SEPTEMBER 19, 2000 ELEVENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 19, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the regular Board Minutes of September 12, 2000 as submitted. Carried 5-0.

Motion by Welte second by Walish to approve the Board Minutes of the September 15, 2000 special board meeting, scheduled to canvass the school election, as submitted. Carried 3-0, Batcheller and Clausen abstained.

The Board approved the appointment of Sonya D. Pierce, Temporary Board Secretary, Board
Administration, @$11.47/hr., effective 9-13-00. Not to exceed 120 days. Copy filed.

The Board approved the transfer of Richard A. Ellison, Court Security Officer, County Sheriff, @$15.00/hr., effective 9-18-00. In-House Posting: 8-16-00. Transfer from Correctional Officer to Court Security Officer at current salary. Copy filed.

The Board approved the separation of Rosanne Lienhard, Domestic Abuse Grant/Assistant County Attorney, County Attorney, effective 9-29-00. Resignation. Copy filed.

The Board approved the separation of Nancy M. Carstensen, First Deputy M.V. Dept., County Treasurer, effective 9-29-00. Retirement. Copy filed.

The Board approved the appointment of Michael R. Clayton, First Deputy M.V. Dept., County Treasurer, @$32,510/year, effective 10-2-00. From Temporary Status to Percentage Deputy Appointment per Elected Official/County Treasurer. Copy filed.

Motion by Clausen second by Welte to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Correctional Officer, County Sheriff, DSA Entry: $11.90/hour; and for a Domestic Abuse/Grant Asst. Co. Attorney, County Attorney, AFSCME Range: $35,000-$39,359/yr. (based on experience). Carried 5-0. Copy filed.

The Board discussed flu and tetanus vaccinations for county employees with J. D. Pellersels, Human Resources Director.

Motion by Welte second by Clausen to approve flu and tetanus vaccinations for county employees. Carried 5-0. Copy filed.

The Board discussed request to rent grain bins and payment of excess electricity beyond monthly base rate.

Motion by Batcheller second by Welte to accept the bid from Kevin Schmidt for the rental of the grain bins. Carried 5-0.

Motion by Clausen second by Welte approve and authorize the Chairman to sign Resolution No. 9241 approving abatement of taxes due 2000-01 for the City of Sloan on Parcel #649320. Carried 5-0.

RESOLUTION # 9241

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the City of Sloan is the titleholder of real estate Parcel #649320, located in, the City of Sloan and legally described as follows:

Auditor Sub-Division of South 1/2 NW and SW Lot 11 29-86-46, City of Sloan, Woodbury County, Iowa

WHEREAS, the above﷓stated property has taxes owing for September 30, 2000, and the parcel is owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the City of Sloan, Iowa is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 433.4, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Angela Green, as joint titleholder of real estate located at 3201 and 3207 Park View Blvd. Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #278445 and 278460

Lots One (1) and Two (2) Block Ten (10) Kelly Park Addition

WHEREAS, Angela Green as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Public Hearing and sale of Real Estate Parcel #340335 (a/k/a 535 Chambers, Sioux City) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Jim Johnson, 1104 6th Street, informed the board that there are several landowners who use the street for access.

Motion by Batcheller second by Clausen to close the Public Hearing on sale of Real Estate Parcel #340335 as there was no one else present wishing to be heard on said sale. Carried 5-0.

There was no action taken on the sale of the property.

The Board reviewed the Cooperation Agreement for Northern Ponca Housing Authority with Assistant County Attorney John Rusch.

Motion by Walish second by Clausen to approve the Cooperation Agreement with Northern Ponca Housing Authority. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to receive the bids and allow the county engineer to review the bids and to bring his recommendations to the Board. Carried 5-0. Copy filed.

There was no action taken to refer Rick Pattersons site plan to Zoning Commission for recommendations. The request was withdrawn.

Gary Niles spoke in favor of the Plats for Niles 2nd Addition. Jerry Hanson and Brent Nelson from the City of Sioux City provided information. Kenneth Gard of 1215 Carroll Avenue representing the Woodbury County Farm Bureau spoke against the addition.

Motion by Clausen second by Batcheller to authorize the Chairman to sign final plats for Niles 2nd Addition. Carried 5-0.

BOARD OF SUPERVISORS RESOLUTION
RESOLUTION NO. 9246

RESOLUTION ACCEPTING AND APPROVING NILES SECOND ADDITION, WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 19 DAY OF SEPTEMBER, 2000, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS NILES SECOND ADDITION, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF NILES SECOND ADDITION, WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

WOODBURY COUNTY BOARD OF SUPERVISORS

Motion by Welte second by Boykin to place a moratorium on any further development of this type in the county until the Countys Comprehensive Plan has been developed by the planning and zoning commission. After discussion, Mr. Welte asked for unanimous consent to withdraw his motion. There was no objection.

James Stephenson of ReMax of Siouxland addressed the Board to present an Offer to Purchase the property located at 2325 Port Neal Road, Sergeant Bluff, IA. There was no action taken.

Motion by Clausen second by Walish to approve the submission of the local law enforcement block grant. Carried 5-0. Copy filed.

There was a discussion of odor problems in the Law Enforcement Center.

Motion by Batcheller second by Clausen to go into executive session under section 21.5(i)(j) of the Iowa Code. Carried 5-0 on a roll call vote.

Motion by Welte second by Walish to go out of executive session. Carried 5-0 on a roll call vote.

The Board adjourned the regular meeting until September 26, 2000.
