SEPTEMBER 10, 2002ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 10, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Welte second by Batcheller to approve the Board minutes of September 3, 2002 as submitted. Carried 4-0, Walish abstained.
Motion by Boykin second by Batcheller to approve the minutes of the first Executive Session of September 3, 2002 as submitted. Carried 4-0, Walish abstained.
Motion by Batcheller second by Boykin to approve the minutes of the second Executive Session of September 3, 2002 as submitted. Carried 4-0, Walish abstained.
The Board observed a moment of silence in memory of 9/11.
The Board approved the reclassification of Randy D. Robinson, Custodian/Jail, County Sheriff Dept., @$9.75/hr., effective 9-12-02. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.
Motion by Boykin second by Walish to receive Quarterly Report from Commission of Veteran Affairs for the quarter ending June 30, 2002. Carried 5-0. Copy filed.
Motion by Welte second by Boykin to approve the appointment of Tom Ullrich for the office of Council Member for the Woodbury County Extension Council, to fill a vacancy previously held by Lloyd Parker until the next General Election. Carried 5-0. Copy filed.
Motion by Welte second by Boykin to approve and authorize the Chairman to sign Resolution No. 9590 approving abatement of taxes for Parcel #823275, #826425, #826440, #826410 owned by Woodbury County. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES
WHEREAS, the Woodbury County, Iowa are the titleholders of real estate Parcels #823275, #826425, #826440, #826410, located in Woodbury County, Iowa and legally described as follows:
Parcel #823275, #826425, #826440, #826410
NW, SW & SW SW 14-88-47, SW of RD E 1/2 NW 23-88-47, SW NW 23-88-47, NW NW 23-88-47, Woodbury Township, Woodbury County, Iowa
WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcel is owned by a political subdivision of the state; and
WHEREAS, the political subdivision, namely the Woodbury County, Iowa, is failing to immediately pay the taxes due; and
WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.
SO RESOLVED this 10th day of September, 2002.

The Board discussed with Patty Erickson-Puttmann submission of mental health court grant application to U.S. Department of Justice.
Motion by Boykin second by Batcheller to approve submission of mental health court grant application to the U.S. Department of Justice and designation of local funds in the amount of $50,000. Carried 5-0. Copy filed.
The Board discussed changes of courthouse cafeteria food service operation with Roger Erpelding and Monty Habben, Manager.
1. a) Close the counter for two designated weeks, centering on Christmas and July 4th.
b) Turn the cafeteria into a full service vending area with limited counter service. A full line of fresh salads, cold sandwiches, microwaveable sandwiches and entrees. A year round fully automated dining area, complete with state of the art equipment and service.
2. a) Close the counter for two designated weeks, centering around Christmas and July 4th.
b) From Labor Day until Memorial Day each year serve fresh salads, cold sandwiches, fast food grill and fryer items, with occasional homemade soups.
c) From Memorial Day until Labor Day conduct business as described in the first proposal.
3. a) Close the counter for two designated weeks, centering around Christmas and July 4th.
b) From Labor Day until Memorial Day each year serve fresh salads, cold sandwiches, soups, fast food grill and fryer items, with occasional specials.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign Contract Addendum with North West Environmental Services, Inc., Alton, Iowa, for environmental services at Davidson Oil Co. site, Moville, Iowa. Carried 5-0. Copy filed.
Action to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Qwest Corp. was removed from the agenda at the request of the county engineer.
Chuck Cipperley of Siouxland District Health gave a report on the West Nile virus.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Nancy Countryman from the county landfill discussed with the Board the possibility of City of Sergeant Bluff terminating a 28-E agreement with the county to use the county landfill.
The Board adjourned the regular meeting until September 17, 2002.
