JULY 28, 1998 FOURTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 28, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary, and Ann Long, Assistant County Attorney.

Meeting called to order

The Claims were approved as presented.

Motion by Burnight second by Batcheller to approve the Regular Board Minutes of July 21, 1998 as submitted. Carried 4-0. Welte abstained.

The Board approved the separation of Elizabeth Closter, Temporary Clerk II, County Auditor/Recorder Sr., effective 7/21/98. Copy filed.

The Board approved the appointment of Rachelle A. Martin, Temporary Clerk II, County Auditor/Recorder, @$8.63/hr., effective 7/27/98. Not to exceed 120 days. Copy filed.

The Board approved the appointment of James L. Drury II, Assistant County Attorney, County Attorney, @$34,000.00/yr., effective 7/29/98. Copy filed.

Motion by Boykin second by Batcheller to approve and receive for signatures a resolution naming Depositories for the Woodbury County Treasurers Department. Carried 5-0.

RESOLUTION NAMING DEPOSITORIES #9098

BE IT RESOLVED by the Woodbury County Board of Supervisors in Woodbury County, Iowa: That we do hereby designate the following named banks to be depositories of the Woodbury County funds in amounts not to exceed the amount named opposite each of said designated depositories and Robert Knowler, Woodbury County Treasurer is hereby authorized to deposit the Woodbury County funds in amounts not to exceed in the aggregate the amounts named for said banks as follows, to wit:

The Public Hearing and sale of Real Estate Parcel #145665 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Burnight to close the Public Hearing on the sale of Real Estate Parcel #145665 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #145665. Danny Robinson bid $347.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Burnight to accept Danny Robinsons $347.00 bid plus recording fees for Real Estate Parcel #145665. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVIORS OF WOODBURY COUNTY, IOWA #9099

BE IS RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: DANNY ROBINSON SINGLE PERSON

in the sum of THREE HUNDRED FORTY-SEVEN AND NO/100 ($347.00) Dollars for the following described real estate to wit:

LOT FORTY-ONE (41) OF BLOCK THREE (3) OF THE EDEN PARK ADDITION OF THE CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA

now and included in and forming a part of the City of SIOUX CITY, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8 (3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County, Treasurer is requested to abate taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of the Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Clausen to delay the acceptance of bids for two tandem axle trucks until reviewed by the County Engineer. Carried 5-0.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a 28E Agreement between the City of Sioux City and Woodbury County for simple misdemeanor prosecutions. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to authorize the Chairman to sign a letter to Mr. Charles Palmer, Director of Iowa Department of Human Services regarding the Countys Managed Care Plans for the Mentally Retarded and Mentally Ill. Carried 5-0.

Motion by Batcheller second by Clausen to approve the sale of the house located at 2709 Old Highway 141 to Donald Hoefling for the bid of $8,025.00 subject to review of the 404 Project Manager. Carried 5-0.

Motion by Clausen second by Boykin to approve the sale of the house located at 2713 Old Highway 141 to Lisa Evans for the bid of $7,630.00 subject to review of the 404 Project Manager. Carried 5-0.

Motion by Boykin second by Burnight to approve and authorize the Chairman to sign a Policy On The Prombition of the Use Of Excessive Force and the Residential Anti-displacement and Relocation Assistance Plan as submitted by Shelly Malcom, 404 Project Manager. Carried 5-0. Copies filed.

Bridget Hayes of Juvenile Court Services announced the award by the State of Iowa Criminal and Juvenile Justice Planning Council (CJJP) a grant of $173,000 for the Iowa Juvenile Crime Prevention Community proposal called Siouxland Human Investment Partnership (SHIP).

Stephen Quirk, Director of Siouxland District Health appeared before the Board to discuss the Health Department Facility Building Expansion.

Brad Carlson of the Sheriffs Department presented a Building Security Proposal.

Motion by Boykin second by Welte to receive the report presented. Carried 5-0.

Consensus was to form a committee to review the report.

Motion by Batcheller second by Boykin to go into Executive Session per Iowa Code Section 21.5(1)(j). Carried 5-0 on roll call vote.


Motion by Clausen second by Batcheller to go out of Executive Session. Carried 5-0 on roll call vote.

Motion by Burnight second by Batcheller to approve the appraisals for the 404 Mitigation Project. Carried 5-0.

The Board adjourned the meeting until August 4, 1998.
