OCTOBER 5, 1999 FOURTEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 5, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Walish, and Welte. Clausen was absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented.

Meeting called to order.

There was open discussion period held by the Board.

Motion by Walish second by Welte to approve the regular Board Minutes of September 28, 1999 as submitted. Carried 4-0.

Motion by Batcheller second by Walish to approve the minutes of the Executive Session #1 of September 28, 1999 as submitted. Carried 4-0.

Motion by Welte second by Batcheller to approve the minutes of the Executive Session #2 of September 28, 1999 as submitted. Carried 4-0.

The Board approved the separation of John J. Butler, III, Correctional Officer, County Sheriff, effective 9/23/99. Copy filed.

The Board approved the reclassification of Deborah K. Westphal, Election Clerk/Secretary, County Auditor/Recorder, @$10.70/hr., effective 10/13/99. Per AFSCME Cthouse. Contract Agreement, from Grade 4, Step 4 to Grade 4, Step 5. Copy filed.

The Board approved the appointment of David L. Conner, Correctional Officer, County Sheriff, Job vacancy posted: 8-5-99 Entry level salary: $11.50/hr., effective 10/04/99. Copy filed.

The Board approved the separation of Stacy L. Dillard-Spahn, Asst. County Attorney, County Attorney, effective 10/26/99. Copy filed.

Motion by Welte second by Walish to authorize Chairman to sign Authorization to Initiate Hiring Process for Male Correctional Officer, County Sheriff, $11.50/hr. and an Assistant County Attorney, County Attorney, AFSCME, Step 1: $34,000/yr. Carried 4-0.

Motion by Welte second by Batcheller to receive and accept the resignation of Dave Bumsted as Grant Township Trustee. Carried 4-0. Copy filed.

Motion by Batcheller second by Walish to authorize Chairman Pro Tem to sign contract with Frank Audino Construction, Inc. for 1st floor remodeling at the Trosper-Hoyt County Services Building. Carried 4-0. Copy filed.

Motion by Welte second by Batcheller to approve and authorize Chairman Pro Tem to sign Lease of Farm Structures between Woodbury County and David Folsom for the leasing of the grain bins at the County Farm including changes relating to capacity. Carried 4-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #280605 was held at 10:15 A.M. The Chairman Pro Tem called on anyone wishing to be heard on said sale.

Motion by Welte second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #280605 to as there was no one present wishing to be heard on said sale. Carried 4-0.

William Irish bid $500.00. Frank Tracy bid $550.00. William Irish bid $600.00. Frank Tracy bid $650.00.

Motion by Batcheller second by Welte to accept the offer of $650.00 from Frank Tracy for Real Estate Parcel #280605 plus recording fees. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9226

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: FRANCIS JOSEPH TRACY

in the sum of SIX HUNDRED FIFTY AND NO/100 ($650.00) Dollars for the following described real estate to wit:

Lot Twenty-three (23) Block Seventeen (17) Kelly Park Addition to City of Sioux City, Woodbury County, Iowa

now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Michael OBrien, Juvenile Public Defender discussed Juvenile Attorneys Fees-Budget Program. The consensus was to pay the outstanding claims and use a budget amendment to cover the costs at a later date.

Motion by Welte second by Walish to authorize Chairman Pro Tem to sign agreement with City of Correctionville to use Secondary Road Department Equipment. Carried 4-0. Copy filed.

Motion by Batcheller second by Welte to approve a proposal from Calhoun-Burns of West Des Moines, Iowa in the amount of $80.00/bridge for 1999-00 bridge inspection services upon the recommendation of the county engineer. Carried 4-0. Copies filed.

The Board deferred action to sign Tri-State Nursing Contract until a sharing arrangement with the Sheriffs Department is investigated.

Motion by Welte second by Walish to refer Gary Niles/Kent Iveners rezoning petition to Zoning Commission for recommendation. Carried 4-0. Copy filed.

Mark Elgert, Building Services Department discussed partial replacement of HVAC System at County Home. The direction of the Board was to proceed with the work and to cover it with a budget amendment at a later date.

Motion by Batcheller second by Welte to set the bid openings for north courthouse doors for October 12, 1999 at 10:05 AM. Carried 4-0.

Motion by Welte second by Walish to approve and authorize Chairman Pro Tem to sign a Community Economic Betterment Account (CEBA) loan agreement on behalf of Schaeff, Inc., by the State of Iowa through Woodbury County. Carried 4-0. Copy filed.

Robert P. Sheehan, Boys and Girls Home of Sioux City, discussed proposal of bond issue.

Motion by Batcheller second by Welte to approve the request of Bob Sheehan from Boys and Girls Home and Family Services for the use of $2 million of the Countys $10 million bond issue limit. Carried 4-0.

Don Dixon, Mayor of Correctionville; David Phipps, SIMPCO; and Rick Schneider, Conservation Department discussed the proposed bicycle/pedestrian trail along the Little Sioux River south of Correctionville terminating at Little Sioux Park.

The Chairman Pro Tem asked for and received unanimous consent to add two items to the agenda due to the urgency and timeliness of the issue.

Motion by Walish second by Batcheller to authorize the Chairman Pro-Tem to sign letter of support from Board of Supervisors on behalf of the Crittenton Center to Wellmark Foundation. Carried 4-0. Copy filed.

Motion by Batcheller second by Welte to pay $475.00, from infrastructure and economic development funds, to Western Iowa Tourism Region as part of required matching funds for a grant from the Iowa Department of Economic Development. Carried 4-0.

The Board adjourned the regular meeting until October 12, 1999.
