FEBRUARY 22, 2000 THIRTY-FIRST MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 22, 2000 at 9:00 A.M. Board members present were Clausen, Walish and Welte. Boykin and Batcheller were absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting was called to order.
Motion by Welte second by Walish to appoint Larry Clausen Temporary Chairperson for the meeting. Carried 3-0.
Motion by Walish second by Welte to approve the regular Board minutes of February 15, 2000 as submitted. Carried 3-0.
The Board approved the transfer of Christopher A. Persinger, Court Security Officer, County Sheriffs Dept., @$13.34/hr., effective 2-23-00 per DSA Contract agreement, an In-House Transfer from Correctional Officer, Class 2 to Ct. Security Officer, Class 2. Copy filed.
The Board approved the appointment of Jeremy R. Stoltze, M.V. Clerk II, County Treasurers Dept., @$9.07/hr., effective 2-23-00. Vacancy posted: 1-18-00. Entry Level Salary: $9.07/hr. Copy filed.
The Board approved the reclassification of Pamela J. Westra, M.V. Clerk II, County Treasurers Dept., @$9.53/hr., effective 2-23-00 per AFSCME Cthouse, Contract agreement, from Grade 4.5, Step 1 to Grade 4.5, Step 2. Copy filed.
Motion by Welte second by Walish to authorize the Chairman Pro Tem to sign the Authorization to Initiate Hiring Process for a Male Correctional Officer, County Sheriffs Dept. @$11.50/hr. Carried 3-0. Copy filed.
Motion by Welte second by Walish to approve and authorize Chairman Pro Tem to sign Resolution No. 9258 setting a public hearing for sale of real estate property, Parcels #181320 & 181335. Carried 3-0.

NOTICE OF PROPERTY SALE
Parcels # 181320 & 181335
WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Lots Six (6) and Seven (7) Block Six (6) Gaughrans 2nd Addition, City of Sioux City, Woodbury County, Iowa (a.k.a 210 and 214 Cecelia Street)
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on
the 7th day of March, 2000, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 7th day of March, 2000, immediately
following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $1,340.00 plus recording
fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

The Board discussed the consideration of additional funds required for upgrading the Trosper-Hoyt County Buildings mechanical system from Infrastructure Funds.
Motion by Welte second by Walish to approve the additional expenditure of $4,937.00 from Infrastructure Funds to update the mechanical system at Trosper-Hoyt County Services Building for mechanical upgrade. Carried 3-0. Copy filed.
The Public Hearing for the sale of property, Parcel #143850 was held at 10:10 A.M. The Chairman Pro-Tem called on anyone wishing to be heard on said sale.
Motion by Welte second by Walish to close the Public Hearing on the sale of Real Estate Parcel #143850 as there was no one present wishing to be heard on said sale. Carried 3-0.
Chairman Pro Tem called for bids on Real Estate Parcel #143850. Gene Sherman bid $1,200.00 plus recording fees. There were no further bids.
Motion by Walish second by Welte to accept the bid of $1,200.00 plus recording fees from Gene Sherman for Real Estate Parcel #143850. Carried 3-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

in the sum of _ONE THOUSAND TWO HUNDRED AND NO/100 ($1,200.00)-------------------------------------Dollars for the

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Board discussed the consideration of a request from the Northern Housing Ponca Authority to remove effective dates in the agreement between Woodbury County and the Northern Housing Ponca Authority.
Motion by Welte second by Walish to postpone until next week action on the agreement between Woodbury County and the Northern Housing Ponca Authority. Carried 3-0
Motion by Welte second by Walish to approve and authorize Chairman Pro Tem to sign a new Class C Liquor License, Class C Beer Permit, Outdoor Service Area and Sunday Sales Privilege for the Whispering Creek Golf Club, Sioux City. Carried 3-0. Copy filed.
Motion by Welte second by Walish to approve and authorize Chairman Pro Tem to sign Resolution No. 9260 authorizing embargoing of certain county roads per recommendation of the County Engineer. Carried 3-0.
RESOLUTION NO. 9260
WHEREAS, the Board of Supervisors of Woodbury County believe that certain secondary roads in Woodbury County, Iowa, which are paved or unpaved, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or the permissible weight thereon reduced, and
WHEREAS, Chapter 321, Section 321.471 of the Code of Iowa, gives said Board the power to prohibit the operation of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads,
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that, where signs are erected on a highway stating the weight limit beyond which vehicles are restricted from operation on said highway, operation of vehicles weighing in excess of said weight limit is prohibited on said highway,
IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in EXHIBIT A, attached thereto and by this reference made a part hereof.
The effective date of this Resolution is February 28, 2000 through and including May 19, 2000.

PROCLAMATION FOR
MENTAL RETARDATION
AWARENESS MONTH
WHEREAS, mental retardation is a condition which today affects more than seven (7) million American children, adults, and their families, many of whom wait on long lists for needed services and supports; and
WHEREAS, the most effective weapons for alleviation of the serious problems associated with
mental retardation are public knowledge and understanding; and
WHEREAS, the potential for citizens with mental retardation to function more independently productively must be fostered; and
WHEREAS, during the month of March, over 2,500 members through the local chapters of The
Arc of Iowa, a statewide organization on mental retardation, are forging vital
employment, educational, and fund-raising campaigns under private section
initiatives; and
WHEREAS, The Arc of the United States is 50 years of service to families and individuals;
THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors does hereby proclaim the period of March, 2000, as
MENTAL RETARDATION AWARENESS MONTH
In Woodbury County, and urge that the citizens of this County to give full support to efforts toward enabling people with mental retardation to live productive lives and achieve their potential.

Diane Swoboda Peterson, representing a group of deputies addressed the Board about the compensation schedule that the Woodbury County Compensation Board had recommended.
Motion by Welte second by Walish to go into executive session under section 21.5a of the Iowa Code. Carried 3-0 on a roll call vote.
Motion by Welte second by Clausen to go out of executive session. Carried 3-0 on a roll call vote.
The Board adjourned the regular meeting until February 29, 2000.
