JAUARY 22, 2002-TWENTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 22, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Walish and Welte; Clausen was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

Victoria Ritz, Deputy Commissioner of Elections, presented the Canvass of the Farmers and Garretson Drainage Ditch Elections held on January 19, 2002.

For the office of Trustee of Farmers Drainage District Trustee for Sub-District #3 there were Seven Thousand Six Hundred Forty-Nine (7,649) ballots cast as follows:

Fred Johnson 7,649 votes

Fred Johnson was duly elected to the office of Farmers Drainage District Trustee Sub-District #3 for the term of 3 years.

Motion by Batcheller second by Walish to receive for signatures the Canvass of the Farmers Drainage Ditch Election. Carried 4-0. Copy filed.

For the office of Garretson Drainage District Trustee Sub-District #3 there were One Thousand Five Hundred Twenty-Nine (1,529) ballots cast as follows:

Wilbur Ray 1,529 votes

Wilbur Ray was duly elected to the office of Garretson Drainage District Trustee Sub-District #3, for the term of 3 years.

Motion by Welte second by Batcheller to receive for signatures the Canvass of the Garretson Drainage Ditch Election. Carried 4-0. Copy filed.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Welte second by Batcheller to appoint George Boykin as temporary chair. Carried 4-0.

Motion by Batcheller second by Walish to approve the Board minutes of January 15, 2002 as submitted. Carried 4-0.

The Board approved the reclassification of Marleen J. Loftus, Assistant County Attorney, County Attorney Dept., @$60,546/year, effective 2-01-02, per AFSCME Asst. County Attorney Contract agreement, from Step 11 to Step 12. Copy filed.

County Sheriff David Amick discussed raising per diem rate for work release program with the Board.

Motion by Welte second by Batcheller to implement the sliding scale per diem rate as provided by code for the work release program. Carried 4-0.

The Public Hearing and sale of Real Estate Parcel #116655 (1200 Irene Street, Sioux City, IA) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Walish to close the Public Hearing on the sale of Real Estate Parcel #116655 as there was no one present wishing to be heard on said sale. Carried 4-0.

Chairman called for bids on Real Estate Parcel #116655. Ryan Schultz bid $933.00 plus recording fees. Mary Whitzel bid $1,000, Rick Krueger bid $1,200. Ms. Whitzel and Mr. Krueger traded bids until Krueger finished at $2,400 plus recording fees. There were no further bids.

Motion by Batcheller second by Welte to accept Mr. Kruegers bid plus recording fees on Real Estate Parcel #116655. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:

RESOLUTION # 9537

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Dirtworks Inc. in the sum of Two-Thousand, Four-Hundred Dollars ($2,400.00)

For the following described real estate, To Wit:

Parcel #116655

Lot 52 (Fifty-Two); Coles Outlots Addition
(lka 1200 Irene Street, Sioux City, Iowa 51105)

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real

Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed appointments to County Cluster Board of Social Welfare.

Motion by Walish second by Welte to appoint Merrill Buckley, Patricia Sutherland, and Earl Belt to the County Cluster Board of Social Welfare. Carried 3-0. Copy filed.

The Board discussed appointments to Commission to Assess Damages-Category AOwner/Operators of Agricultural Property.

Motion by Welte second by Walish to appoint Leo Jochum to the Commission to Assess Damages-Category AOwner/Operators of Agricultural Property. Carried 3-0. Copy filed.

Motion by Welte second by Walish to approve to transfer funding of The Centers Conservatorship Program from General Basic Fund to Mental Health Fund. Carried 3-0. Copy filed.

Motion by Welte second by Walish to authorize the Chairman to sign Iowa Department of Transportation Agreement for Federal-Aid Highway Bridge Replacement and Rehabilitation Program Project. Carried 3-0. Copy filed.

Motion by Welte second by Walish to receive the County Treasurers semi-annual report of funds ending December 31, 2001. Carried 3-0. Copy filed.

Motion by Welte second by Walish to approve to submit State Criminal Alien Assistance Program (SCAAP) Grant Application for reimbursement, FY 2002. Carried 3-0. Copy filed.

The Board discussed consideration of Cooperation Agreement with Northern Ponca Housing Authority with Assistant County Attorney John Rusch.

Motion by Welte second by Walish to deny a request for a Cooperation Agreement with Northern Ponca Housing Authority. Carried 3-0.

Motion by Walish second by Welte to authorize the Chairman to sign Powell Group Fund grant letter for FY 2002. Carried 3-0. Copy filed.

Dennis Butler of County Auditors office discussed FY 2002-2003 budget with the Board.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until January 29, 2002.
