JUNE 30, 1998 FIFTY-FOURTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 30, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary, Vicki Ritz, Deputy Elections Commissioner, and Ann Long, Assistant County Attorney.

Meeting called to order

The Board canvassed the River Valley Community School District Special Election of June 23, 1998 at 9:00 A.M. with results as follows:

Vicki Ritz, Deputy Elections commissioner announced that there were (6) special challenged ballots, of which (1) was accepted and added to the Tally. There were also (4) after election absentee ballots that were postmarked by June 22nd or hand delivered on Election Day, which were also added to the Tally.

Upon the public measure,

Question A Shall the River Valley Community School District, in the Counties of Woodbury, Cherokee and Ida, State of Iowa, be authorized to contract indebtedness and issue its School Bonds in an amount not to exceed $6,000,000 to provide funds to defray the costs of constructing, equipping, and furnishing a new Elementary School building and a new high School building?

there were One Thousand Five Hundred Ninety-Two, (1,592) votes cast, as follows:

FOR the question there were One Thousand Forty Four, (1,044) votes cast. AGAINST the question there were Five Hundred Forty-Eight, (548) votes cast.

We therefore declare the public measure Question A to be adopted.

Upon the public measure

Question B Shall the board of directors of the River Valley Community School District, in the Counties of Woodbury, Cherokee and Ida, State of Iowa, be authorized to levy annually a tax exceeding two dollars and seventy cents per thousand dollars, but not exceeding four dollars and five cents per thousand dollars, of the assessed value of the taxable property within said school corporation to pay the principal of and interest on bonded indebtedness of said school corporation, it being understood that the approval of this proposition shall not limit the source of payment of the bonds and interest, but shall only operate to restrict the amount of bonds which may be issued?

there were One Thousand Five Hundred Seventy-Six, (1,576) votes cast, as follows:

FOR the question there were One Thousand Seven, (1,007) votes cast. AGAINST the question there were Five Hundred Sixty-Nine, (569) votes cast.

We therefore declare the public measure Question B to be adopted.

Motion by Batcheller second by Burnight to approve the canvass of the River Valley Special Election. Carried 5-0.

The Claims were approved as presented.


Motion by Burnight second by Boykin to approve the regular Board Minutes of June 23, 1998 as submitted. Carried 5-0.

Motion by Batcheller second by Clausen to approve the minutes of Executive Session of June 23, 1998 as submitted. Carried 5-0.

Motion by Burnight second by Clausen to set the Public Hearing and Sale of Real Estate Parcel #524325 on July 14, 1998 at 10:15 A.M. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:

Lot Five (5) Block One (1) Vine Place Addition to City of Sioux City, Woodbury County, Iowa (2114 Douglas Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 14th day of July, 1998 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 14th day of July, 1998, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $900.00 plus recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 14th day of July, 1998 at 10:16 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 14th day of July, 1998, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $117.00 plus recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Boykin second by Clausen to authorize the Chairman to sign a Certificate of Completion for Project RC-0097(37)--9E-97. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to authorize the Chairman to sign a Utility Accommodation Permit submitted by Mid American Energy, Sioux City, IA. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to authorize the chairman to sign Hungry Canyons Project Agreement No.98-16. Carried 5-0.

Motion by Burnight second by Boykin to adjourn the regular Board Meeting to go into a Drainage Ditch Trustee Meeting. Carried 5-0.

Motion by Burnight second by Batcheller to go into a Drainage Ditch Trustee Meeting. Carried 5-0.

Motion by Boykin second by Batcheller to approve the FY 98/99 Drainage Assessments for various drainage districts as submitted by the County Engineer. Carried 5-0.

Motion by Burnight second by Boykin to adjourn the Drainage Ditch Trustee Meeting and to return to the regular Board Meeting. Carried 5-0.

Regular Board Meeting called back to order.

Motion by Clausen second by Boykin to approve the payments of the total cost of $144,513.56 for asphalt roads in Little Sioux Park. Carried 5-0.

The Board approved the appointment of Eden R. Kinnaman, temporary R.E. Clerk, County Auditor/Recorder, @$8.63/hr. effective 7/6/98, not to exceed 120 days. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to authorize the Chairman to sign an agreement between Siouxland Regional Transit System and Woodbury County Board of Supervisors. Carried 5-0.

There was a discussion of a possible moratorium on any new buildings to be erected near a possible interchange on Correctionville Road. There was a consensus to do nothing at this time.

Motion by Clausen second by Boykin to designate Enviro Safe Air Inc. North Sioux, SD as the entity to use when asbestos has to be removed during Phase III of Courthouse Preservation. Carried 5-0.

Motion by Batcheller second by Burnight to allow Supervisor Welte and Clausen to provide oversight on asbestos removal on Phase III of the Courthouse Preservation. Carried 5-0.

Motion by Clausen second by Batcheller to authorize the Chairman to sign an agreement between Siouxland Mental Health and Woodbury County, IA. Carried 4-0. Boykin abstained.

Motion by Batcheller second by Clausen to authorize the Chairman to sign an agreement between Siouxland Residential Services, Inc. and Woodbury County, IA. Carried 5-0.

Motion by Clausen second by Boykin to accept the recommendations of Social Services Coordinator for a response from the Iowa Department of Human Services review of Woodbury Countys MR and CMI Management Plans. Carried 5-0.

The Board adjourned the meeting until July 7, 1998.
