DECEMBER 17, 2002TWENTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, December 17, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Boykin to approve the Board minutes of December 10, 2002 as submitted. Carried 4-0, Batcheller abstained.

Motion by Welte second by Walish to approve the minutes of Executive Session of December 10, 2002 as submitted. Carried 4-0, Batcheller abstained.

The Board approved the reclassification of Patrick E. Hinrichsen, Deputy Sheriff, County Sheriff Dept., @$19.56/hour, effective 1-3-03. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Sara J. Miller, Correctional Officer, County Sheriff Dept., @$15.39/hour, effective 1-07-03. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Ryan L. McCrory, Correctional Officer, County Sheriff Dept., @$15.39/hour, effective 1-07-03. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of David M. Junge, Correctional Officer, County Sheriff Dept., @$15.39/hour, effective 1-08-03. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Drew H. Bockenstedt, Assistant County Attorney, County Attorney Dept., @$49,520/year, effective 1-10-03. Per Asst. County Attorney Contract agreement, from Step 5 to Step 6. Copy filed.

Mike Miranda from Siouxland Benefit Consultants and the Board discussed Woodbury Countys Cafeteria/Flex Plan.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign the Cafeteria/Flex Plan document. Carried 5-0. Copy filed.

J.D. Pellersels, Human Resource Director, and the Board discussed the Woodbury County Health and Insurance Portability and Accountability Act (HIPAA) for private medical information of individuals.

Motion by Boykin second by Batcheller to establish Woodbury County HIPAA Compliance Committee. Carried 5-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #039870 was held at 10:18 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Walish to close the Public Hearing on the sale of Real Estate Parcel #039870 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #039870. Rick Rembe bid $270.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Boykin to accept Rick Rembes bid of $270.00 plus recording fees on Real Estate Parcel #039870. Carried 5-0.


RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION # 9606


BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Richard Cyril Rembe in the sum of $ Two-Hundred and Seventy Dollars ($ 270.00)

for the following described real estate, To Wit:

Parcel #039870

W (west) 75 Feet S (south) 37 Feet Lot 10 Block 137
(715 Court Street, Sioux City IA 51105)

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real

Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed Grant Applications from the State of Iowa.

Motion by Boykin second by Walish to approve the 'Planning' FY 2002 Supplemental Funding Grant Number CFDA 83.562 grant application, the Citizen Corps FY 2002 Supplemental Grant Number CFDA 83.564 grant application and the CERT FY 2002 Supplemental Grant Number CFDA 83.564 grant application. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to set the Public Hearing and Sale of Real Estate Parcel #026265 on January 14, 2003 at 10:15 A.M. Carried 5-0.

Motion by Boykin second by Walish to approve a three year County Farm Lease. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve a three year Lease of Farm Structures. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve tax abatement of personal assessed as real estate, buildings on leased land and non-taxable real estate. Carried 5-0. Copy filed.

Motion by Welte second by Walish to approve 28E Agreement between Woodbury County and the Iowa Department of Human Services for partial funding of the Sanford Gang Prevention Program. Carried 4-0, Boykin abstained. Copy filed.

Motion by Batcheller second by Boykin to authorize the Chairman to sign a letter of support for Siouxland District Health Department application for a Targeted Capacity Expansion (TCE) drug treatment grant to expand and enhance drug treatment capacity in Woodbury County, Grant Application PA 03-001 TCE. Carried 4-0, Walish abstained. Copy filed.

The Board adjourned the regular meeting until December 23, 2002.
