JUNE 8, 1999 FORTY SEVENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 8, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish, and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Clerk to the Board.
The Claims were approved as presented.
Meeting called to order.
There was open discussion period held by the Board.
Motion by Welte second by Walish to approve the Board minutes of June 1, 1999 as submitted. Carried 5-0.
Motion by Batcheller second by Boykin to approve the minutes of the Executive Session #1 of June 1, 1999 as submitted. Carried 5-0.
Motion by Boykin second by Walish to approve the minutes of Executive Session #2 of June 1, 1999 as submitted. Carried 5-0.
The Board approved the appointment of Kevin A. Ortmann, Temporary Engineering Aide, Secondary Roads, @$7.00/hr., effective 6/14/99. Not to exceed 120 days. Copy filed.
Motion by Welte second by Boykin to authorize Chairman to sign the Authorization to Initiate Hiring Process for Part-time Operations Officer, Disaster Services, Wage Plan: $10.01/hr. Carried 5-0. Copy filed.
The Public Hearing was held at 10:15 a.m. to amend the Woodbury County Zoning Ordinance.
Motion by Boykin second by Batcheller to close the public hearing to amend the Woodbury County Zoning Ordinance. Carried 5-0.
Motion by Batcheller second by Boykin to approve the amendment for Woodbury County Zoning Ordinance to increase penalties as provided through the Iowa Code. Carried 5-0.
Resolution No. 9202
WHEREAS the Board of Supervisors of Woodbury County, Iowa, has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorded in the office of the Woodbury County Recorder, in Book 1263, page 9; and
WHEREAS the Board of Supervisors has received a report in respect to amending said Ordinance from the Woodbury County Zoning Commission which held hearing(s) on said amendment(s), all as by law provided; and which amendment(s) is/are attached hereto marked Item (s) One, and hereby made a part hereof; and
WHEREAS the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said amendment(s), all as by law provided; and
WHEREAS the Woodbury County Board of Supervisors has concluded that the said amendment(s) to the aforesaid Zoning and Subdivision Ordinance should be made;
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid Zoning and Subdivision Ordinance is amended as shown on said Item(s) One.
IT IS FURTHER RESOLVED that these amendment(s) to said Ordinance shall be in full force and effect from and after its passage, approval and publication, and that the County Auditor shall cause this Ordinance to be published in the Sioux City Journal and be recorded in the office of the Woodbury County Recorder.

Delete Section 32, VIOLATION AND PENALTIES, and insert as follows:
SECTION 32. VIOLATION AND PENALTIES
The violation of any of the provisions of this ordinance shall constitute a misdemeanor. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance, upon conviction shall be subject to a fine of not more than five hundred dollars ($500) for each offense. Each day that a violation is permitted to exist constitutes a separate offense.
The violation of any of the provisions of this ordinance shall also constitute a civil infraction. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance, upon judgment shall be subject to the following fine schedule: First violation five hundred dollars ($500); second violation seven hundred fifty dollars ($750). Each day that a violation occurs or is permitted to exist constitutes a separate violation.
In addition to the above fines, the County may seek alternative relief to halt or abate the violation. The imposition of civil penalties in this section does not prevent the County from seeking criminal penalties in the same action.

Motion by Welte second by Boykin to authorize Chairman to sign Utility Accommodation Permit submitted by Rose Engineering for City of Sioux City. Carried 5-0. Copy filed.
The Board discussed Tandem Truck Snow Plow Wings for Secondary Roads.
Deb Burnight, Burnight Facilitated Services, discussed Strategic Planning Sessions held this fiscal year.
Motion by Batcheller second by Welte to award the bid for County Audit Services for FYs 1999, 2000 and 2001 to Dierking, Lockie & Associates. Failed 2-3, Clausen, Boykin and Walish opposed.
Motion by Walish second by Boykin to award the bid for County Audit Services for FYs 1999, 2000 and 2001 to Williams and Co. Carried 3-2, Batcheller and Welte opposed.
The bid letting was held for Real Estate Property and Contents Coverage, Faithful Performance Coverage and Boiler and Machinery Coverage.
Motion by Boykin second by Batcheller to receive and review the bids for insurance coverage. Carried 5-0.
Motion by Batcheller second by Walish to approve a 90-day extension for the Child Support Recovery 28E Agreement ending June 30, 1999. Carried 5-0.
There was discussion about wage plan employees and department head wages for FY 2000.
Motion by Boykin second by Batcheller to delay action on the wage plan increase for wage plan employees and department heads for FY 2000 until next week. Carried 5-0.
The Board adjourned the regular meeting until June 15, 1999.
