APRIL 17, 2001FORTIETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 17, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Welte to approve the Board minutes of April 10, 2001 as submitted. Carried 5-0.

The Board approved the reclassification of Sydney C. Engle, Legal Secretary III, County Attorneys Dept., @$14.29/hr., effective 4-23-01. Per AFSCME Cthouse. Contract agreement, from Grade 6, Step 5 to Grade 6, Step 6. Copy filed.

The Board approved the reclassification of Randi D. Campbell, Records Clerk III, County Sheriffs Dept., @ $13.29/hr., effective 5-3-01. Per AFSCME Cthouse. Contract agreement, from Grade 6, Step 4 to Grade 6, Step 5. Copy filed.

The Board discussed Letter of Agreement for workers compensation medical care with J.D. Pellersels, Director of Human Resources Department.

Motion by Welte second by Walish to authorize the Chairman to sign the Letter of Agreement between Mercy Business Health Services, Mercy Medical Center and Woodbury County. Carried 5-0. Copy filed.

The Board discussed the appointments to the Commission to Assess Damages in Category B-Owners of City Property; in Category C-Licensed Real Estate Salesman or Real Estate Broker; and in Category D-Persons Having Knowledge of Property Values in the County by Reason of Their Occupation.

Motion by Walish second by Welte to authorize the Chairman to appoint Diane DeKok to the Commission to Assess Damages, Category B. Carried 5-0. Copy filed.

Motion by Welte second by Walish to approve and authorize the Chairman to sign Resolution No. 9483 appointing Karen James as the housing authority commissioner. Carried 5-0.

RESOLUTION NO 9483

RESOLUTION APPOINTING HOUSING AUTHORITY COMMISSIONER

WHEREAS, the County of Woodbury, Iowa has previously entered into Articles of Agreement with the Siouxland Regional Housing Authority, and

WHEREAS, these Articles provide that the County of Woodbury, Iowa shall be represented upon the governing commission of the Siouxland Regional Housing Authority, and further said Articles provide said County to appoint one authority commissioner to said governing commission.

NOW, THEREFORE, BE IT RESOLVED by the County Board of Supervisors of Woodbury County, Iowa, that ___KAREN JAMES_____ of the County of Iowa, be and hereby is appointed as housing authority commissioner to represent the interests of the county of Woodbury, Iowa, upon the Siouxland Regional Housing Authority Commission. Said appointment shall be for the term and under the conditions as provided in the Articles of Agreement previously signed between the County of Woodbury, Iowa and Siouxland Regional Housing Authority.

Motion by Batcheller second by Walish to approve Lawton Scout Pack 264 to utilize the gravel stockpile area for a concession stand for RAGBRI. Carried 5-0. Copy filed.

There was a consensus to have the Boards legal counsel draft a hold harmless agreement to present to the scout pack.

Motion by Walish second by Clausen to approve the appointment of Gary Brown as the designated county agent for county agricultural contact complaint investigations for Department of Natural Resources and Shelly Malcom as the alternate. Carried 5-0. Copy filed.

Motion by Welte second by Batcheller to receive the County Auditors Quarterly Report for the 3rd quarter ending 3-31-2001. Carried 5-0. Copy filed.

Motion by Welte second by Walish to authorize the Chairman to sign Project Agreement with Hungry Canyons Alliance for reimbursement to Woodbury County for costs associated with Hungry Canyons stream channel stabilization. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to authorize the Chairman to sign Utility Accommodation Permit submitted by Larry Krell and Stalcup Agricultural Services. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign Resolution No. 9484 adopting and levying special assessment in the McCandless Inter-County Drainage District. Carried 5-0.

RESOLUTION 9484

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE MCCANDLESS INTERCOUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the McCandless Inter-County Drainage District, in session on the 21st day of February, 2001, requested that the Board of Supervisors levy a special assessment of Eighty percent (80%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the McCandless Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of Eighty percent (80%) of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2001-2002.

PASSED and APPROVED this 17th day of April, 2001.

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE SANDHILL-LAKEPORT DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the Sandhill-Lakeport Inter-County Drainage District, in session on the 12th day of March, 2001, requested that the Board of Supervisors levy a special assessment of Twenty-One (21%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the Sandhill-Lakeport Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of Twenty-One (21%) Percent of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2001-2002.

IN THE LITTLE SIOUX INTER-COUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 6th day of April, 2001, requested that the Board of Supervisors levy a special assessment of Forty-Six (46%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-Six (46%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2001-2002.

The Board discussed county employees picnic with the picnic committee representatives, Julie Connelly and Tish Ford.

Motion by Welte second by Clausen to authorize the committee to budget up to $2,500.00 dollars for the county picnic. Carried 5-0. Copy filed.

Judge Patrick McCormick addressed the Board regarding the consideration of hiring an architect for jail planning.

There was a consensus to proceed to draft a Request For Proposal for an architect to develop a plan to increase jail capacity, to ask for a weekly report on jail population and programs, and to obtain an update of the Huskee Report on jail capacity.

Juvenile Detention Director Mark Olson and Gang Prevention Specialist Leo Miller presented a report on the activities of the Gang Prevention Specialist.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Clausen second by Batcheller to authorize the Chairman to sign a grant application for the Edward Byrne Memorial State Local Law Enforcement Assistance Program. Carried 5-0. Copy filed.

The Board adjourned the regular meeting until April 24, 2001.
