JULY 16, 2002THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 16, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Victoria L. Ritz, Deputy Commissioner of Elections/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Boykin second by Walish to approve the Board minutes of July 9, 2002 as submitted. Carried
4-0. Batcheller abstained.
Leesa McNeil gave a report on jail information from the Judges.
Dick Storm, County Engineer, and Attorney John Sullivan discussed the Countys liability concerning the intersection of Route K-45 (Lewis Blvd. AKA Old U.S. 75) and Warrior Road and the possibilities of annexing the corner into the City of Sergeant Bluff.
The Board directed the County Engineer to request a Traffic Engineering Assistance Program study of the intersection and then proceed with implementation of the recommendations for installation of stop sign.
The Public Hearing and Sale of Real Estate Property Parcel #027210 for Correction of Legal Description was held at 10:20 A.M. The Chairman called on anyone wishing to be heard.
Motion by Batcheller second by Boykin to close the Public Hearing on the Sale of Real Estate Property Parcel #027210 for Correction of Legal Description as there was no one present wishing to be heard. Carried 5-0.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign Resolution No. 9581 on the Sale of Real Estate Property Parcel #027210 for the Correction of the Legal Description. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By Nustyle Development Corporation in the sum of Four-Thousand and Fifty-Seven Dollars and No/100 Cents ($ 4,057.00).

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

RESOLUTION ACCEPTING AND APPROVING McNAUGHTON SUBDIVISION, WOODBURY COUNTY, IOWA
WHEREAS, THE OWNER AND PROPRIETOR DID ON THE 24TH DAY OF JUNE, 2002, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS McNAUGHTON SUBDIVISION; WOODBURY COUNTY, IOWA; AND
WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND
WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

The Public Hearing on the proposed drawings, specifications, and form of contract for alterations to the new Siouxland District Health Building was held at 10:30 A.M. The Chairman called on anyone present wishing to be heard on said alterations for the new Siouxland District Health Building.
Motion by Batcheller second by Boykin to close the Public Hearing on the alterations to the new Siouxland District Health Building as there was no one present wishing to be heard. Carried 5-0. Copy filed.
The Public Hearing on application submission and use of local law enforcement Block Grant funds was held at 10:35 A.M. The Chairman called on anyone wishing to be heard on said application submission and use of local law enforcement Block Grant funds.
Motion by Boykin second by Walish to close the Public Hearing on the use of local law enforcement Block Grant (LLEBG) funds as there was no one present wishing to be heard. Carried 5-0.
Motion by Boykin second by Welte to approve the submission of the LLEBG application in the amount of $75,092 for the use of Sheriffs Office to obtain to obtain vehicles, equipment, and/or overtime expenses. Carried 5-0. Copy filed.
The Board and Patty Erickson-Puttmann, Social Services Coordinator, discussed approval of Siouxland Residential Services (SRS) request for use of funds returned by Tri-State Behavioral to the County under the Countys managed care contract.
Motion by Boykin second by Walish to approve granting of $68,950 to Siouxland Residential Services for the specified uses requiring proof of expenses and/or purchase. Carried 5-0. Copy filed.
The Board approved the separation of Lisa A. Maier-Hoffman, Jail Nurse, County Sheriff Dept., effective 7-14-02. Resignation. Copy filed.

Motion by Boykin second by Welte to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Vital Statistics Clerk III, County Auditor/Recorder Dept., Entry Level AFSCME Cthouse, Grd. 6: $12.60/hour; and for three (3) Jail Nurses, County Sheriff Dept., Wage Plan: $16.69/hour. Motion by Boykin second by Batcheller to approve request by retiree, Judith K. Peterson, to remain on Countys health and dental Insurance plans at her own expense with single coverage. Carried 5-0. Copy filed.
Sue Pierce, Pierce Associates, discussed with the Board the Downtown School Employee Survey on the feasibility study for a potential downtown elementary school.
Motion by Boykin second by Batcheller to authorize distribution of Memorandum and Downtown School Employee Survey to Woodbury County employees working in the downtown area. Carried 5-0. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Richard Hayes spoke regarding activating the video camera in the elevator used to transport prisoners being detained in the Woodbury County Jail. The Board reported that they are in the process of doing so.
Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 21.5(1)(f). Carried 5-0 on roll call vote.
Motion by Boykin second by Welte to go out of Executive Session. Carried 5-0 on roll call vote.
Motion by Boykin second by Batcheller to proceed according to the recommendation of the attorney made in the executive session. Carried 5-0.
The Board adjourned the regular meeting until July 23, 2002.
