JULY 25, 2000 THIRD MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 25, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the regular Board Minutes of July 18, 2000 as submitted. Carried 4-0, Clausen abstained.

The Board approved the separation of Jay C. Menke, Temporary M.V. Clerk II, County Treasurer, effective 6-30-00. End of Temporary Work. Copy filed.

The Board approved the separation of George Nuncio, Correctional Officer, County Sheriff, effective 7-18-00. Separation. Copy filed.

The Board approved the appointment of Deborah A. Origer, Custodian, Building Services, @$7.88/hr., effective 7-25-00. Job Vacancy Posted: 5-17-00. Entry Level FY 01 Salary: $7.88/hr. Copy filed.

The Board approved the appointment of Shannon C. Larson, Correctional Officer, County Sheriff,
@$11.90/hr., effective 7-31-00. Job Vacancy Posted: 6-07-00. Entry Level Salary: $11.90/hr. Copy filed.

The Board approved the separation of Ryan P. Houlihan, Temporary Engineering Aide, Secondary Roads, effective 8-03-00. End of Temporary Work. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Correctional Officer, County Sheriff. DSA Entry: $11.90/hr. Carried 5-0. Copy filed.

Motion by Clausen second by Welte to approve the Midlands Choice Preferred Provider Arrangement Plan Agreement. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to authorize the Chairman to sign a Utility Accommodation Permit submitted by Northwest Iowa Telephone Co., Sergeant Bluff, IA, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to authorize the Chairman to sign a Utility Accommodation Permit submitted by Martin & Associates, Inc. on behalf of Western Iowa Telephone Association, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Welte second by Batcheller to approve and receive for signatures a resolution requiring contract to operate pumps for Wolf Creek Drainage District/Pumping Station. Carried 5-0.

RESOLUTION NO. 9319

WOLF CREEK DRAINAGE DISTRICT/PUMPING STATION

RESOLUTION REQUIRING CONTRACT
TO OPERATE PUMPS

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Drainage District and as the governing body has approved and established certain pumping stations in connection therewith; and

WHEREAS, the Board of Supervisors as the governing body of the Wolf Creek Drainage District and its pumping station(s) has previously contracted for the pumping of excess surface waters in the Wolf Creek Pumping Station District; and

WHEREAS, it appears that authority for pumping of excess surface waters including the use of the district owned pumping equipment should be renewed in the event of rainfall which might require pumping in the affected area.

NOW THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that this Board as Trustees of Wolf Creek Pumping Station District should enter into a contract for the crop year of 2000, for the operation and maintenance of the pumping stations in the Wolf Creek Drainage District heretofore established by this Board.

BE IT FURTHER RESOLVED, that the Chairman of this Board be and he is hereby authorized and directed to enter into that Employment Contract with Douglas Washburn, as per the attached form of Employment Contract, subject to the Guidelines for the operation of the Wolf Creek Pumping Station District.

IT IS FURTHER RESOLVED that in connection herewith, the Contractor, Douglas Washburn, will furnish evidence of insurance as required by Paragraph 4 of said Contract.

Motion by Welte second by Clausen to receive the quotes for crack sealing and joint repair of selected concrete paved roads, and to approve the quote of Sioux Commercial Sweeping, Inc. Sioux Center, Iowa, to complete approximately 38,000 LF of joint repair at a total estimated cost of $36,100 per recommendation of County Engineer Richard J. Storm. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and receive for signatures the Iowa Retail Cigarette Permit Application for Whispering Creek Golf Club, L.C., 1476 170th St., Sioux City, IA. Carried 5-0. Copy filed.

The Board discussed a request for tax suspension on Parcels #219795 and #219780 and the consideration of redeeming the parcels for tax suspension.

Motion by Welte second by Clausen to approve and authorize the Chairman to sign Resolution No. 9320 approving petition for suspension of taxes through the redemption process for Parcel #219795 and to approve and authorize the Chairman to sign Resolution No. 9321 approving petition for suspension of taxes for Parcel #219780. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS

WHEREAS, Dorothy L. Schonrock, as joint titleholder of real estate located at 119 S. Colon Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #219795

South 1/2 North 2/5 Lot 18 & South 1/3 North 3/5 Lot 18 Highland Plat 2 Addition, Sioux City, Woodbury County, Iowa

WHEREAS, Dorothy L. Schonrock, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel # 219795 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

RESOLUTION APPROVING PETITION FOR SUSPENSION

WHEREAS, Dorothy L. Schonrock, as joint titleholder of real estate located at 117 S. Colon Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

WHEREAS, Dorothy L. Schonrock as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Board discussed the air conditioning in WCICC Department with Mark Elgert, Building Superintendent.

Motion by Batcheller second by Welte to approve proceeding to purchase a backup air conditioner for W.C.I.C.C. at a cost of $7,500.00. Carried 5-0.

The Board held a discussion with Patty Erickson Puttmann concerning the rearrangement of the reception area of the jail for the INS Video Teleconferencing System funded through a federal grant.

Motion by Clausen second by Walish to approve the remodeling of the reception area of the jail for the INS Video Teleconferencing System by Audiovisual Inc. quote: $31,410 for equipment acquisition; M.B.S. Inc. quote: $21,922 for renovation; and contingency balance for new equipment storage, furniture, security, consulting and incidental costs of $9,168. Carried 4-1, Batcheller opposed. Copy filed.

The Board discussed setting up the Big Brothers Big Sisters photo display within the Woodbury County Courthouse with Gretchen Graber, Community Relations Coordinator of Big Brothers Big Sisters of Siouxland.

Motion by Walish second by Welte to approve setting up the Big Brothers Big Sisters photo display within the Woodbury County Courthouse. Carried 5-0. Copy filed.

The Board discussed a request for three additional offices for senior judges that will be working in Woodbury County with District Court Administrator Leesa McNeil.

There was no action taken on the position of Decategorization Coordinator.

Larry Bumstead addressed the Board about the request for funding for equipment from the Oto Fire and Rescue.

Woodbury County Treasurer Bob Knowler reported to the Board about the status of the Motor Vehicle Department.

The Board recessed for a picture taking session.

Motion by Welte second by Walish to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 5-0 on roll call vote.

Motion by Welte second by Batcheller to go out of Executive Session. Carried 5-0 on roll call vote.

Motion by Batcheller second by Welte to send a letter to Village Northwest reflecting the countys position.

The Board reviewed backup material.

The Board adjourned the regular meeting until August 1, 2000.
