OCTOBER 24, 2000 SIXTEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 24, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the regular Board Minutes of October 17, 2000 as submitted. Carried 5-0.

Motion by Batcheller second by Walish to approve the Board Minutes of the first executive session of October 17, 2000 as submitted. Carried 3-0, Clausen and Welte abstained.

Motion by Walish second by Batcheller to approve the Board Minutes of the second executive session of October 17, 2000 as submitted. Carried 3-0, Clausen and Welte abstained.

Motion by Batcheller second by Welte to approve the quote of Gus Construction Co. Inc., Casey, Iowa for full-depth concrete patching on various P.C.C. roads. Carried 5-0. Copy filed.

Motion by Walish second by Clausen to approve and authorize the Chairman to sign the grant application for water well program. Carried 5-0. Copy filed.

Motion by Clausen second by Welte to approve and authorize the Chairman to sign a resolution approving the abatement of taxes for parcel #382804 and parcel #382812 titled to the Orpheum Theatre Project Ltd. Carried 5-0.

RESOLUTION # 9457

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Orpheum Theatre Preservation Project Ltd. is the titleholder of real estate Parcels #382804 and #382812, located in the City of Sioux City, Iowa and legally described as follows:

Unit 2 and Undiv. 3.6% Int. in & to Limited Common Elements Lots 1-2-3 & Lot 4 Except S 16 feet and Vacated E-W Alley Adjacent Block 10 Sioux City East Addition

Parcel #382812

Unit 9 A and Undiv. 13% Int. in & to Limited Common Elements Lots 1-2-3 & Lot 4 Except 16 feet and Vacated E-W Alley Adjacent Block 10 Sioux City East Addition

WHEREAS, the above﷓stated property has taxes owing for September 1, 2000 and the parcel is owned by the Orpheum Theatre Preservation Project Ltd., and

WHEREAS, the organization, namely the Orpheum Theatre Preservation Project Ltd. is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 24th day of October, 2000.

Motion by Welte second by Clausen to approve a proposed change in the county zoning ordinance. Motion by Welte second by Clausen to amend the motion by striking to approve and inserting to postpone until the next meeting action on. Carried 5-0. The motion as amended carried 5-0.

Motion by Clausen second by Welte to authorize the chairman to sign a contract between Mercy Health Services and Woodbury County Juvenile Detention for sick call services. Carried 5-0. Copy filed.

Motion by Clausen second by Welte that the Board of Supervisors accept the recommendation of the Law Library Committee to convert the present hard cover book Law Library to primarily internet access through Westlaw Internet with costs to be shared by Woodbury County and the Woodbury County Bar Association as outlined in the proposal details.

Woodbury County will pay 50% of the first year costs and 100% of the one time costs. The Woodbury County Bar Association will pay 50% of the first year costs. In addition, the Bar Association will pay 100% of the cost for any new additions to the hard cover book collection. Carried 5-0. Copy filed.

Wanda Jones appeared before the Board to ask for assistance in a health related matter.

Lloyd Tresham of Hornick addressed the Board with a concern about millings from a Secondary Roads project.

Batcheller raised a concern about expenses involved with the recent sale of an assignment of tax certificates.

Welte and Clausen excused themselves.

Motion by Batcheller second by Walish to go into executive session under Section 21.5(1)(i) of the Iowa Code. Carried 3-0 on a roll call vote.

Motion by Walish second by Batcheller to go out of executive session. Carried 3-0 on a roll call vote.

Motion by Batcheller second by Walish to authorize the Chairman to negotiate the salary for the executive secretary for the Board. Carried 3-0.

The closed session under Section 21.5(1)(c) of the Iowa Code was not held.

The Board adjourned the regular meeting until October 31st, 2000.
