APRIL 3, 2001THIRTY-EIGHTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 3, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of March 27, 2001 as submitted. Carried 4-0, Welte abstained.

Motion by Clausen second by Walish to approve the minutes of the Executive Session of March 27, 2001 as submitted. Carried 4-0, Welte abstained.

The Board approved the reclassification of Catherine J. Derochie, Legal Secretary III, County Attorneys Dept., @$13.29/hr., effective 4-06-01. Per AFSCME Cthouse, Contract agreement, from Grade 6, Step 4 to Grade 6, Step 5. Copy filed.

The Board approved the reclassification of Ann M. Long, Assistant County Attorney, County Attorneys Dept., @$37,485/yr., effective 4-19-01. Per AFSCME Asst. County Attorney Contract agreement, from Step 2 to Step 3. Copy filed.

The Board approved the reclassification of John S. Rusch, Assistant County Attorney, County Attorneys Dept., @$37,485/yr., effective 4-19-01. Per Wage Plan comparability with AFSCME Asst. Co. Attorney Contract agreement, from Step 2 to Step 3. Copy filed.

Motion by Welte second by Walish to authorize the Chairman to sign final payment voucher for Projects BRS-97(41)60-97 to Dixon Construction Co., Correctionville, IA for bridge construction. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to authorize the Chairman to sign universal payment voucher reimbursing Iowa Department of Transportation for plan printing costs for asphalt resurfacing letting. Carried 5-0. Copy filed.

Motion by Walish second by Batcheller to reject all bids and rebid three (3) asphalt resurfacing projects, Projects FM-CO97(47)55-97, FM-CO97(48)55-97, and STP-S-CO97(49)5E-97. Carried 5-0. Copy filed.

The Public Hearing and sale of Real Estate Parcels #228600 and #228558 (also known as 1707 Wabash Street) was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Welte second by Batcheller to close the Public Hearing on the sale of Real Estate Parcels #228600 and #228558 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcels #228600 and #228558. John Nelson of 1708 Wabash bid $1,114.00, Ken Reifenrath of 1704 Wabash bid $1,164.00, John Nelson of 1708 Wabash bid $1,214.00. There were no further bids.

Motion by Batcheller second by Clausen to accept John Nelsons bid of $1,214.00 plus recording fees for Real Estate Parcels #228600 and #228558. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION # 9478

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By John J. Nelson and Gayle E. Nelson, as Joint Tenants with Full Rights of Survivorship, and not as

Tenants in Common in the sum of $ 1,214.00 (One-Thousand, Two-Hundred and Fourteen and No/100) Dollars for

the following described real estate, To Wit:

Lots Eight (8) Nine (9) Ten (10) Eleven (11) and Twelve (12) Block Eight (8) of Highland Park Addition, City of Sioux City, Woodbury County, Iowa.

Now and included in and forming a part of the City of __SIOUX CITY___, Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

The Board discussed with City of Sioux City Mayor Marty Dougherty, City Councilman Todd Moss and John Meyers, Director of Finance for the City of Sioux City, a request for a contribution from Woodbury County towards the Sioux City Event Center Project.

Motion by Welte second by Batcheller to commit to a contribution of $25,000.00 to the project each year for ten years starting in 2005 from the infrastructure fund. Carried 4-1, Clausen opposed. Copy filed.

Motion by Batcheller second by Walish to authorize the Chairman to sign Resolution No. 9479 approving Final Plats as revised for Shepards Hill Subdivision per recommendation of the Zoning Commission. Carried 5-0.

RESOLUTION NUMBER: 9479

RESOLUTION ACCEPTING AND APPROVING SHEPHERDS HILL, AN ADDITION TO WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 26 DAY OF MARCH, 2001, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS SHEPHERDS HILL, AN ADDITION TO WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF SHEPHERDS HILL, AN ADDITION TO WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

PASSED AND APPROVED THIS 3 DAY OF APRIL 2001.

The Board discussed preliminary plats for Joyces Subdivision and Logan Subdivision with Shelly Malcom of the Zoning Commission.

Motion by Welte second by Batcheller to refer preliminary plats for Joyces Subdivision to Zoning
Commission for recommendations. Carried 5-0. Copy filed.

Assistant County Attorney John Rusch discussed the proposed County Weed Ordinance.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Batcheller second by Welte to go into executive session per Iowa Code Section 21.5(1)(a). Carried 5-0 on roll call vote.

Motion by Walish second by Clausen to go out of executive session. Carried 5-0 on roll call vote.

Motion by Batcheller second by Clausen to go into executive session per Iowa Code Section 21.5(1)(j). Carried 5-0 on roll call vote.

Motion by Welte second by Walish to go out of executive session. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until April 10, 2001.
