JUNE 19, 2001FORTY-NINTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 19, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Welte second by Batcheller to go into executive session under section 21.5 (1) (j) of the Iowa Code. Carried 5-0 on a roll call vote.
Motion by Welte second by Clausen to go out of executive session. Carried 5-0 on a roll call vote.
Motion by Walish second by Welte to approve the Board minutes of June 12, 2001 corrected to reflect Batcheller excused himself at 10:25 a.m. and Welte excused himself prior to the executive session. Carried 4-0; Batcheller abstained.
Motion by Clausen second by Walish to approve the minutes of the Executive Session of June 12, 2001 as submitted. Carried 3-0; Welte and Batcheller abstained.
The Board approved the appointment of James J. Wingert, Temporary Engineering Aide, Secondary Roads Dept., @$8.00/hr., effective 5-14-01. Original Appointment should have been at $8.00/hr. rather than $7.50/hr. Retro pay due for 152 hours = $76.00. Copy filed.

Motion by Batcheller second by Clausen to accept bid of Diamond Mowers Inc., Sioux Falls, SD, to furnish the rear and side mounted mowers at a price of $17,450.00 and to accept the bid of Vern Anderson Inc., Anthon, IA, to furnish the New Hollard Model TM 115 at a price of $44,925.00, for a total of $62,375.00, per recommendation of the county engineer. Motion by Clausen second by Batcheller to adjourn to the meeting to convene a meeting of trustees for the drainage districts under the direct control of the Woodbury County Board of Supervisors as trustees. Carried 5-0.
Motion by Welte second by Walish to approve the FY 2001-02 assessment of $500.00 for the Hackley Lateral drainage district, the FY 2001-02 assessment of $500.00 for the Orton Slough drainage district, the FY 2001-02 assessment of $2,500.00 for the Upper Wolf Creek drainage district, the FY 2001-02 assessment of $500.00 for the Weber Creek drainage district, the FY 2001-02 assessment of $3,000.00 for the Wolf Creek drainage district and the FY 2001-02 assessment of $15,000.00 for the Wolf Creek Pump Sub-Dist 2 & 3 only drainage district. Motion by Clausen second by Welte to adjourn the meeting of the drainage ditch trustees and to reconvene the regular board meeting. Carried 5-0.
Motion by Walish second by Welte to approve and authorize the Chairman to sign Resolution No. 9502. Carried 5-0.
WOODBURY COUNTY, IOWA
APPROPRIATION RESOLUTION
FOR FISCAL YEAR 2002
RESOLUTION # 9502
WHEREAS, it is desired to make appropriations for each Service Area and Program Activity of County Government for the Fiscal Year 2002, beginning July 1, 2001, and
NOW, therefore, be it resolved by the Woodbury County Board of Supervisors that the amounts detailed by Service Area on the Adopted FY 2002 Woodbury County Budget Summary Form 638-R constitute the authorization to make expenditures from the Countys funds beginning July 1, 2001 and continuing until June 30, 2002, and
FURTHERMORE, this Appropriation Resolution extends the spending authority of each County Program Activity to the amount appropriated to it on its budgeted Program Planner, and
ACCORDINGLY, until such time as a Service Area is identified as progressing to a spending level challenging its appropriation, a budget amendment per 331.435 will not be implemented,
HOWEVER, should a Program Activity approach a spending level challenging its appropriation level, and the Service Area continues balanced, the Board of Supervisors will be requested to increase the Programs spending authority by resolving to permit such, and,
ADDITIONALLY, the Board of Supervisors may be requested to decrease a Programs appropriation by 10% or $5,000, whichever is greater, to appropriate a like amount to a Program Activity requesting same: 331.435 will govern actions in this regard.
The above and foregoing resolution was adopted by the Board of Supervisors of Woodbury County on June 19th, 2001, and certified thereon as follows:

The Public Hearing and sale of Real Estate Parcels #337710, 337725, and 337740 also known as 1117, 1121 and 1125 S. Rustin Street was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.
Motion by Clausen second by Batcheller to close the Public Hearing on the sale of Real Estate Parcels #337710, 337725, and 337740 as there was no one present wishing to be heard on said sale. Carried 5-0.
Chairman called for bids on Real Estate Parcels #337710, 337725, and 337740. BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By Earl and Debbra Schultz in the sum of $ Two-Thousand, One-Hundred Dollars ($2,100.00)
for the following described real estate, To Wit:
PARCELS #337710, 337725, AND 337740 (AKA 1117, 1121, AND 1125 S. RUSTIN STREET, SIOUX CITY, IOWA)
LOTS THIRTEEN (13), FOURTEEN (14), AND FIFTEEN (15), IN BLOCK FOUR (4) OF THE MARKS SECOND FILING ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

John Malloy, WCICC, gave a presentation of the County telephone system.
Motion by Clausen second Welte to approve option 3 solution for the telecommunications system. Carried 5-0.
Motion by Batcheller second by Clausen to designate the Infrastructure and Economic Development Fund as the funding source for the telecommunications system. Carried 4-1, Welte opposed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns. Mr. Batcheller introduced Nancy Countryman from the county landfill to the Board.
The Board adjourned the regular meeting until June 26, 2001.
