OCTOBER 17, 2000 FIFTEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 17, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Batcheller second by Welte to approve the Board Minutes of October 10, 2000 corrected to show Mike Lallys final bid to be $20,250 for the former U.S. Tanning site tax certificates. Carried 5-0.
Motion by Walish second by Clausen to approve the minutes of the October 10, 2000 first executive session as submitted. Carried 5-0.
Motion by Welte second by Batcheller to approve the minutes of the October 10, 2000 second executive session as submitted. Carried 5-0.
The Board approved the reclassification of Dawn R. Anderson, Vital Statistics Clerk II, County Auditor/Recorder, @ $10.16/hour, effective 10-26-00. Per AFSCME Cthouse, Contract agreement from Grade 4, Step 2 to Grade 4, Step 3. Copy filed.
Motion by Welte second by Clausen to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Custodian (new position), Building Services. Wage to be determined. Creation of designated custodial position for utilization thru Mental Health Funding. Carried 5-0. Copy filed.
Motion by Welte second by Walish to approve and authorize the Chairman to sign an agreement with the City of Hornick to use secondary road equipment. Carried 5-0. Copy filed.
Motion by Batcheller second by Clausen to receive for signatures a resolution authorizing an embargo for sections of Warrior Road. Carried 5-0.
RESOLUTION NO. 9454
WHEREAS, the Board of Supervisors of Woodbury County believe that certain secondary roads in Woodbury County, Iowa, which are paved or unpaved, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or the permissible weight thereon reduced, and
WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operation of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads,
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that, where signs are erected on a highway, operation of vehicles weighing in excess of said weight limit is prohibited on said highway,
IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in EXHIBIT A, attached thereto and by this reference made a part hereof.
The effective date of this Resolution is October 20, 2000 through and including December 31, 2000.

Warrior Road from its intersection with Old Lakeport Road easterly to the intersection of Lewis Blvd. or Route K-45 in Woodbury County shall be limited to vehicles including load of a gross weight of 6 tons per axle.

RESOLUTION # 9456
RESOLUTION COMPROMISING DELINQUENT TAXES AND ASSIGNING
CERTIFICATES OF PURCHASE
WHEREAS, the Woodbury County Board of Supervisors, in accordance with Section 446.31 of the Code of Iowa, as holder of the Certificates of Purchase on the below described properties, seeks to assign said Certificates of Purchase and to compromise the delinquent taxes accumulated on said following described properties:

WHEREAS, Woodbury County purchased Parcels I and II on June 17, 1996 pursuant to Iowa Code Section 446.29, and now seeks to compromise the amount of such taxes which exist on said Parcels to the date of October 10, 2000, which totals approximately $441,292.00 more or less, and assign all said Certificates of Purchase, in accordance with Iowa Code Section 446.31, and;
WHEREAS, the Board of Supervisors held an auction of said Certificates of Purchase on October 10, 2000 with the selling price of said Certificates determined to be $25,000, and;
WHEREAS, Woodbury County has received and holds a deposit for the full payment of the amount bid for said Certificates;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Woodbury County, Iowa, that it accepts the amount of $25,000.00 in full liquidation of the aforesaid delinquent taxes to the date of October 10, 2000 and the Board of Supervisors does hereby assign to USA Tire and Management Systems all of the aforesaid Certificates of Purchase held by Woodbury County on the above-described real estate. This resolution constitutes a written agreement between the Board and USA Tire and Management Systems within the meaning of Section 446.31 of the Iowa Code.

Board Consultant John Pritchard updated the Board on the implementation of the phone and voice mail system.
Diane Swoboda Peterson asked the Board if she could conduct a food drive for county employees and plan a holiday event for county employees. The consensus was to proceed.
Wanda Jones reported to the Board an injury she received while using the Courthouse elevators.
The Board recessed until 2:00 p.m.
The meeting was reconvened at 2:10 p.m. with members Walish, Boykin and Batcheller present.
Motion by Batcheller second by Walish to go into executive session under Iowa Code Section 21.5(1)(i) at the request of a job applicant. Carried 3-0 on a roll call vote.
