DECEMBER 22, 1998 - TWENTY-FOURTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, December 22, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen, and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Ann Long, Assistant County Attorney and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Burnight second by Clausen to approve the regular Board minutes of December 15, 1998 as submitted. Carried 5-0.

There was open discussion period held by the Board.

Motion by Batcheller second by Clausen to approve the grants monitor position for the Auditors office. Carried 5-0.

Motion by Clausen second by Batcheller to authorize the Chairman to sign the Authorization to Initiate Hiring Process for Clerk II/Grants Monitor, County Auditor/Recorder, AFSCME Courthouse/Grade 4, Step 1: $8.63/hr. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to approve and receive for signatures a resolution thanking and commending Raymond L. Burnight for his service to Woodbury County as a County Treasurer and Board Member. Carried 5-0.

A RESOLUTION THANKING AND COMMENDING
RAYMOND L. BURNIGHT
FOR HIS SERVICE TO WOODBURY COUNTY

WHEREAS Raymond L. Burnight has served Woodbury County, Iowa, as the County Treasurer, January, 1991 to December, 1994 and as a Member of the Board of Supervisors, January, 1995 to December, 1998 and

WHEREAS Raymond L. Burnights service in both of these elected offices has been characterized by his dedication to the care and concern of all citizens of Woodbury County; and,

WHEREAS, the other members of the Board of Supervisors has appreciated the positive, caring , and thoughtful input that Raymond L. Burnight has contributed to the guest for the right solutions to problems confronting Woodbury County;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thank and commend Raymond L. Burnight for his distinguished service as County Treasurer and as County Supervisor;

BE IT FURTHER RESOLVED that it is the wish of all those signing below, that the future hold only the best for a very deserving gentleman, Raymond L. Burnight.

Motion by Batcheller second by Boykin to receive for signatures a resolution setting a public hearing for the sale of property to Jack Cook Farms, Inc. only to clear any questions about the title to such property. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS, Woodbury County, Iowa, did file certain proceedings in the matter of the condemnation from Jack Cook Farms, Inc. which included the real estate described as:

A tract of land located in the SW 1/4 SE 1/4 of section 32, T88N, R47W of the 5th P.M., Woodbury County, Iowa further described as follows: Commencing at the SW corner of the SE 1/4 of said section 32; thence east along the south line of the SE 1/4 33.0 feet to the point of beginning, thence north parallel to and 33.00 feet normally east of the west line of the SE 1/4 of said section 32 for a distance of 735.00 feet; thence east 22.00 feet, thence south 735.00 feet to the south line of the SE 1/4, thence west 22.00 feet to the point of beginning. Containing 0.35 acres, more or less.

Note: The west line of the SE 1/4 of said section 32 is assumed to bear north.

such proceedings filed on January 24, 1989 and May 12, 1989 on Roll 211 at Image 799 and on Roll 215 at Image 577, respectively, of the records of the County Recorder of Woodbury County, Iowa; and

WHEREAS, this condemnation has been withdrawn and this sale proposed herein has been requested to clear any questions about the title to such property;

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the proposal described herein shall be held on the 5th day of January, 1999, at 10:15 o'clock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That such Board proposes to sell such real estate on the 5th day of
January, 1999, immediately following the closing of the public hearing,
to Jack Cook Farms, Inc.

3. That such Board proposes to sell such real estate to Jack Cook Farms, Inc. for
consideration of $1.00 plus notice of sale, publication fees, service cost and recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for
this subparagraph 4, be published as notice of the aforesaid proposal, hearing and sale.

Motion by Boykin second by Welte to approve a request from the Sioux City Community School District to display inaugural writings by students in the school district. Carried 5-0.

Motion by Batcheller second by Burnight to authorize the Chairman to sign NRCS Grant Agreement #8318. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to refer the bids for an inspection/survey vehicle to the County Engineer for recommendations. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to adjourn the regular meeting to convene a meeting of the Orton-Slough Drainage District Trustee Meeting. Carried 5-0.

