DECEMBER 7, 1999 TWENTY-SECOND MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, December 7, 1999 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator and Patrick F. Gill, Clerk to the Board.

The Claims were approved as presented.

Meeting called to order.

There was open discussion period held by the Board.

Motion by Boykin second by Walish to approve the regular Board Minutes of November 23, 1999. Carried 3-0. Welte and Batcheller abstained.

Motion by Welte second by Batcheller to approve the regular Board Minutes of November 30, 1999. Carried 4-0. Walish abstained.

The Board postponed action on Woodbury County, Iowas Investment Policy.

Board reviewed the schedule for the Budget Programs for FY 2000-2001.

Motion by Welte second by Walish to approve and authorize the Chairman to sign Change Order #2 for Remodeling First Floor at the Trosper-Hoyt County Services Building at a cost of $2,600. Carried 5-0 Copy filed.

Motion by Welte second by Walish to approve and authorize the Chairman to sign an Agreement with the City of Bronson for the use of Secondary Road Equipment to clean ditches. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to defer action to approve and authorize the Chairman to sign the Utility Accommodation Permit submitted by Van Tuyl Contracting to install a 2 water line along a section of DeRocher Path. Carried 5-0.

Motion by Boykin second by Welte to approve Resolution # 9240 Designating Snowmobile Trail requested by the Powder Players Snowmobile Club of Remsen, Iowa. Carried 5-0.

RESOLUTION NO. 9240

WOODBURY COUNTY, IOWA

RESOLUTION DESIGNATING SNOWMOBILE TRAILS

WHEREAS, POWDER PLAYERS, INC. SNOWMOBILE CLUB, has requested that the WOODBURY COUNTY BOARD OF SUPERVISORS, designate the following portions of Woodbury County roadway to be used as snowmobile trails; L-14 from the Plymouth County Line to D-12 and D-12 from Highway 140 East to the West city limits of Pierson, Iowa, AND;

WHEREAS, Chapter 321G of the Code of Iowa allows the WOODBURY COUNTY BOARD OF SUPERVISORS to designate portions of roadway for snowmobile trail use for a specified period of time, AND;

WHEREAS, in accordance with Chapter 321G.9 of the Code of Iowa, the WOODBURY COUNTY BOARD OF SUPERVISORS has evaluated the traffic patterns of the roadways requested to be designated as snowmobile trails and has determined that a designated snowmobile trail on portions of said roadways will not unduly interfere with traffic or constitute a traffic hazard, AND;

WHEREAS, Section 321G.28 of the Code of Iowa does not require approval from the Iowa Department of Transportation for merely designating a portion of a county roadway as a snowmobile trail, AND;

WHEREAS, the WOODBURY COUNTY BOARD OF SUPERVISORS has agreed to designate the requested portions of Woodbury County roadways as snowmobile trails, AND;

WHEREAS, the POWDER PLAYERS INC. SNOWMOBILE CLUB agrees to sponsor said snowmobile trails, AND;

WHEREAS, the POWDER PLAYERS INC. SNOWMOBILE CLUB agrees to provide all designations and signs to be erected along said trails for the use of the club members, AND;

WHEREAS, the POWDER PLAYERS INC. SNOWMOBILE CLUB agrees to place and maintain any signs necessary to warn traffic of the operation of snowmobiles along said trails and roadways, AND;

WHEREAS, POWDER PLAYERS INC. SNOWMOBILE CLUB agrees that all members and any guest or associates using said designated trail shall comply with the provisions of Chapter 321G of the Code of Iowa and further agree that any violations of said Code Chapter shall be considered grounds for terminating the designation of said snowmobile trail, AND;

WHEREAS, POWDER PLAYERS INC. SNOWMOBILE CLUB agrees to hold and save WOODBURY COUNTY harmless from any and all liability resulting from injuries, loss or damages, including damages to equipment, of any kind to club members, guests or other persons using said snowmobile trail, or those whose injuries or damages are a result of the use of said trails by members, guests, or other persons using said snowmobile trail, AND;

WHEREAS, POWDER PLAYERS INC. SNOWMOBILE CLUB shall submit proof of insurance coverage, covering all persons participating in any club activities on or along the designated snowmobile trails to the Woodbury County Auditor within fifteen days of the passage of this resolution and agrees that failure to do so shall constitute grounds for the Board of Supervisors revoking this resolution.

WHEREAS, WOODBURY COUNTY does not warrant the condition of the county road right-of-way which will be designated as a snowmobile trail to be fit for any particular purpose nor, does it warrant against any hazards that may exist as a result of snow plowing or other necessary road work on the public road along side said trail.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Woodbury County, Iowa as follows:

The following roadway is hereby designated as a snowmobile trail for the
POWDER PLAYERS INC. SNOWMOBILE CLUB and may be used for
snowmobile operation from December 1, 1999 through March 31, 2000:

L-14 from Plymouth County Line to D-12, and
D-12 from Highway 140 East to the West City limits of
Pierson, Iowa.

