JUNE 26, 2001FIFTIETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 26, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, and Welte; Walish was absent. Staff members present were Sonya Pierce, Board Executive Secretary, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

Meeting called to order.

Motion by Welte second by Clausen to approve the Board minutes of June 19, 2001 as submitted. Carried 4-0.

Motion by Batcheller second by Clausen to approve the minutes of the executive session of June 19, 2001 as submitted. Carried 4-0.

The Board approved the separation of Rashelle R. Katseres, Jail Nurse, County Sheriffs Dept., effective 6-25-01. Resignation. Copy filed.

The Board discussed soil test drilling conducted at the Law Enforcement Center with Jerry E. Steffen of Steffen Engineering & Testing Inc.

Motion by Batcheller second by Clausen to approve the proposal from Steffen Engineering to complete a Tier II Site Assessment Report for the Law Enforcement Center. Carried 4-0. Copy filed.

Motion by Batcheller second by Welte to accept quote from Kooiker, Inc. of $23,550.00 to repair the bridge on 220th Street over Farmers Drainage Ditch. Carried 4-0. Copy filed.

Motion by Clausen second by Welte to approve and receive for signatures resolutions levying FY2001-2002 special assessments in the sum of $2,500 for Hackley Lateral Drainage District, in the sum of $750 for Orton Slough Drainage District, in the sum of $2,000 for Upper Wolf Creek Drainage District, in the sum of $500 for Weber Creek Drainage District, in the sum of $3,000 for Wolf Creek Drainage District, and in the sum of $12,000 for Wolf Creek Pumping Drainage District. RESOLUTION NO. 9504
HACKLEY LATERAL DRAINAGE DISTRICT
RESOLUTION LEVYING SPECIAL ASSESSMENT AND CERTIFICATE
TO THE COUNTY AUDITOR OF WOODBURY COUNTY, IOWA

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Hackley Lateral Drainage District of Woodbury County, Iowa; and
WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Hackley Lateral Drainage District, that a special tax and/or assessment in the sum of $2500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.
BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the 1999/2000 real estate taxes.

RESOLUTION LEVYING SPECIAL ASSESSMENT AND CERTIFICATE
TO THE COUNTY AUDITOR OF WOODBURY COUNTY, IOWA

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Orton Slough Drainage District of Woodbury County, Iowa; and
WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Orton Slough Drainage District, that a special tax and/or assessment in the sum of $750 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.
BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the 1999/2000 real estate taxes.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Upper Wolf Creek Drainage District, that a special tax and/or assessment in the sum of $2000 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Weber Creek Drainage District, that a special tax and/or assessment in the sum of $500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Pumping District of Woodbury County, Iowa; and
WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Pumping District.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District, that a special tax and/or assessment in the sum of $12,000 be levied against all the tracts of land, lots, railroad companies and public highways within said Pumping District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

West Fifty (W 50) Feet of the East One Hundred Sixty-Eight and One-Half Feet (168 ) in Block Forty-Nine (49) of C. B. Rustin and Companys Addition, City of Sioux City, Woodbury County, Iowa (aka 2418 Marshall Ave, Sioux City, Iowa)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 10th Day of July, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 10th Day of July, 2001, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 200.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'

The Public Hearing for the consideration of the Hazard Mitigation Plan was held at 10:30 A.M. The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Batcheller to close the Public Hearing as there was no one present wishing to be heard. Carried 4-0.

Motion by Batcheller second by Welte to approve the Woodbury County Hazard Mitigation Plan subject to review of Hazard Mitigation Planning Committee. Carried 4-0. Copy filed.

Neil Stockfleth, Woodbury County Soil and Water Conservation Service, addressed the Board concerning sponsorship for three grade stabilization structures.

Motion by Clausen second by Batcheller to approve Little Sioux Watershed Project Agreement for three (3) grade stabilization structures to be constructed in the Zellmer and Jet subwatersheds on sites J-1A, J-2-1 and 2-1. Carried 4-0. Copy filed.

Fran Sadden, Director of Siouxland District Health Department, spoke on contract amendment for CBS Grant.

Motion by Welte second by Clausen to approve and authorize the Chairman to sign contract amendment on Contract #5881CO97 for FY2001 CSB Grant. Carried 4-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a letter of agreement between Mercy Medical Services, Inc., and Woodbury County Juvenile Detention Center for sick call services. Carried 4-0. Copy filed.

John Malloy, WCICC, gave a presentation of the county web site.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Dean Williams of Goodwill Industries addressed the Board about the Northwest Iowa Contracting Consortium.

The Board discussed with John Malloy electronic viewing considerations for the Board Room. Mr. Malloy agreed to bring options back to the Board in two weeks.

The Board discussed a timeline for selecting an architectural firm for the jail project.

The Board adjourned the regular meeting until July 3, 2001.
