APRIL 2, 2002THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 2, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Welte to approve the Board minutes of March 26, 2002 as submitted. Carried 5-0.

Motion by Boykin second by Walish to approve and receive for signatures a resolution honoring Sharon Williamson for her years of service to the county. Carried 5-0.

RESOLUTION NO. 9550

A RESOLUTION THANKING AND COMMENDING

Sharon Williamson

FOR HER SERVICE TO WOODBURY COUNTY

WHEREAS, Sharon Williamson has capably served Woodbury County as an employee of the Woodbury County Auditor Elections Department for 17 years, from April of 1985 to March 2002; and

WHEREAS, the service given by Sharon Williamson as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Sharon Williamson for her seventeen years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Sharon Williamson; and

BE IT SO RESOLVED this 2nd of April, 2002.


WOODBURY COUNTY BOARD OF SUPERVISORS


Motion by Welte second by Boykin to authorize the Chairman to sign a Utility Accommodation Permit submitted by the City of Moville for proposed wastewater treatment facilities improvements, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to approve and authorize the Chairman to sign proposal of Northwest Environmental Services Inc., Alton, Iowa, for free product recovery at former Davidson Oil Co. site, Moville, Iowa, per recommendation of the county engineer. Carried 5-0. Copy filed.

There was no action taken to receive a proposal from Plymouth County for joint funding of paving of Highland Avenue and 340th Street.

The Board discussed road paving policy.

Motion by Boykin second by Batcheller to postpone for one week action to set a Public Hearing and Sale of Real Estate Parcel #26010 to the City of Sioux City on April 16, 2002 at 10:15 A.M. Carried 5-0.

The Board discussed the consideration of the purchase of the Eagles Club Building.

Motion by Batcheller second by Boykin to postpone action to approve and authorize the Chairman to sign an Offer to Buy Real Estate and Acceptance for the purchase of the Eagles Club Building. Carried 5-0.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign a resolution approving abatement of taxes on Metz Baking Company Building, Parcels #024420, #024450 and 024465. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Metz Baking Company is the titleholder of real estate Parcel #024420, #024450 and #024465 located in Woodbury County, Iowa and legally described as follows:

Parcels #024420, #024450 and 024465

Lots 1 to 6 Inclusive Block 55 and Lots 9 to 12 Block 55 and all Vacated E-W Alley in Block 55 and Vacated N-S Alley Between Lots 1, 2, 3, 4 and Lots 9, 10, 11, 12 Block 55, East 100 feet Lot 7 Block 55, East 100 feet Lot 8 Block 55, Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, the above stated property has taxes owing for March 1, 2002 and the parcel is owned by Metz Baking Company, and

WHEREAS, the organization, namely the Metz Baking Company is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 2nd day of April, 2002.

Resolution for Iowa Real Estate Gift

Resolution # 9552

WHEREAS, Chapter 331 of the Iowa Code, as amended (the Act), authorizes the creation of counties and authorizes such counties to, among other things, have and receive property to be used for public purposes; and

WHEREAS, Woodbury County has been duly organized pursuant to the Act;

WHEREAS, the Woodbury County has made the necessary arrangements with Metz Baking Company (the Donor), a corporation organized and existing under the laws of Iowa to receive certain real property consisting of portions of Block 55, City of Sioux City, State of Iowa (the Property), all as set forth in the details and provisions of the Purchase and Sale Agreement between Woodbury County and the Donor, dated March 18, 2002, as amended; and

WHEREAS, Woodbury County proposes to utilize the Property in furtherance of the Countys public purposes.

NOW, THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors as follows:

1. That the Chairman of the Woodbury County Board of Supervisors is hereby authorized, empowered and directed to receive said Property from the Donor.

2. That the Woodbury County Board of Supervisors is hereby authorized, empowered and directed to do all such acts and things and to execute all such certificates and documents, including but not limited to declaration of value forms, IRS Form 8283 and closing statements, as may be necessary, desirable, convenient or proper to carry out and comply with the provisions of the foregoing resolution or the documents herein above authorized.

3. That all acts and doings of the Woodbury County Board of Supervisors are in conformity with the purposes and intent of these resolutions and in furtherance of the receipt of the Property be, and the same hereby are, in all respects approved and confirmed.

Bid letting was held for FY 2002, 2003 and 2004 audit contract.

The bids were as follows:

Williams & Company -- $86,800.00

Motion by Walish second by Boykin to receive the bids and submit to the county auditors office for review and recommendation. Carried 5-0. Copy filed.

Jeff Harcum of County Sheriffs Department gave an update of the jail food contract.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Temporary Roadside Sprayer, entry level $8.00-$10.00/hour based on experience; and for two (2) Temporary Roadside Drivers, entry level $7.50-$8.50/hour based on experience. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Walish to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 5-0 on roll call vote.

Motion by Boykin second by Walish to go out of Executive Session. Carried 5-0 on roll call vote.

Motion by Welte second by Boykin to follow the recommendation of the attorney representing the county in the matter of Kounas versus Woodbury County. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until April 9, 2002.
