FEBRUARY 13, 2001THIRTY-FIRST MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 13, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

Motion by Batcheller second by Welte to go into Executive Session #1 per Iowa Code Section 21.5(1)(c). Carried 5-0 on roll call vote.

Motion by Welte second by Clausen to go out of Executive Session #1. Carried 5-0 on a roll call vote.

Motion by Welte second by Walish to go into Executive Session #2 per Iowa Code Section 21.5(1)(c). Carried 5-0 on roll call vote.

Motion by Welte second by Clausen to go out of Executive Session #2. Carried 5-0 on roll call vote.

A third executive session was added to the agenda.

Motion by Welte second by Batcheller to go into Executive Session #3 per Iowa Code Section 21.5(1)(c). Carried 5-0 on roll call vote.

Motion by Batcheller second by Welte to go out of Executive Session #3. Carried 5-0 on roll call vote.

Motion by Clausen second by Walish to approve the Board minutes of February 6, 2001 as submitted. Carried 5-0.

Motion by Batcheller second by Welte to approve the minutes of the first Executive Session of February 6, 2001 as submitted. Carried 5-0.

Motion by Clausen second by Walish to approve the minutes of the third Executive Session of February 6, 2001 as submitted. Carried 5-0.

The Board approved the reclassification of Karen M. James, Board Administrative Coordinator, Board Administration, @$37,311/yr., effective 12-01-00. End of Probation Salary Increase. Copy filed.

The Board approved the appointment of Charles E. Collison, Correctional Officer, County Sheriffs Dept., @$11.90/hr., effective 2-14-01. Job Vacancy Posted: 1-18-01. Entry Level Salary: $11.90/hour. Copy filed.

The Board approved the reclassification of Pamela J. Westra, Motor Vehicle Clerk II, County Treasurers Dept., @$10.31/hr., effective 2-23-01. Per AFSCME Cthouse. Contract agreement, from Grade 4.5, Step 2 to Grade 4.5, Step 3. Copy filed.

The Board approved the reclassification of Donald F. Armstrong, Sheriffs Deputy, County Sheriffs Dept., @$18.99/hr., effective 3-5-01. Per DSA Contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the separation of Jessica S. Clausen, Case Manager, Social Services, effective 3-6-01. Resignation. Copy filed.

Motion by Clausen second by Welte to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Case Manager, Social Services. Wage Plan: $25,000/yr. Carried 5-0. Copy filed.

Motion by Welte second by Batcheller to approve the appointment of Gregg Grupp to the Woodbury County Conservation Board. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve the appointment of Lawrence Tobin to the Woodbury County Planning/Zoning Commission. Carried 5-0. Copy filed.

Motion by Walish second by Welte to approve the appointment of Christy Nicolaisen to the Woodbury County Cluster Board of Welfare. Carried 5-0. Copy filed.

Motion by Clausen second by Walish to approve the appointment of Patricia Sutherland to the Woodbury County Cluster Board of Welfare. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a resolution approving a tax suspension for D.C. Carried 5-0.

RESOLUTION # 9469

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Donovan R. Chrestensen, as titleholder of real estate located at 2218 W 2nd Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #264060

Lot Five (5) Block Twenty-three (23) Hornicks 2nd Addition

WHEREAS, Donovan R. Chrestensen as titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 13th day of February, 2001.

Motion by Batcheller second by Welte to postpone action on the 28E Agreement with Iowa Department of Human Services until next week. Carried 5-0.

The Board discussed consideration of proposed variance to Woodbury County Subdivision Zoning Ordinance with Assistant County Attorney, John Rusch.

Motion by Welte second by Batcheller to approve a variance requested by Jeri Semple to the Woodbury County Subdivision Zoning Ordinance. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to recommend a change to the Woodbury County Subdivision Zoning Ordinance recommended by Robert J. Rehan. Carried 5-0. Copy filed.

Dennis Butler discussed FY 2002 Budget with the Board.

Motion by Clausen second by Welte to reduce the Human Resources Budget by $18,000. Carried 5-0.

Motion by Batcheller second by Welte to move the purchase payment of $97,406 for the Sheriffs jail software from a tax allocation to a Riverboat encumbrance. Carried 4-1, Boykin opposed.

Motion by Batcheller second by Walish to reduce the Allocation to the Siouxland District Health Budget (001-3041) by $103,907. Carried 4-1, Boykin opposed.

Motion by Clausen second by Walish to reduce the Sheriffs Uniform Patrol Budget (001-1001) by $1,000.00, the Investigations Budget (001-1011) by $500.00, the Jails Expense Budget (001-1051) by $2,000.00, the Administration Budget (001-1061) by $2,000.00 and the Crime Prevention Budget by $1,000.00. Carried 4-1, Boykin opposed.

Motion by Batcheller second by Clausen to reduce the County Attorneys Administration Budget (001-1101) by $1,000.00 and the Juvenile Attorneys Budget (001-1104) by $1,000.00. Carried 5-0.

Motion by Walish second by Welte to reduce the Medical Examiner Budget (001-1111) by $1,600.00. Carried 5-0.

Motion by Batcheller second by Welte to reduce the General Relief Assistance Budget (001-5012) by $3,537.00. Carried 4-1, Boykin opposed.

Motion by Batcheller second by Welte to reduce the Conservation-Parks Budget (001-6111) by $1,000.00 and Conservation-Naturalist Budget (001-6111) by $500.00. Carried 5-0.

Motion by Clausen second by Batcheller to reduce the Treasurers Motor Vehicle Budget (001-8101) by $1,000.00. Carried 5-0.

Motion by Batcheller second by Welte to reduce the Board Expense Budget (001-5012) by $12,000.00. Carried 5-0.

Motion by Clausen second by Batcheller to reduce Board Administrations Budget (001-9002) by $2,000.00 and the Public Bidders Budget (001-9032) by $1,000.00. Carried 5-0.

The Board recessed until 12:30 p.m. for a demonstration of the law enforcement package. Mr. Welte excused himself.

The Board viewed a demonstration of the law enforcement package in the Offices of W.C.I.C.C.

The Board adjourned the regular meeting until February 20th, 2001.
