OCTOBER 1, 2002 FOURTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 1, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Sonya Pierce, Executive Secretary, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of September 26, 2002 as submitted. Carried 5-0.

The Board approved the appointment of Jacob G. Monroe, Correctional Officer, County Sheriff Dept., @$13.70/hour, effective 10-02-02. Job Vacancy Posted: 7-31-02. Entry Level Salary: $13.70/hour. Copy filed.

The Board approved the appointment of Amy L. Ellis, Assistant County Attorney, County Attorney Dept., @$39,100/year, effective 10-02-02. Job Vacancy Posted: 8-21-02. Salary Range: $39,100 - $45,312/year. Copy filed.

The Board approved the appointment of Cameron M. Scott, Correctional Officer, County Sheriff Dept., @$13.70/hour, effective 10-14-02. Job Vacancy Posted: 7-31-02. Entry Level Salary: $13.70/hour. Copy filed.

The Board and J.D. Pellersels, Human Resource Director, discussed Corrective Action Design Report for the Law Enforcement Center environmental issue and recommended corrective measures.

The Board discussed countys third party administrator (TPA) self-insured dental plan.

The Board discussed countys self-insured health plan (PPO) vendor.

Motion by Welte second by Boykin to approve First Administrators to change third party administrator (TPA) self insured dental plan and self-insured health plan (PPO) vendors and set implementation date of January 1, 2003 for change. Carried 5-0. Copy filed.

Motion by Welte second by Batcheller to approve and authorize the Chairman to sign Resolution No. 9596 approving abatement of taxes for Woodbury County Conservation on Parcels #696465, #696480, #696555, #696570, #696585, #696600, #680853 #673650, #673665, 696510, #696495, #696135, #696090, #696525, #685035, #685050, and #685065, located in Woodbury County, Iowa. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Woodbury County Conservation is the titleholder of real estate Parcels #696465, #696480, #696555, #696570, #696585, #696600, #680853, #673650, #673665, #696510, #696495, #696135, #696090, #696525, #685035, #685050, and #685065, located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the above-stated property has taxes owing for September 1, 2002 and the parcels are owned by Woodbury County Conservation, and

WHEREAS, the organization, namely the Woodbury County Conservation is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against the parcels; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors herby abates the taxes owing on the above parcel according to the Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 1st day of October, 2002.

There was a discussion of Change Order G3 for Siouxland District Health Department building.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign Change Order G3, for Project No. 0031, remodel of existing building for Siouxland District Health Dept. Carried 5-0. Copy filed.

Darrell Geib, Sioux Rivers RC&D, gave an update report on Climbing Hill Water Project.

Motion by Welte second by Boykin to cooperate with Sioux Rivers RC&D to develop a solution for the water problem at Climbing Hill. Carried 5-0. Copy filed.

There was an introduction of Lewis Byers of Natural Resource Conservation Service (NRCS).

Motion by Boykin second by Batcheller to accept the bid and award the contract to Holtze Construction Company for Phase V Renovation of Woodbury County Courthouse, per recommendation of Wetherell-Ericsson-Leusink Architects. Failed 2-3 on a roll call vote, Boykin and Clausen aye, Batcheller, Welte and Walish nay.

Motion by Batcheller second by Walish to direct the Architect to contact the low bidder to determine cost of transferring the mobilization costs from the base bid to the alternate bids. Carried 3-2 on a roll call vote, Batcheller, Walish and Welte aye, Clausen and Boykin nay. Copy filed.

Motion by Boykin second by Walish to authorize the Chairman to sign Decategorization Contract No. 209-D with Siouxland Human Investment Partnership for Gang Prevention Specialist. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign IDOT Agreement for Federal Aid Highway Bridge Replacement and Rehabilitation Program Project, No. BROS-C097(59)8J-97, per recommendation of county engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Welte to approve and authorize the Chairman to sign Project Agreement with Hungry Canyons Alliance for funding of a stream stabilization project on a tributary of Reynolds Creek, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County R.E.C., per recommendation of the county engineer. Carried 5-0. Copy filed.

There was a discussion of proposed Woodbury County paving policy.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until October 8, 2002.
