SEPTEMBER 25, 2001TWELFTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 25, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller and Walish, Welte was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the Board minutes of September 18, 2001 as submitted. Carried 4-0.

The Board approved the reclassification of Francisco Gonzalez, Correctional Officer, County Sheriff, @$15.68/hr., effective 10-04-01, per DSA Contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the reclassification of Elizabeth A. Peterson, P/T Youth Worker, Juvenile Detention, @$14.65/hr., effective 10-07-01, per AFSCME J.D. Contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

Motion by Walish second by Clausen to approve flu vaccinations for county employees. Carried 4-0. Copy filed.

There was no action taken to approve and authorize the Chairman to sign a resolution approving the abatement of taxes.

Motion by Batcheller second by Clausen to approve property tax credit on real estate taxes due to overpayment of taxes paid. Carried 4-0. Copy filed.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign Resolution No. 9516 for abatement of the Woodbury Monona Drainage District real estate taxes. Carried 4-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Woodbury Monona Drainage District (now know as Little Sioux Inter-County Drainage District) is the titleholder of real estate Parcels #687962, #687737, and #688052 located in, Woodbury and Monona Counties and legally described as follows:

WHEREAS, the above stated property has taxes owing for September 30, 2001, and the parcels are owned by the Woodbury Monona Drainage District; and

WHEREAS, the above-stated property is exempt from tax pursuant to Iowa Code Section 427.1 (2).

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes.

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 427.1 (2), and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 25th day of September, 2001.

Motion by Batcheller second by Clausen to authorize the Chairman to sign Project Agreement with Hungry Canyons Alliance. Carried 4-0. Copy filed.

Motion by Walish second by Batcheller to authorize the Chairman to sign Utility Accommodation Permit submitted by Woodbury County R.E.C., per recommendation of the county engineer. Carried 4-0. Copy filed.

Motion by Clausen second by Batcheller to authorize the Chairman to sign Certificate of Completion for Project L-139273-97. Carried 4-0. Copy filed.

Motion by Batcheller second by Walish to authorize the Chairman to sign Proposal from Steffen Engineering approving installation of additional monitoring wells at Davidson Oil Site, Moville, Iowa, per recommendation of the county engineer. Carried 4-0. Copy filed.

Motion by Clausen second by Batcheller to receive the quotes and accept the quote of Kooiker, Inc., of LeMars, Iowa, in the amount of $47,320.00 for bridge repair, per recommendation of the county engineer. Carried 4-0.

Motion by Clausen second by Batcheller to receive the quotes and accept the quote of Denco Corp. of Mingo, Iowa, in the amount of $47,520.00 for maintenance crack sealing repairs, per recommendation of the county engineer. Carried 4-0. Copy filed.

The Board discussed drainage problems at locations on the Missouri River flood plain.

The Board received information for future discussion regarding Anthon Maintenance Shed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign Notice of Bid Letting and Notice of Bid Hearing for the HVAC alterations in the basement of the Law Enforcement Center. Carried 4-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Wes Roeschke, 2520 140th Street, discussed the vacation of Garner Avenue with the Board.

Robert Pietrich, Mayor of Hornick, addressed the Board on the suspension of a county employee. The Board did not respond.

Victoria Ritz, Deputy Commissioner of Elections, presented the canvass for Western Iowa Tech Community College and stated there were no challenge ballots to consider for this district and that one (1) after election ballot was received timely and added to the tally.

Motion by Clausen second by Batcheller to receive and approve the official canvass results of the Western Iowa Tech Community College Election as follows: Carried 4-0.

For the office of Western Iowa Tech Community College School Board Director District I there were One Hundred Eighty-two (182) votes cast as follows:

John Ribando received One Hundred Eighty-Two (182) votes

We therefore declare John Ribando duly elected to the office of Western Iowa Tech Community College School Board Member Director District I for the term of 3 years.

For the office of Western Iowa Tech Community College School Board Director District III there were Eight Hundred Thirty-three (833) votes cast as follows:

Bob Rasmus received Eight Hundred Twenty-three (823) votes
Scattered Write-ins received Ten (10) votes

We therefore declare Bob Rasmus duly elected to the office of Western Iowa Tech Community College School Board Member Director District III for the term of 3 years.

For the office of Western Iowa Tech Community College School Board Director District V there were Three Hundred Fifty-one (151) votes cast as follows:

Deborah J. Cook received Three Hundred Forty-four (344) votes
Scattered Write-ins received Seven (7) votes

We therefore declare Deborah J. Cook duly elected to the office of Western Iowa Tech Community College School Board Member Director District V for the term of 3 years.

The Board adjourned the regular meeting until October 2, 2001.
