. Carried 3-0, Clausen abstained.
Motion by Batcheller second by Boykin to approve the minutes of the Executive Session of March 18, 2003 as submitted. Carried 3-0, Clausen abstained.
Motion by Boykin second by Clausen to approve lifting of tax suspension on Parcel #248250 for M.C. Carried 4-0. Copy filed.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an application for a Class C Liquor License, Sunday Sales and Outdoor Privilege for Anthon Golf Club, Inc., 2236 Hwy 31, Anthon, IA. Carried 4-0. Copy filed.
Motion by Clausen second by Boykin to approve abatement of taxes due 2002-2003 for real estate Parcel #129360. Carried 4-0. Copy filed.
Motion by Boykin second by Batcheller to authorize the Chairman to sign proposal submitted by Steffen Engineering & Testing to abandon wells at two sites in Hornick and Danbury, Iowa, per recommendation of the county engineer. Carried 4-0. Copy filed.
There was a discussion of draft of 5-year Secondary Roads Construction Program.
There was a discussion of Woodbury County cell phones.
The Public Hearing was held at 10:30 a.m. regarding the Woodbury County Mental Health Services Management Plan. The Chairman called on anyone wishing to be heard on said Mental Health Planning.
Motion by Boykin second by Batcheller to close the Public Hearing on Mental Health Services Management Plan as there was no one present wishing to be heard. Carried 4-0.
Motion by Boykin second by Clausen to approve Woodbury County Mental Health Services Management 3-Year Strategic Plan. Carried 4-0. Copy filed.
The Board discussed Change Order #2 Courthouse Restoration Phase V.
Motion by Batcheller second by Boykin to approve Change Order #2 Courthouse Restoration Phase V. Carried 4-0. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Boykin second by Clausen to receive for signatures a resolution to support Senator Steve Warnstadts agenda to support our troops in the Persian Gulf. Carried 4-0.
IOWANS CALLED TO DUTY SERVICE MEMBER SUPPORT AGENDA
Resolution No. 9629
Whereas: More than 2,000 Iowans in the Iowa National Guard, the Reserve and on active duty have been called to duty in Iraq and for Homeland Security;
Whereas: These Iowans are disrupting their lives and families to serve their country;
Whereas: The Service Members Support Agenda is a collection of common sense suggestions developed in consultation with Iowa service members that the state of Iowa can do to help ease the stresses they and their families face. These are no-cost and low-cost steps that include delayed filing of taxes, tuition rebates for students forced to leave classes for the military, allowing service members to deduct military expenses, and the elimination of state taxes on death benefits;
Whereas: In a month the Iowa Legislature is scheduled to finish its session and none of these messages have passed the Legislature;
Be it therefore enacted: That the Woodbury County Board of Supervisors urge the Iowa Legislature make supporting Iowans called to duty a top priority and consider these measures on the floor of the Iowa House and Senate as soon as possible and take action before the end of the session.
So enacted this 25th day of March, 2003.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a resolution to provide property tax relief for our citizen soldiers in the Persian Gulf. Carried 4-0.

Property Tax Relief for Woodbury County Service Personnel Called to Active Duty
Whereas: Citizen Soldiers who are property owners in Woodbury County, namely the members of the Iowa National Guard and the Reserve, many of which are being called to duty in Iraq and for Homeland Security.
Whereas: These Woodbury County citizens are disrupting their lives and families to serve their county.
Whereas: The Iowa National Guard Members and Reservists who are property owners of Woodbury County may encounter a problem in contributing to the Public Fund in the form of property tax payment.
Be it therefore enacted: The Woodbury County Board of Supervisors empowers the Woodbury County Treasurer to suspend the property taxes, without interest, until such time the Guardsman or Reservist returns to their normal civilian employment and again has the resources to bring their property taxes up to date.

County Attorney Tom Mullin and Sheriff David Amick discussed with the Board the consideration of the county participating with the City of Sioux City in the Edward Byrne Memorial State and Local Law Enforcement Assistant Grant Application.
Motion by Boykin second by Batcheller to approve participation with City of Sioux City in the submission of the Edward Byrne Memorial State and Local Law Enforcement Assistant Grant Application to the Governors Office of Drug Control Policy. Carried 4-0. Copy filed.
Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 20.17(3). Carried 4-0 on a roll call vote.
Motion by Boykin second by Clausen to go out of Executive Session. Carried 4-0 on a roll call vote.
The Board adjourned the regular meeting until April 1, 2003.
