MAY 4, 1999 FORTY SECOND MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 4, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish, and Welte. Staff members present were Karen James, Executive Secretary/Public Bidder, Deborah K. Westphal, Election Clerk, and John Rusch, Board Legal Counsel.
Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 21.5(1)(c) Litigation or Litigation is pending. Carried 5-0 on a roll call vote.
Motion by Boykin second by Batcheller to go out of Executive Session. Carried 5-0 on a roll call vote.
The Claims were approved as presented.

There was open discussion period held by the Board.
Motion by Boykin second by Walish to approve the Board minutes of April 27, 1999 as submitted. Carried 5-0.
Motion by Batcheller second by Walish to approve the minutes of Executive Session of April 27, 1999 as submitted. Carried 5-0.
The Board approved the reclassification of Brian L. Haggler, Correctional Officer, County Sheriff, @$12.40/hr., effective 5/17/99. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.
The Board approved the appointment of Bernie J. Thomas, Temporary Summer Laborer, Secondary Roads, @$7.00/hr., effective 5/10/99. Job Vacancy posted: 3-10-99. Salary Range: $7.00-$8.50, based on experience with County. Copy filed
The Board approved the separation of Suzanne M. Houdeshell, M.V. Clerk II, County Treasurer, effective 5/14/99. Copy filed.
The Board approved the appointment of William D. Smith, Custodian, Building Services, @$7.35/hr., effective 5/05/99. Job Vacancy Posted: 3/23/99. Entry Level Salary: $7.35/hr. Copy filed.
Motion by Boykin second by Walish to refer proposed amendment to Zoning Ordinances to the Zoning Commission for recommendation. Carried 5-0.
Motion by Welte second by Batcheller to approve lifting a tax suspension for L.M. Carried 5-0.
The Public Hearing and sale of Real Estate Parcel #193260 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.
Motion by Batcheller second by Boykin to close the Public Hearing on the sale of Real Estate Parcel #193260 as there was no one present wishing to be heard on said sale. Carried 5-0.
Chairman called for bids on Real Estate Parcel #193260. Sharon Arthur bid $1,200.00 plus recording fees and Virgil Kleve bid $1,100.00 plus recording fees. There were no further bids.
Motion by Walish second by Boykin to accept Sharon Arthurs $1,200.00 bid for Real Estate Parcel #193260 plus recording fees. Carried 5-0.
RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9191
BE IT RESOVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: SHARON ARTHUR
in the sum of ONE THOUSAND TWO HUNDRED AND NO/100 ($1,200.00) Dollars for the following described real estate to wit:
LOTS ONE (1), TWO (2), THREE (3) BLOCK FOUR (4) HAMILTONS ADDITION, CITY OF SIOUX CITY WOODBURY COUNTY, IOWA
now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

in the sum of TWO THOUSAND AND NO/100 ($2,000.00) Dollars for the following described real estate to wit:
LOT SIXTEEN (16) BLOCK SEVEN (7) METROPOLITAN PARK ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA
now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

There was discussion with Dick Storm, County Engineer, about a letter received regarding two retaining walls falling down.
Dick Storm will come back to the Board with more information about the two retaining walls falling down.
Mike Neswick, Rml Architects discussed the bids for the first and third floors of the Trosper-Hoyt County Services Building.
Motion by Batcheller second by Boykin to award bids for furnishings of the first and third floors of the Trosper-Hoyt County Services Building to General Business for Group 3 in the amount of $14,771.84 & Group 9 in the amount of $1,975.56, Perkins Stationery for Group 1 in the amount of $28,690.00, Group 2 in the amount of $38,577.60, Group 4 in the amount of $429.60, Group 6 in the amount of $24,260.00, Group 7 in the amount of $7,428.40, Group 10 in the amount of $533.73, & Group 11 in the amount of $4,996.00, and Standard Office for Group 5 in the amount of $4,304.32 & Group 8 in the amount of $5,151.00 per Mike Neswicks recommendation. Carried 5-0. Copies filed.
There was a consensus to remove a wall in the Trosper-Hoyt County Service Building per Mike Newsicks request.
Dave Amick, County Sheriff discussed interviewing with consulting firms with experience in jail and correctional facility projects. Dave Amick recommended a Criminal Justice Planner from Husky & Associates, Inc., which has two options to choose from to help the needs of Woodbury County jail population.
Motion by Batcheller second by Boykin to approve and authorize Chairman to sign the Criminal Justice Needs Assessment Proposal Study Agreement, Option 2, from Husky & Associates, Inc. recommended by Dave Amick, County Sheriff. Carried 5-0.
Bob Knowler, County Treasurer introduced Phil Sickles from Image Tech to discuss imaging.
The consensus was to let Phil Sickles give a short presentation about imaging but to have Mr. Sickles contact WCICC and present to them.
Jeff Riese of Tax Research Conference discussed the money being spent on consulting firms to help the jail situation. He would like to see money being spent on programs such as Recovery Centers and Rehab. Centers as alternatives.

Motion by Boykin second by Welte to accept the recommendation of Attorney Lapierre in regard to voluntary mediation. Carried 4-0. Clausen abstained.
The Board approved the Sheriffs Civil Division 3rd Quarter report. Copy filed.
The Board approved the appointment of Paul Licht of Sergeant Bluff, as Mayor of Sergeant Bluff, to fill the vacancy of Mayor James Gaul until the next regular election. Copy filed.
The Board approved the appointment of Cathy Bishop of Sergeant Bluff, as Council member to fill the vacancy of Councilman Paul Licht until the next regular election. Copy filed.
The Board adjourned the regular meeting until May 11, 1999.
