DECEMBER 12, 2000TWENTY-THIRD MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, December 12, 2000, at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, and Welte; Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Welte to approve the regular Board minutes of December 5, 2000 as submitted. Carried 4-0.

Motion by Welte second by Clausen to approve the minutes the first executive session of December 5, 2000 as submitted. Carried 4-0.

Motion by Clausen second by Welte to approve the minutes the second executive session of December 5, 2000 as submitted. Carried 4-0.

Motion by Batcheller second by Clausen to approve the minutes the third executive session of December 5, 2000 as submitted. Carried 4-0.

The Board approved the leave of absence of Oscar Sanchez-Alvarez, Correctional Officer, County Sheriff, effective 10-30-00. Copy filed.

The Board approved the separation of Geraldine L. Meyer, Jail Nurse, County Sheriff, effective 12-15-00. Resignation. Copy filed.

The Board approved the separation of Jason M. Allen, Correctional Officer, County Sheriff, effective
12-19-00. Resignation. Copy filed.

The Board approved the reclassification of Michael R. Clayton, First Deputy M.V. Dept., County Treasurer, @$39,167/year, effective 1-1-01. Per County Treasurer Percentage Deputy designation. Copy filed.

The Board approved the new term of elected official, David H. Amick, County Sheriff, County Sheriffs Dept., effective: 01-01-01. Copy filed.

The Board approved the new term of elected official, Robert G. Batcheller, Board Member, Board of Supervisors, effective: 01-01-01. Copy filed.

The Board approved the new term of elected official, Larry D. Clausen, Board Member, Board of Supervisors, effective: 01-01-01. Copy filed.

The Board approved the new term of elected official, Patrick F. Gill, County Auditor/Recorder, County Auditor/Recorders Dept., effective 01-01-01. Copy filed.

The Board approved the new term of elected official, Maurice D. Welte, Board Member, Board of Supervisors, effective: 01-01-01. Copy filed.

Motion by Welte second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Jail Nurse, County Sheriff, Wage Plan: $29,548/year; and for a Correctional Officer, County Sheriff, DSA Entry: $11.90/hr. Carried 4-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign the Woodbury County Courthouse Historic Preservation Easement. Carried 4-0. Copy filed.

The Board discussed the family farm tax credit applications provided by M. J. Obbink, Sioux City Assessor.

Motion by Welte second by Batcheller to allow the family farm tax credit applications and to disallow the parcels that were not timely filed upon the City Assessors recommendations. Carried 4-0. Copy filed.

The Board discussed the Lease Agreement with the State of Iowa Department of Human Service Regional Office for space at the Trosper Hoyt County Services Building with Assistant County Attorney, John Rusch.

Motion by Batcheller second by Welte to approve and authorize the Chairman to sign the Lease Agreement with State of Iowa Department of Human Services for office space at the Trosper Hoyt County Services Building. Carried 4-0. Copy filed.

The Board discussed the preliminary plats for Pleasant Acres subdivision submitted by Mr. and Mrs. Charles Solomon.

Motion by Clausen second by Batcheller to approve the preliminary plats for the Pleasant Acres Subdivision and to forward them to the zoning commission. Carried 4-0. Copy filed.

The Board discussed the preliminary plats for Valley View subdivision submitted by Mr. and Mrs. Wesley Zellmer.

Motion by Batcheller second by Welte to approve the preliminary plats for the Valley View Subdivision with the recommendations made by the zoning commission and to forward them to the zoning commission. Carried 4-0. Copy filed.

The Board discussed the preliminary plats for Blenderman Addition subdivision submitted by Mr. and Mrs. Thomas Blenderman.

Motion by Clausen second by Welte to approve the preliminary plats for the Blenderman Addition Subdivision with the recommendations of the zoning commission and to forward them to the zoning commission. Carried 4-0. Copy filed.

The public hearing for proposed amendment to Subdivision Ordinance was held at 10:15 a.m.

Motion by Clausen second by Batcheller to close the public hearing. Carried 4-0.

Motion by Clausen second by Welte to approve and receive for signatures a resolution for the amendment to the Woodbury County Subdivision Ordinance for the Unincorporated Area of Woodbury County, Iowa. Carried 4-0.

Resolution No. 9460

WHEREAS, the Board of Supervisors of Woodbury County, Iowa, has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorded in the Office of the Woodbury County Recorder, in Book 1263, page 9; and

WHEREAS, the Board of Supervisors has received a report in respect to amending said Ordinance from the Woodbury County Zoning Commission which held hearing(s) on said amendment(s), all as by law provided; and which amendment(s) is/are attached hereto marked Item(s) One, and hereby made a part hereof; and

WHEREAS, the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said amendment(s), all as by law provided; and

WHEREAS, the Woodbury County Board of Supervisors has concluded that the said amendment(s) to the aforesaid Zoning and Subdivision Ordinance should be made;

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid Zoning and Subdivision Ordinance is amended as shown on said Item(s) One.

IT IS FURTHER RESOLVED that these amendment(s) to said Ordinance shall be in full force and effect from and after its passage, approval and publication, and that the County Auditor shall cause this Ordinance to be published in the Sioux City Journal and be recorded in the office of the Woodbury County Recorder.

Amendment to the Woodbury County Subdivision Ordinance for the Unincorporated Area of Woodbury County, Iowa:

Amend Section 3. Preliminary Approval by Commission, Page S3. Change Section Heading to read as follows:

Amend Section 3. Preliminary Approval by Commission and Board of Supervisors, Page S3. Add Paragraphs:

Subdivider shall provide Corn Suitability Rating (CSR). This data may be used to deny subdivision of land for any purpose other than agriculture.

Upon recommendation for the preliminary plats by the Zoning Commission, the plats shall be submitted to the Board of Supervisors for approval or rejection.

The Board discussed the OSHA Report on the Law Enforcement Center with Mark Elgert and J. D. Pellersels. Copy filed.

Mr. Batcheller excused himself at 10:32 a.m.

David Amick, Sheriff, discussed the Local Law Enforcement Block Grant funds with the Board.

Motion by Welte second by Clausen to approve the Local Law Enforcement Block Grant allocation of funds. Carried 3-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Clausen second by Welte to go into executive session #1 per Iowa Code Section 230.25. Carried 3-0 on roll call vote.

Motion by Clausen second by Welte to go out of executive session #1. Carried 3-0 on roll call vote.

Motion by Welte second by Clausen to approve the recommendation of Judy Peterson, Vital Records/Institutional Accounts Clerk, in regards to an individual previously indexed by the Board. Carried 3-0.

Motion by Welte second by Clausen to go into executive session #2 per Iowa Code Section 21.5(1)(j). Carried 3-0 on roll call vote.

Motion by Welte second by Clausen to go out of executive session #2. Carried 3-0 on roll call vote.

Motion by Clausen second by Welte to go into executive session #3 per Iowa Code Section 21.5(1)(c). Carried 3-0 on roll call vote.

Motion by Clausen second by Welte to go out of executive session #3. Carried 3-0 on roll call vote.

Motion by Welte second by Clausen to ask Mr. Mullin to contact the Attorney General on this matter. Carried 3-0.

Motion by Clausen second by Welte to go into executive session #4 per Iowa Code Section 21.5(1)(c). Carried 3-0 on roll call vote.

Motion by Clausen second by Welte to go out of executive session #4. Carried 3-0 on roll call vote.

The Board adjourned the regular meeting until December 19th, 2000.
