MAY 29, 2001FORTY-SIXTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 29, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Clausen to approve the Board minutes of May 22, 2001 as submitted. Carried 5-0.

Motion by Batcheller second by Welte to approve the minutes of the first Executive Session of May 22, 2001 as submitted. Carried 5-0.

Motion by Clausen second by Batcheller to approve the minutes of the second Executive Session of May 22, 2001 as submitted. Carried 5-0.

The Board approved the appointment of Chris E. Koehn, Temporary Summer Laborer, Secondary Roads Dept., @$7.50/hr., effective 5-29-01. Job Vacancy Posted: 3-7-01. Salary Range: $7.50-$8.50/hour, based on experience with Woodbury County. Copy filed.

The Board approved the separation of Daniel D. Nettleton, Jail Nurse, County Sheriffs Dept., effective 6-05-01. Resignation. Copy filed.

The Board approved the reclassification of Roxanne Hamann, P.T. Motor Vehicle Clerk II, County Treasurers Dept., @$12.29/hr., effective 6-13-01. Per AFSCME Cthouse. Contract agreement, from Grade 4.5, Step 5 to Grade 4.5, Step 6. Copy filed.

The Board discussed Juvenile Intake Workers on-call system with J.D. Pellersels, Human Resource Director.

Motion by Clausen second by Walish to approve the request from the Juvenile Detention Center Director to implement a new on-call system for 180 days with a quarterly report provided. Carried 5-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #901250, also known as 1531-30th Street, was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #901250 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #901250. There were no bids.

The Public Hearing and sale of Real Estate Parcel #230910, also known as 3305 Edmunds, was held at 10:16 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Welte second by Clausen to close the Public Hearing on the sale of Real Estate Parcel #230910 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #230910. Richard Krueger bid $100.00 plus cost of services and recording fees. There were no further bids.

Motion by Welte second by Walish to accept Richard Kruegers bid plus costs of services and recording fees on Real Estate Parcel #230910. Carried 5-0.

OF WOODBURY COUNTY, IOWA:
RESOLUTION # 9496

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Dirtworks, Inc, Bronson, Iowa in the sum of $ 370.00 (Three-Hundred and Seventy Dollars)

for the following described real estate, To Wit:

LOT 15 & LOT 16 EX TRI IN NLY PART BEING 43 FT ON NLY LINE & LOT 17 EX IRREG TCT BEING 70 FT ON W IN NLY PART BLK 19

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real

estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed Sheriffs Department jail nurses issue with J.D. Pellersels and Sheriff David Amick.

Motion by Walish second by Clausen to grant the Sheriffs request to increase the starting wage rate for jail nurses from $14.21 to $16.13 per hour and to increase the existing positions $1.92 per hour. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to grant the Sheriffs request to create a lead nurse position earning an additional 5%. Carried 5-0. Copy filed.

Motion by Clausen second by Welte to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Jail Nurse, County Sheriffs Dept. Wage Plan: Starting at $16.13 per hour. Carried 5-0. Copy filed.

Motion by Welte second by Walish to approve and authorize the Chairman to sign Class C Liquor License, Sunday Sales Privilege and Outdoor Service for Sloan Community Recreation Corp., 3113 Hwy 75, Sloan, IA. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to approve the Iowa Retail Cigarette Permit Application for Sloan Community Recreation Corp., 3113 Hwy 75, Sloan, IA. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve tax abatement of personal tax assessed as real estate, buildings on leased land and personal utility tax per recommendation of the County Treasurer. Carried 5-0. Copy filed.

John Calhoun, S.H.I.P. Director, and Assistant County Attorney John Rusch discussed with the Board the Woodbury County Sub-Contract Agreement for Administrative Cost Sharing with the Siouxland Human Investment Partnership.

Motion by Welte second by Walish to approve and authorize the Chairman to sign Woodbury County, Iowas Sub-Contract Agreement for Administrative Cost Sharing with the Siouxland Human Investment Partnership. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to award the contract to furnish 2001 maintenance culvert pipe to Northern Iowa Const. Products, Cedar Falls, Iowa. Carried 5-0. Copy filed.

Motion by Welte second by Batcheller to authorize the Chairman to sign a Utility Accommodation Permit submitted by Frontier Communications of Iowa, Inc., per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Walish second by Clausen to authorize the Chairman to sign final payment voucher for Project SBRFM-97(34)5D-97. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to approve Amendment No. 1 to FY 2000-01 Secondary Road Budget. Carried 5-0. Copy filed.

Richard Storm, County Engineer, discussed bridge closures and problems with the Board.

Motion by Batcheller second by Clausen to approve the County Engineers request to negotiate with Kookier Inc. to make repairs to one bridge. Carried 5-0. Copy filed.

The Public Hearing and sale of excess real estate property, Parcel #626460, located at Pierson, IA, was held at 10:45 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Welte second by Clausen to close the Public Hearing on the sale of excess real estate property, Parcel #626460, as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on real estate Parcel #626460. Ronald Narin bid $1,000.00. John Mahoney bid $1,500.00. Mr. Narin bid $2000.00. Mr. Mahoney bid $2,500.00. Mr. Narin bid $3,000.00, Mr. Mahoney bid $3,500.00 Mr. Narin bid $3,700.00. Mr. Mahoney bid $3,800.00 Mr. Narin bid $4,000.00. There were no further bids.

Motion by Batcheller second by Clausen to accept Ronald Narins bid for $4,000.00 plus recording fees on excess real estate property, Parcel #626460, located at Pierson, IA. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until June 5, 2001.
