JUNE 5, 2001FORTY-SEVENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 5, 2001 at 9:00 A.M. Board members present were Clausen, Batcheller, Walish and Welte; Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator, Victoria L. Ritz, Deputy/Clerk to the Board, and John Rusch, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Batcheller second by Walish to appoint Clausen as Chairman Pro Tem in the absence of Chairman Boykin. Carried 4-0.
Motion by Walish second by Welte to approve the Board minutes of May 29, 2001 as submitted.

The Board approved the separation of Jonathan M. Callender, P/T Assistant Custodian, Building Services Dept., effective 5-17-01. Copy filed.
The Board approved the 30 day unpaid leave of absence for James E. Lloyd, Equipment Operator, Secondary Roads Dept., effective 6-5-01. Copy filed.
The Board approved the reclassification of Korey C. VonderLieth, Correctional Officer, County Sheriffs Dept., @$13.28/hr., effective 6-11-01. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.
Motion by Walish second by Batcheller to approve and authorize the Chairman Pro Tem to sign the authorization to initiate hiring process for a Lead Jail Nurse (replaces 1 Jail Nurse position), County Sheriffs Dept. Wage Plan: $16.55/hour. Carried 4-0. Copy filed.
Motion by Batcheller second by Welte to authorize the Chairman Pro Tem to sign County Farm lease between Woodbury County and Gregory J. Jochum. Carried 4-0. Copy filed.
Motion by Walish second by Batcheller to approve and authorize the Chairman Pro Tem to sign Resolution No. 9497 approving petition for suspension of taxes for M.N. Carried 4-0.

OF TAXES
WHEREAS, Marian E. Nelson, as titleholder of real estate located at 1215 S. Mulberry, Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Seven (7) Block Two (2) Stone Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Marian E. Nelson as titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on
the 19th Day of June, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 19th Day of June, 2001, immediately
following the closing of the public hearing.
That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 867.00 plus recording
fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

The Board discussed with Patty Erickson Puttman, Social Service Coordinator, the contract with Redfern Resources as a Federal Consultant.
Motion by Batcheller second by Walish to approve continuing the contract with E. Edwin Redfern/ Redfern Resources and to extend the contract until July 1, 2001. Carried 4-0. Copy filed.
The Board discussed the Tri-State Behavioral Health Association, Inc. contract with Patty Erickson-Puttmann and Rick Pyburn, Executive Director of Tri-State.
Bid letting for Project CPRS-01(1)73-97 was held 10:20 A.M.

RESOLUTION NO. 9501
A RESOLUTION VACATING AND CLOSING ROAD
WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.11 (Code of Iowa 1999) as amended, on June 5, 2001 held a public hearing on the proposed vacation and closure of a portion of Woodbury County Secondary Road, described as follows:
That portion of county road right-of-way established as Road No. 196
more commonly known as Humboldt Ave. and further described as;
commencing at the North East Corner of Section 16, T86N, R45W
Willow Township thence south 847.21 feet to a point of beginning.
Vacate all that portion of Road No. 196 lying south of said point and
on the East line of said Section 16 to the South East Corner of the
NESE of said Section 16, thence west along the south line of the
NESE for a distance of 260 feet to the west right-of-way line of
the West Fork of the Little Sioux River.
WHEREAS, No objections were received either in writing or by persons present.
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that the subject section of road be ordered vacated and closed.
SO RESOLVED this 5th day of June 2001.

The Board went back to the discussion to extend the contract with Tri-State Behavioral Health Association, Inc., for the Woodbury County Mental Health Services Management Plan from July 1, 2001 through June 30, 2003. It was the consensus of the Board to bring the contract back next week with an addendum.
Motion by Batcheller second by Walish to authorize the Chairman Pro Tem to sign contracts with Brower Construction for Projects FMCO97(47)55 -97, FMCO97(48)55-97 and STP-S-CO97(49)5E-97. Carried 4-0. Copy filed.
Motion by Welte second by Batcheller to authorize the Chairman Pro Tem to sign Resolution No. 9500 assigning transfer of real estate from the Sale of Property May 29, 2001 to Ronald and Diana Nairn for a bid of $4,000.00 on Parcel #626640. Carried 4-0.
RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA: # 9500
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer of:
Ronald and Diana Nairn, 105 Summit, Pierson, Iowa 51048
in the sum of Four Thousand and No/100 ($4,000.00) Dollars for the
following described real estate, to wit: Lot 10, Block 6, Town of Pierson, Woodbury County, Iowa
now and included in and forming a part of the City of Pierson , Iowa, the same is hereby accepted.
WHEREAS, the Board of Supervisors has determined that the transfer of and the intended use of the real property is for a public purpose in accordance with other State laws, and as such, conveys the property legally described above to the purchaser according to Code of Iowa 331.361(3).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Warranty Deed for the said premises to the said purchaser.

The Chairman Pro Tem asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Suzanne Poplin presented a letter of intent of County plans to contribute $8,431.00 toward decategorization which is due June 8th with the actual waiver due by September 1st.
Motion by Walish second by Batcheller to authorize the Chairman Pro Tem to sign the letter of intent for the Juvenile Accountability Incentive Block Grant (JAIBG). Carried 4-0. Copy filed.
The Board adjourned the regular meeting until June 12, 2001.
