MARCH 4, 2003THIRTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 4, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Welte second by Boykin to approve the Board minutes of February 25, 2003 as submitted. Carried 4-0, Batcheller abstained.

Motion by Boykin second by Clausen to approve the minutes of the Executive Session of February 25, 2003 as submitted. Carried 4-0, Batcheller abstained.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a resolution approving petition for suspension of taxes for M.C. Carried 5-0.

RESOLUTION # 9623

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Mary T. Castle, as titleholders of real estate located at 2020 Nebraska Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Two (2) Block Twenty-Seven (27), Higmans 2nd Addition,
Sioux City,Woodbury County, Iowa


WHEREAS, Mary T. Castle as titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 4th day of March, 2003.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Phyllis McLarty is the titleholder of real estate Parcel #650161, located in, the City of Smithland and legally described as follows:

B/LL Loc on P#650160 Lot One (1) Block Two (2) City of Smithland, Woodbury County, Iowa

WHEREAS, the above stated property has taxes payable for 2002-2003, and the parcel is owned by Phyllis McLarty; and

WHEREAS, the value placed on the above-stated property is incorrect; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.62, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Easley Division
South 11 (Eleven Feet) and Pt West 10 (Ten Feet) Vacated Street adjacent to Lot 3 (Three) Block 2 (Two). City of Sioux City, Iowa, all in Woodbury County, Iowa.
(2743 Virginia Street an 11 x 135 lot)

NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 18th Day of March, 2003, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 18th Day of March, 2003, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 250.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

Motion by Welte second by Boykin to receive the bids and accept the quote of Sioux Commercial Sweeping, Sioux Center, Iowa at a cost of $41,940.00 for crack sealing and joint repair, per recommendation of the county engineer. Carried 5-0. Copy filed.

The process for replacing the Planning & Zoning Administrator was discussed with Dick Storm, and Jerry Hanson and Brent Nelson of the City.

The Board approved the promotion of Danielle J. Dempster, Service Officer, Veteran Affairs Dept., @$14.42/hour, effective 3-9-03. End of Probation Salary Increase. Copy filed.

Motion by Clausen second by Boykin to authorize the Chairman to sign the authorization to initiate the hiring process, excluding Planning & Zoning Administrator, for 5 Temporary Summer Laborers, Secondary Roads Dept., $7.50-$8.50/hour based on experience; and for 2 Temporary Summer Engineering Aides, Secondary Roads Dept., $7.50-$11.00/hour based on experience. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to approve and receive for signatures a resolution for Proclamation in support of Mental Retardation Awareness Month. Carried 5-0.


WOODBURY COUNTY, IOWA

RESOLUTION NO. 9626

PROCLAMATION

IN SUPPORT OF MENTAL RETARDATION AWARENESS MONTH

WHEREAS mental retardation is a condition which today affects more than seven million American children and adults and their families; and

WHEREAS public awareness and education enhance a communitys understanding of the issues affecting people with mental retardation; and

WHEREAS the month of March has been designated National Mental Retardation Awareness Month, with more than 120,000 members and 1,000 chapters of the Arc undertaking public awareness, educational, and fundraising initiatives; and

WHEREAS The Arc of the United States is the nations leading volunteer-based organization
advocating for and with people with mental retardation and related developmental
disabilities and their families; and

THEREFORE the Woodbury County Board of Supervisors hereby proclaims March 2003

MENTAL RETARDATION AWARENESS MONTH

in Woodbury County, Iowa, and urges the citizens to give full support to efforts toward enabling people with mental retardation to live productive lives of inclusion in our communities.

SO RESOLVED this 4th day of March, 2003.

There was a discussion with County Treasurer Bob Knowler, concerning submission of a grant application on behalf of the Sesquicentennial Committee.

Motion by Boykin second by Clausen to approve the submission of a grant application on behalf of the Sesquicentennial Committee to the Missouri River Historical Development. Carried 5-0. Copy filed.

The Board discussed a request by Gary Brown, Disaster and Emergency Services Director, to submit a grant application to the Missouri River Historical Development.

Motion by Boykin second by Clausen to approve the submission of a grant application on behalf of the Disaster and Emergency Services to the Missouri River Historical Development. Carried 5-0. Copy filed.

There was a discussion with Sheriff David Amick concerning submission of a grant application on behalf of the K-9 Division to the Missouri River Historical Development.

Motion by Boykin second by Welte to approve the submission of a grant application on behalf of the County Sheriff K-9 Division to the Missouri River Historical Development. Carried 5-0. Copy filed.

The Board discussed the consideration of the LAWCON Grant Application on behalf of the Woodbury County Conservation with Rick Schneider, Conservation Director.

Motion by Boykin second by Welte to approve the submission of the LAWCON Grant Application to the Department of Natural Resources, on behalf of Woodbury County Conservation. Carried 5-0. Copy filed.

There was a discussion concerning the collaboration of Woodbury County General Relief with Woodbury County Community Action Agency.

Motion by Clausen second by Batcheller to relocate General Relief to 2700 Leech Avenue. Carried 5-0.

The Board discussed Compensation Board recommendations.

Motion by Clausen second by Welte to reduce the Compensation Board recommendations to 0% for all elected officials. Carried 3-2, Walish and Boykin opposed. Copy filed.

The Board discussed wage plan salaries.

Motion by Boykin second by Walish to approve wage plan salary increases of 3.5%. Carried 3-2, Batcheller and Welte opposed. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 20.17(3). Carried 5-0 on roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until March 11, 2003.
