MAY 14, 2002FORTY FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 14, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 5-0 on roll call vote.

Motion by Boykin second by Welte to go out of Executive Session. Carried 5-0 on roll call vote.

Meeting called to order.

Motion by Batcheller second by Boykin to approve the Board minutes of May 7, 2002 as submitted. Carried 3-0, Welte and Walish abstained.

Mr. Batcheller excused himself.

The Board approved the end of probation of Matthew P. Plummer, P/T Operations Officer, Disaster Services Dept., @$11.71/hour, effective 5-14-02. Wage Plan position. End of Probation Salary Increase. Copy filed.

The Board approved the appointment of Jason J. McManigal, Correctional Officer, County Sheriff Dept., @$13.24/hour, effective 5-20-02. Job Vacancy Posted: 3-13-02. Entry Level Salary: $13.24/hour. Copy filed.

The Board approved the reclassification of Lorie G. Jepsen, P/T Secretary, Disaster Services Dept., @$10.86/hour, effective 5-22-02. Per Wage Plan comparability with AFSCME Cthouse. Contract, from Grade 3/Step 2 to Grade 3/Step 3 level. Copy filed.

The Board approved the appointment of Carl J. Stoltze, Correctional Officer, County Sheriff Dept., @$13.24/hour, effective 6-03-02. Job Vacancy Posted: 3-13-02. Entry Level Salary: $13.24/hour. Copy filed.

The Board discussed the Law Enforcement Center environmental issue.

Motion by Boykin second by Walish to proceed with the bidding process for consulting services to deal with the L.E.C. environmental issue. Carried 4-0.

Motion by Welte second by Boykin to approve and authorize the Chairman to sign Resolution No. 9566 approving suspension of taxes for D.S. and K.S. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Dale J. and Karal L. Slate, as titleholders of real estate located at 239 S. John Street., Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #437745

Lot Two (2) Block Seventeen (17) Riverview 2nd Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Dale J. and Karal L. Slate as titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 14th day of May, 2002.

Motion by Welte second by Boykin to re-appoint Joe Heger to serve as a member of the Commission of Veteran Affairs for the next term. Carried 4-0. Copy filed.

Motion by Welte second by Boykin to approve the Iowa Retail Cigarette Permit Application for Salix Grocery, 1556 275th St., Salix, IA for the period July 1, 2002 through June 30, 2003. Carried 4-0. Copy filed.

The Board discussed with Shelly Malcom, Planning & Zoning Administrator, the consideration of final plats for Country Sunshine Subdivision submitted by Mr. and Mrs. Doyle Smith.

Motion by Welte second by Walish to approve and authorize the Chairman to sign final plats for Country Sunshine Subdivision, per recommendation of the Zoning Commission subject to a paving agreement being established. Carried 4-0.

BOARD OF SUPERVISORS RESOLUTION

RESOLUTION NUMBER: 9567

RESOLUTION ACCEPTING AND APPROVING COUNTRY SUNSHINE ADDITION, WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 25TH DAY OF MARCH, 2002, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS COUNTRY SUNSHINE ADDITION, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF COUNTRY SUNSHINE ADDITION, WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

The public hearing for Kelly Pry rezoning petition was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said petition.

Motion by Boykin second by Walish to close the public hearing on Kelly Pry rezoning request as there was no one present wishing to be heard on said petition. Carried 4-0.

Motion by Walish second by Welte to deny the Kelly Pry rezoning request. Carried 4-0.

Patty Erickson Puttmann and Glen Sedivy reported on the Washington trip.

The public hearing for Paul Dunn rezoning petition was held at 10:30 a.m. The Chairman called on anyone wishing to be heard on said petition.

Paul Dunn, 1463 110th Street and spoke in favor of the request. Robert Cherkas spoke against the request.

Motion by Boykin second by Walish to close the public hearing on Paul Dunn rezoning request as there was no one present wishing to be heard on said petition. Carried 4-0,

Motion by Boykin second by Welte to deny the Paul Dunn rezoning request. Carried 4-0.

Motion by Boykin second by Walish to allow one year until May 14th, 2003 for the property to be brought into compliance with the county zoning ordinance and a progress report to be made to the Board of Supervisors in six months. Carried 4-0.

Motion by Welte second by Walish to authorize the Chairman to sign a Utility Accommodation Permit submitted by Cable One, per recommendation of the county engineer. Carried 4-0. Copy filed.

The Board held a discussion with a representative from the City of Moville regarding use of County road right-of-way for a walking and bike trail.

Motion by Welte second by Boykin to postpone for one week action to approve the use of County road right-of-way for a trail for the City of Moville. Carried 4-0.

Motion by Boykin second by Walish to receive the quotes for 2002 maintenance paint striping program and to accept the quote of Vogel Traffic Services, per recommendation of the county engineer. Carried 4-0. Copy filed.

The Board discussed a request from the Board of Directors of the Siouxland Aviation Historical Association for support to help build new Mid America Air Museum.

The Department of Natural Resources (DNR) addressed the Board regarding Climbing Hill Project.

Motion by Boykin second by Walish to authorize the chairman to sign a letter seeking funds to develop a solution for water contamination at the Climbing Hill area. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until May 21, 2002.
