NOVEMBER 24, 1998 - TWIENTIETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, November 24, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen, and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Ann Long, Assistant County Attorney and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Batcheller second by Burnight to approve the Regular Board Minutes of November 17, 1998 as submitted. Carried 4-0. Boykin abstained.

Motion by Clausen second by Burnight to approve the Executive Session #1 of November 17, 1998 as submitted. Carried 4-0. Boykin abstained.

Motion by Batcheller second by Clausen to approve the Executive Session #2 of November 17, 1998 as submitted. Carried 3-0. Boykin and Burnight abstained.

The Board approved the reclassification of Gregory J. Stallman, Correctional Officer, County Sheriff, @$12.40/hr., effective 11/30/98. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of George G. Nuncio, Correctional Officer, County Sheriff, @$12.40/hr., effective 11/30/98. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Lynn dell S. Spink, Tax Clerk II, County Treasurer, @$8.63/hr., effective 07/01/98. Per AFSCME Courthouse. Contract agreement, from Grade 4, Step 1 to Grade 4, Step 1 FY 1998/99 increase. $196.00 Retro Pay. Copy filed.

The Board approved the separation of Gary L. Edwards, Deputy Sheriff, County Sheriff, effective 11/20/98. Copy filed.

The Board approved the separation of Pammi K. Rissell, Temporary Clerk, County Auditor/Recorder, effective 11/13/98. End of Temporary Work. Copy filed.

Motion by Boykin second by Batcheller to set a public hearing for the sale of Parcel #105660 for December 8, 1998 at 10:15 am. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:

North Forty Feet (N 40) East One Hundred Feet (E 100) Lot Five (5) Block Twelve (12), Clarks Addition, City of Sioux City, Woodbury County, Iowa
NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 8th day of December, 1998, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 8th day of December, 1998, immediately following the closing of the public hearing, to the City of Sioux City, Iowa only per Code of Iowa 331.361(3).

3. That said Board proposes to sell the said real estate to the City of Sioux City, Iowa only for consideration of $1.00 plus notice of sale publication fees, service cost and recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Boykin to sign Thank you letter to Lawrence Ericsson for the contributions to Woodbury County Courthouse Foundation. Carried 5-0.

Motion by Batcheller second by Boykin to approve quotes for bridge repair and removals per Dick Storms 11/20/98 letter excluding item #2 which will be deferred until a later time to see how his budget is. Carried 5-0.

Motion by Batcheller second by Burnight to approve vacation of road right-of -way, Lakeport Road. Carried 5-0.

RESOLUTION #9136
A RESOLUTION VACATION ROAD RIGHT OF WAY
WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.11 (Code of Iowa 1997), as amended, on November 17, 1998 held a public hearing on the proposed vacation of a portion of Woodbury County Secondary Road right-of way described as follows:

A tract of land located in the SE of Section 32, T88N, R47W of the
5th P.M. Woodbury County, Iowa further described as follows: Beginning
at the SW corner of the SE of said Section 32; thence north along the
west line of the SE of said Section 32 for a distance of 735.0 feet; thence
east for a distance of 55.0 Feet; thence south parallel to and 55.0 feet normally
distant east of the west line of the SE of said Section 32 for a distance
of 735.0 feet to the south line of the SE of said Section 32; thence west
along the south line of the SE of said Section 32 to the SW corner of the
SE of said Section 32 the point of beginning. Containing 0.35 acres,
more or less, exclusive of the present established road. (Said tract contains
0.93 acres, more or less, inclusive of the present established road). Note:
The west line of the SE of said Section 32 is assumed to bear north.


WHEREAS, No objections were received either in writing or by persons present.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors that all interest in the subject section of road right-of-way be vacated.

SO RESOLVED this 24th day of November 1998.

Motion by Burnight second by Boykin that the Board of Supervisors will not meet on 12/29/98. Carried 5-0.

Motion by Clausen second by Batcheller to go into Executive Session #1 per Iowa Code Section 21.5(c). Carried 5-0 on roll call vote.

Motion by Welte second by Batcheller to go out of Executive Session #1. Carried 5-0 on roll call vote.

Motion by Batcheller second by Burnight to follow recommendations of Attorney. Carried 4-0. Boykin nay.

Motion by Batcheller second by Clausen to go into Executive Session #2 per Iowa Code Section 21.5(1)(a). Carried 5-0 on roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session #2. Carried 5-0 on roll call vote.

Motion by Clausen second by Batcheller to go into Executive Session #3 per Iowa Code Section 21.5 (1)(c). Carried 5-0 on roll call vote.

Motion by Clausen second by Welte to go out of Executive Session #3. Carried 5-0 on roll call vote.

Motion by Wetlte second by Clausen to go into Executive Session #4 per Iowa Code Section 21.5 (1)(c). Carried 5-0 on roll call vote.

Motion by Boykin second by Burnight to go out of Executive Session #4. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until December 1, 1998.

The Chairman called to order the Wolf Creek Drainage & Pumping District Board of Trustees Meeting.

Dick Storm, Roger Milligan and Dennis Butler were present.

County Engineer, Dick Storm discussed activities with district.

Discussion among landowners as to benefit the pumping district.

Consensus of Board was to seek other sources of revenues from federal and state to aid in cleaning out ditches.

The Board adjourned the meeting of the Wolf Creek Drainage and Pumping District Board of Trustees Meeting.