A public hearing for the reclassification of sections of the Orton-Slough Drainage District was held.

Motion by Clausen second by Batcheller to close the public hearing. Carried 5-0.

Motion by Batcheller second by Burnight to receive for signatures a resolution approving commissioners report/classifications of the Orton Slough Drainage District. Carried 5-0.

IN THE MATTER OF THE
ORTON SLOUGH DRAINAGE DISTRICT
WOODBURY COUNTY

RESOLUTION APPROVING COMMISSIONERS REPORT/CLASSIFICATION

WHEREAS, the Woodbury County Board of Supervisors, as the governing body of the Orton Slough Drainage District, did appoint Commissioners to reclassify the land affected by the certain improvements by Design Homes, Inc., in the said drainage district; and

WHEREAS, said Commissioners have submitted Report entitled Reclassification of certain tracts of land in the Southwest Quarter (SW1/4) of Section Twenty-One (21), Township Eighty-Seven (87) North, Range Forty-Seven (47) West of the Fifth (5th) Principal Meridan, Woodbury County, Iowa which receive benefits from improvements of the Orton Slough Drainage District which Report has been filed with the Woodbury County Auditor; and

WHEREAS, the Woodbury County Board of Supervisors, acting as Trustees of the Orton Slough Drainage District fixed time and place of hearing upon the Report, to-wit, December 22, 1998 at 10:30 oclock A.M., CST at the Board Room, Woodbury County Courthouse, 7th & Douglas Streets, Sioux City, Iowa, and prescribed that notice of said hearing be served as required by law (468.45, Code of Iowa), and that proof of service of notice is on file; and

WHEREAS, the testimony of Jack D. Virtue, Engineer, has bee presented in support of the classification as reported to this Board.

NOW THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors as Trustees herein that the Report of Jack D. Virtue, Harold Fowler and John S. Lord, Commissioners, appointed to Classify Land in the Orton Slough Drainage District, filed on September 8, 1998 with the Woodbury County Auditor, be and the same is hereby approved and the lands described in said Report be classified for drainage purposes as therein shown and the Auditor of Woodbury County is directed to spread the classification of lands as shown and contained in the Report on the records of the Orton Slough Drainage District as maintained in his office.

Motion by Boykin second by Batcheller to adjourn the meeting of the Orton-Slough Drainage District Meeting. Carried 5-0.

There was a discussion on the restoration of courtrooms in the courthouse. Consensus was to restore the courtrooms to the original specifications.

Motion by Batcheller second by Boykin to move to engage Larry Ericcson for architectural services to proceed on the projects designated, (Room 208 and Equity courtroom). Carried 5-0.

Motion by Boykin second by Clausen to allow a $15,000.00 expenditure for a request for the American Indian Center from Juvenile Detention money received from the Winnebego Tribe. Motion by Clausen second by Welte to amend the original motion to allow a $8,000.00 expenditure. Carried 4-1. Boykin nay. Amended motion approved. Carried 5-0.

Motion by Boykin second by Burnight to authorize the Chairman to sign a draw request from the Iowa Department of Economic Development under contract number 97-HSG-044. Carried 5-0.

Motion by Clausen second by Batcheller to approve the recommended allowance for Family Farm Tax Credits per list presented. Carried 5-0.

Motion by Batcheller second by Burnight to allow the Chairman to proceed to arrange a sale of the tillable ground at the county farm, by auction, by March 1, 1999. Carried 3-2. Boykin and Clausen nay.

Motion by Boykin second by Clausen to approve a policy setting the mileage reimbursement rate at $.32/mile for county personnel effective January 1, 1999. Carried 5-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an architect contract with RML for the Siouxland Regional Health Departments Building. Carried 5-0.

Consensus was to defer action on the Stop-loss Liability Insurance proposals for 2 weeks.

Consensus was to allow undesignated expenditures to be placed in areas proposed by the Auditors office.

The Board approved the appointment of Paul Kuester for the office of Woodbury Township Clerk until the next General Election. Copy filed.

The Board adjourned the regular meeting until January 5, 1999.
