SEPTEMBER 21, 1999 TWELVETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 21, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish, and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented.

Meeting called to order.

There was open discussion period held by the Board.

Motion by Welte second by Walish to approve the regular Board Minutes of September 14, 1999 as submitted. Carried 4-0. Batcheller abstained.

Motion by Welte second by Boykin to approve the Board Minutes of the Executive Session of September 14, 1999 as submitted. Carried 4-0. Batcheller abstained.

Motion by Boykin second by Batcheller to approve the Board Minutes of the Special Meeting of September 17, 1999 to canvass the Annual School Board Elections held in Woodbury County on September 14, 1999 as submitted. Carried 4-0. Welte abstained.

Motion by Boykin second by Walish to set the Public Hearing and Sale of Real Estate Parcel # 908084 to Gary Stevenson and Shirlee Stevenson Only for $1.00 on October 5th, 1999 at 10:17AM. Carried 5-0.

WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:

That part of Lot Eleven (11) in Patricia A. Thompson Addition, Fourth Filing in Sioux City, Woodbury County, Iowa Described as Follows: Commencing at the Northwest Corner of Said Lot Eleven (11), Thence Southwesterly Along the Northwesterly Line of Said Lot for 24.70 feet: Thence Southeasterly to the Southeasterly line of Lot Eleven (11) at a point 24.70 feet Southwesterly of the Northeast Corner of Lot Eleven (11); Thence Northwesterly Along the Northeasterly Line of Lot Eleven (11) to the Northwest Corner of Lot Eleven (11) and the Place of Beginning.

NOT THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 5th day of October, 1999, at 10:17 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate to Gary W. Stevenson and Shirlee A. Stevenson only on the 5th day of October, 1999, immediately following the closing of the public hearing.


3. That said Board proposes to sell the said real estate to Gary W. Stevenson and Shirlee A. Stevenson only for $1.00.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

1. That a public hearing on the aforesaid proposal shall be held on the 10th day of October, 1999, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 10th day of October, 1999, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $500.00 plus recording fees.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Florence Crittenton Home of Sioux City is the titleholder of real estate Parcel #029730, located at 1309 Pierce Street in, the City of Sioux City and legally described as follows:

Lot Nine (9) in Block Eighty-one (81), Sioux City East Addition, in the County of Woodbury and State of Iowa

WHEREAS, the above-stated property has taxes owing for September 1, 1999 and March 1, 2000, and the parcel is owned by a non-profit organization; and

WHEREAS, the non profit organization, namely the Florence Crittenton Home of Sioux City, Iowa is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owning on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

WHEREAS, the political subdivision, namely the City of Sloan, Iowa is failing to immediately pay the taxes due; and


WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

There was discussion of appointment needs for Loess Hills Alliance Board and County Civil Service Commission. The consensus was to advertise for these vacancies.

Motion by Batcheller second by Boykin to authorize Chairman to sign New Jobs and Income Program (NJIP) Annual Progress Report Ag Processing, Inc. for period ending June 30, 1999. Carried 5-0. Copy Filed.

There was discussion of request from farm lessee to rent grain bins and payment of excess electricity beyond monthly base rate.

The Public Hearing and sale of Real Estate Parcel #573615 to Arthur LeRoy Yates and Beverly Anne Yates to correct legal description of deed issued September 2, 1986 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Welte to close the Public Hearing on the sale of Real Estate Parcel #573615 to Arthur LeRoy Yates and Beverly Anne Yates to correct legal description of deed issued September 2, 1986.as there was no one present wishing to be heard on said sale. Carried 5-0.

Motion by Walish second by Batcheller to accept the offer of $1.00 from Arthur LeRoy Yates and Beverly Anne Yates for Real Estate Parcel #573615 plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: Arthur LeRoy Yates and Beverly Anne Yates, Husband and wife as joint tenants with rights of survivorship and not as tenants in commom

in the sum of ONE AND NO/100 ($1.00) AND OTHER VALUABLE CONSIDERATIONS for the following described real estate to wit:

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Walish to approve plans for Project L-EWP00(1)-73-97. Carried 5-0.

Motion by Batcheller second by Boykin to approve quotes from Dixon Construction Co. for bridge maintenance repair project. Carried 5-0. Copy filed.

Motion Boykin by second by Walish to receive petition from committee for completion of K-64 and letter regarding improvement of Lee Avenue. Carried 5-0.

Bid letting was held for Four (4) Half-Ton Pickups.

Motion by Walish second by Welte to receive the bids for Four (4) Half-Ton Pickups and submit them to the county engineer to review and recommend. Carried 5-0. Copy filed.

Bid letting was held for One (1) Track Hydraulic Excavator.

Motion by Welte second by Boykin to receive the bids for One (1) Track Hydraulic Excavator and submit them to the county engineer to review and recommend. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to award the bid for alteration of Trosper-Hoyt County Services Building for Motor Vehicle Department to Audino Construction in the amount of $140,313.00. Carried 5-0. Copy filed.

Craig Jorgenson, Clerk of Courts and Lt. Brad Carlson, Sheriffs Department discussed guidelines for courthouse security in Iowa.

John Rusch, Assistant County Attorney discussed obtaining title to property in Moville via a tax deed and also discussed taxation of deputy sheriffs uniform allowance.


Motion by Batcheller second by Boykin to approve a new Sexual Harassment policy for Woodbury County including recommended changes made by assistant county attorney John Rusch. Carried 5-0.

Five Minute Recess

Motion by Welte second by Boykin to go into Executive Session per Iowa Code Section 20.17(3)(a). Carried 5-0 on a roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session. Carried 5-0 on a roll call vote.

Break for lunch.

Reconvene at Law Enforcement Center Conference Room.

Motion by Welte second by Boykin to amend the minutes of the executive session of September 14, 1999 to reflect the absence of Mr. Batcheller and changes submitted by Mr. Clausen. Carried 5-0.

David Amick, County Sheriff discussed jail analysis report from Huskey & Associates.

Bobbie Huskey presented the report to the Board.

Motion by Batcheller second by Walish to receive a report titled, Woodbury County Iowa, Criminal Justice Needs Assessment by Huskey & Associates of Chicago, Illinois. Carried 5-0. Copy filed.

The Board adjourned the regular meeting until September 28, 1999.
