MARCH 16, 1999 THIRTY-FIFTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 16, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Boykin second by Walish to approve the Board minutes of March 9, 1999 as submitted. Carried 5-0.

Motion by Boykin second by Walish to approve the Special Board minutes of March 11, 1999 as submitted. Carried 5-0.

There was open discussion period held by the Board.

Patty Erickson-Puttmann & Theresa Jochum from Social Services discussed Mental Health and Mental Retardation Manage Care Plans.

Motion by Batcheller second by Welte to award Mid-Step Services, Inc. a contract to provide services to the Mentally Retarded. Carried 5-0.

Motion by Welte second by Walish to award Siouxland Residential Services, Inc. a contract to provide services to the Chronically Mentally Ill. Carried 5-0.

The Public Hearing was held at 10:30 AM for David Smiths reestablishment of use request.

Motion by Boykin second by Batcheller to close the public hearing for David Smiths reestablishment of use request. Carried 5-0

Motion by Welte second by Walish to approve David Smiths reestablishment of use request and receive for signatures. Carried 5-0.

RESOLUTION NO. 9171

WHEREAS the Board of Supervisors of Woodbury County, Iowa, has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorded in the Office of the Woodbury County Recorder, in Book 1263, Page; and

WHEREAS the Board of Supervisors has received a report in respect to establishing land use from the Woodbury County Zoning Commission which held hearing(s) on said use(s) of land, all as by law provided; and which use(s) is/are attached hereto marked Item(s) ONE, and hereby made a part hereof; and

WHEREAS the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said use(s), all as by law provided; and

WHEREAS the Woodbury County Board of Supervisors has concluded that the said use(s) should be established;

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid use of land is established as shown on said Item(s) ONE.

IT IS FURTHER RESOLVED that this/these use(s) shall be established in full force and effect from and after its passage, approval and publication, and that the County Auditor shall cause the Use to be published in the Sioux City Journal and be recorded in the office of the Woodbury County Recorder.

Pursuant to Section 335 of the Code of Iowa, 1993, the Woodbury County Board of Supervisors will hold a public hearing to change a permitted principal use adopted within the Woodbury County Zoning and Subdivision Ordinance and/or Map for the Unincorporated Area of Woodbury County, Iowa, as follows:

Request to receipt-establish a use within the ML-PD (Light Industrial-Planned Development) District from a sawmill to a storage yard for delivery vehicles and the placement or construction of a single family dwelling for a tract located in part of the SE1/4SW1/4 in Section 322 T88N, R47W of the 5th P.M. in the County of Woodbury, State of Iowa.

Motion by Welte second by Boykin to approve and authorize Chairman to sign Appropriation Resolution for Fiscal Year 1999-2000. Carried 5-0.

APPROPRIATION RESOLUTION
FOR
FISCAL YEAR 2000
RESOLUTION #9169

WHEREAS, it is desired to make appropriations for each Service Area and Program Activity of County Government for the Fiscal Year 2000, beginning July 1, 1999 and

NOW, therefore, be it resolved by the Woodbury County Board of Supervisors that the amounts detailed by Service Area on the Adopted FY 2000 Woodbury County Budget Summary Form 638-R constitute the authorization to make expenditures from the Countys funds beginning July 1, 1999 and continuing until June 30, 2000, and

FURTHERMORE, this Appropriation Resolution extends the spending authority of each County Program Activity to the amount appropriated to it on its budgeted Program Planner, and

ACCORDINGLY, until such time as a Service Area is identified as progressing to a spending level challenging its appropriation, a budget amendment per 331.435 will not be implemented,

HOWEVER, should a Program Activity approach a spending level challenging its appropriation level, and the Service Area continues balanced, the Board of Supervisors will be requested to increase the Programs spending authority by resolving to permit such, and,

ADDITIONALLY, the Board of Supervisors may be requested to decrease a Programs appropriation by 10% or $5,000, whichever is greater, to appropriate a like amount to a Program Activity requesting same: 331.435 will govern actions in this regard.

The above and foregoing resolution was adopted by the Board of Supervisors of Woodbury County on March 16, 1999, and certified thereon as follows:

Motion by Welte second by Boykin to approve and receive for signatures a resolution thanking and commending Dorothy Boyle for her service to Woodbury County for Mental Health Services. Carried 5-0.

RESOLUTION NO. 9170
A RESOLUTION THANKING AND COMMENDING
DOROTHY BOYLE
FOR HER SERVICE TO WOODBURY COUNTY

WHEREAS, Dorothy Boyle has capably served as a member of the Woodbury County Mentally Ill Planning Committee Since the Fall of 1996; and

WHEREAS, Dorothy Boyle is and has been an advocate for Mental Health for most of her adult life and has been a long-standing member of AMI (Alliance for the Mentally Ill); and

WHEREAS, Dorothy Boyles dedication and interests has been to obtain the best services possible for Mental Health for the citizens of Woodbury County, and

WHEREAS, the Members of this Board of Supervisors have appreciated the positive, thoughtful, and constructive input that Dorothy Boyle has contributed to the Mentally Ill Planning Committees quest for the best solutions confronting this Committee; and

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thank and commend Dorothy Boyle for her distinguished service as a member of Woodbury Countys Mentally Ill Planning Committee.

BE IT FURTHER RESOLVED that it is the wish of all those signing below, that the future hold only the best for a very deserving lady, Dorothy Boyle.
