OCTOBER 20, 1998 FIFTEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 20, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen and Welte. Staff members present were Karen James, Executive Secretary/Public Bidder and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Burnight second by Clausen to approve the Regular Board Minutes of October 13, 1998 as submitted. Carried 5-0.

Doris Hansen, the countys independent auditor, presented to the board a letter recommending the Woodbury County Courthouse Foundation monies be transferred to an agency fund within Woodbury County. The consensus was to consult with the boards legal counsel.

Motion by Batcheller second by Burnight to approve the Human Resources proposal to allow Western Iowa Technical Community College to develop an orientation film for county employees. Carried 5-0.

Motion by Batcheller second by Boykin to approve reimbursing Jeannes Jewels for work to safeguard pylon lights. Carried 5-0.

Motion by Clausen second by Boykin to amend the previous motion to add that the funds be taken out of Infrastructure Funds. Carried 5-0.

Motion by Welte second by Clausen to approve the payment of Siouxland District Health Departments architectural fees. Carried 5-0.

Motion by Clausen second by Boykin to close the public hearing for the sale of a garage to the Bronson Fire Department only. Carried 5-0.

Motion by Clausen second by Boykin to sell a garage to the Bronson Fire Department for $1.00. Carried 5-0.

Motion by Boykin second by Batcheller to close the public hearing for Landmark holdings LLC rezoning request. Carried 5-0.

Motion by Clausen second by Burnight to approve Landmark holdings LLC rezoning request. Carried 5-0.

RESOLUTION #9123

WHEREAS the Board of Supervisors of Woodbury County, Iowa, has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorded in the Office of the Woodbury County Recorder, in Book 1263, page 9; and

WHEREAS the Board of Supervisors has received a report in respect to amending said Ordinance from the Woodbury County Zoning Commission which held hearing(s) on said amendment(s), all as by law provided; and which amendment(s) is/are attached hereto marked Item(s) One, and hereby made a part hereof, and

WHEREAS the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said amendment(s), all as by law provided; and

WHEREAS the Woodbury County Board of Supervisors has concluded that the said amendment(s) to the aforesaid Zoning and Subdivision Ordinance should be made;

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid Zoning and Subdivision Ordinance is amended as shown on said Item(s) One.

IT IS FURTHER RESOLVED that these amendment(s) to said Ordinance shall be in full force and effect from and after its passage, approval and publication, and that the County Auditor shall cause this Ordinance to be published in the Sioux City Journal and be recorded in the office of the Woodbury County Recorder.

Motion by Burnight second by Boykin to deny the request for an amendment to the 404 hazard mitigation grant. Carried 5-0.

Consensus was to postpone consideration of building construction and finance methods for Siouxland District Health.

Motion by Clausen second by Burnight that emergency services pay for roof repairs to the Climbing Hill facility from their budget. Carried 5-0.

Consensus was to direct General Services to contact the social services board to meet to discuss County burials and their cost and to bring a recommendation to the board.

Motion by Batcheller to obligate the board for the $40,000 currently budgeted for voice mail and to commit to the additional funding for $60,000. Motion withdrawn.

Consensus was to discuss the new phone system during the budget process.

Motion by Welte second by Clausen to approve RML Architects proceeding with plans as submitted for remodeling Trosper-Hoyts third floor. Carried 5-0.

Motion by Boykin second by Batcheller to receive the annual report of the Woodbury County Conservation Board. Carried 5-0.

Bill Hulse, Jana Martin, Janice Lind and Dennis Rumore of Moville presented to the board their concerns about the closing of a bridge north of the intersection of Haskell Avenue and Highway 140.

Motion by Boykin to approve the expenditure for the year. Died for lack of a second.

Motion by Batcheller second by Clausen to postpone request to repair bridge for two weeks. Carried 4-0. Mr. Batcheller excused himself because of illness.

Motion by Clausen second by Boykin to approve Addendum #1 to Project 97-25 of Hungry Canyons Cost Share Program. Carried 4-0.

Motion by Boykin second by Burnight to go into a Executive Session #1 under Section 21.5(1)(a) of the Iowa Code. Carried 4-0 on roll call vote.

Motion by Clausen second by Burnight to go out of Executive Session #1 under Section 21.5(1)(a) of the Iowa Code. Carried 4-0 on roll call vote.

Motion by Clausen second by Burnight to go into Executive Session #2 under Section 21.5(1)(c) of the Iowa Code. Carried 4-0 on roll call vote.

Motion by Boykin second by Clausen to out of Executive Session #2 under Section 21.5(1)(c) of the Iowa Code. Carried 4-0 on roll call vote.

Motion by Clausen second by Burnight to go into Executive Session #3 under Section 21.5(1)(a) of the Iowa Code. Carried 4-0 on roll call vote.

Motion by Boykin second by Welte to go out of Executive Session #3 under Section 21.5(1)(a) of the Iowa Code. Carried 3-0 on roll call vote. Burnight absent.

The Board adjourned the meeting until October 27th, 1998.