SO RESOLVED this 7th day of December, 1999.

Shelly Malcom, 404 Project Manager, reviewed with the Board the Application for Hazard Mitigation Planning Funds.

Motion by Boykin second by Welte to approve and authorize the Chairman to sign Resolution # 9241 Designating SIMPCO As Authorized Representative for Hazard Mitigation Planning Assistant Grant. Carried 5-0.

RESOLUTION NO. 9241

STATE OF IOWA DESIGNATION OF APPLICANT'S AUTHORIZED
REPRESENTATIVE RESOLUTION FOR A HAZZARD MITIGATION
PLANNING ASSISTANCE GRANT

BE IT RESOLVED BY WOODBURY COUNTY, THAT SIOUXLAND INTERSTATE METROPOLITAN PLANNING COUNCIL (SIMPCO) is hereby authorized to execute on behalf of WOODBURY COUNTY, BOARD OF SUPERVISORS the Hazard Mitigation Planning Project Grant and to file the application with Iowa Emergency Management Division (IEMD) for the purpose of obtaining Federal financial assistance.

RESOLUTION NO. 9242

STATE OF IOWA PLANNING GRANT
MATCH RESOLUTION FOR HAZARD MITIGATION
PLANNING ASSISTANCE GRANT

WHEREAS, WOODBURY COUNTY, BOARD OF SUPERVISORS, would like to develop or update a hazard mitigation plan and desires to obtain a Planning Grant from the Federal Emergency Management Agency (FEMA).

And WHEREAS, WOODBURY COUNTY BOARD OF SUPERVISORS recognizes the fact that a planning grant from FEMA is a 75% federal/ 25% nonfederal match source.

THEREFOR, WOODBURY COUNTY BOARD OF SUPERVISORS, shall form an agreement with Iowa Emergency Management Division (EMD) and FEMA as to the date that said 25% shall be available to match the federal funds awarded and agrees to provide One Thousand Dollars ,($1,000 ) of local monies to be used as match funds for the approved planning grant as outlined in the grant application. Of this amount, only half may be provided from in-kind contribution.

This resolution was passed and approved the 7th day of December, 1999.

John Calhoun, Juvenile Court Services, presented information to the Board of Management Information System and Request of Commitment of Concept.

Mark Elgert, Building Services Director, discussed with the Board the need to replace the freight Elevator in the Courthouse.

The Board approved the reclassification of Patti M. Walsh, Motor Vehicle Clerk II, County Treasurer, @$9.53/hr., effective 12/21/99. Per AFSCME Court House. Contract Agreement, from Grade 4.5, Step 1 to Grade 4.5, Step 2. Copy filed.

The Board approved the reclassification of Benjamin T. Kusler, Project engineer, Secondary Roads, @$43,909/year, effective 01/01/2000. Per Wage Plan Increase of 5% = $2091/year. Copy filed.

Motion by Welte second by Boykin to authorize the Chairman to sign the Authorization to Initiate Hiring Process for 1 Correctional Officer, County Sheriffs Department, DSA Entry: $11.50/hr. Carried 5-0. Copy filed.

The Board deferred discussion on the Woodbury County Health Insurance P.P.O. Plan Provider.

Vern Erskine discussed with the Board a need for lights on Christie Road.

Dr. E. E. Maxwell discussed with the Board the need to complete county road K-64.

Douglas McQuade discussed with the Board a dispute involving a road in West Liberty Township.

Deputy County Sheriff Dennis Simmons and Mark Elgert discussed unforeseen boiler and control problems at the Prairie Hills Center. The Board directed them to fund these costs out of the budgeted expenses for the transition of the facility.

Motion by Boykin second by Welte to go into Executive Session per Iowa Code Section 21.5(1)(j). Carried 5-0 on a roll call vote.

Motion by Boykin second by Welte to go out of Executive Session. Carried 5-0 on a roll call vote.

Motion by Welte second by Boykin to approve a $75,000 offer to purchase a property in the Holly Springs 404 Mitigation Project. Carried 5-0.

Motion by Boykin second by Walish to go into Executive Session per Iowa Code Section 21.5(1)(f). Carried 5-0 on a roll call vote.

Motion by Batcheller second by Boykin to go out of Executive Session. Carried 5-0 on a roll call vote.

Motion by Walish second by Boykin to go into Executive Session under section 21.5(1)(c). Carried 5-0 on a roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session. Carried 5-0.

Motion by Boykin second by Welte to accept the recommendation of the human resources director to move the countys Preferred Provider Organization from Wellmark Select to Midlands Choice until December 31, 2000. Carried 5-0.

The Board adjourned the regular meeting until December 14, 1999.
