JUNE 16, 1998 FIFTY-SECOND MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 16, 1998 at 9:00 A.M. Board members present were Batcheller, Burnight, Clausen and Welte. Boykin absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary, Ann Long, Assistant Attorney.

Motion by Burnight second by Batcheller to approve the regular Board Minutes of June 9, 1998 amended #282. Carried 5-0. Carried 4-0.

Motion by Batcheller second by Burnight to approve the minutes of Executive Session of June 9, 1998. Carried 4-0.

Motion by Burnight second by Batcheller to move the agenda item dealing with approving a judgement against the County for a possible executive session to the last item. Carried 4-0.

Motion by Burnight second by Clausen to approve the placement and payment for DK at Gateway Group Home. Carried 4-0.

The Public Hearing and sale of Real Estate Parcel #626220 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Burnight to close the Public Hearing on the sale of Real Estate Parcel #626220 as there was no one present wishing to be heard on said sale. Carried 4-0.

Chairman called for bids on Real Estate Parcel #626220. Denise Koch bid $234.00 plus recording fees.

Motion by Batcheller second by Burnight to accept $234.00 bid plus recording fees for Real Estate Parcel #626220. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9087

BE IT RESOLVED by the Board or Supervisors of Woodbury County, Iowa, that the offer at public auction of: Douglas and Denise Koch Husband and wife as joint tenants with full rights of survivorship and not as tenants in common

in the sum of TWO HUNDRED THIRTY FOUR AND NO/100 ($234.00) Dollars for the following described real estate to wit

THE SOUTH TWENTY-FIVE FEET (S 25) OF NORTH FORTH-SEVEN FEET (N 47) OF LOTS TEN (10), ELEVEN (11) AND TWELVE (12) IN BLOCK FIVE (5) IN CITY PIERSON, WOODBURY COUNTY, IOWA

now and included in and forming a part of the City of PIERSON, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8 (3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County, Treasurer is requested to abate taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of the Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

The Public Hearing for a rezoning request was held at 10:20 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Batcheller to close the Public Hearing for a rezoning request by Leo Jochum and Deb Jochum.. Carried 4-0.

Motion by Batcheller second by Clausen to approve the rezoning request by Leo Jochum and his daughter, Deb Jochum. Carried 4-0.

RESOLUTION NO. 9088

WHEREAS the Board of Supervisors of Woodbury County, Iowa, has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorder in the office of the Woodbury County Recorder, in Book 1263, page 9; and

WHEREAS the Board of Supervisors has received a report in respect to amending said Ordinance from the Woodbury County Zoning Commission which held hearing(s) on said amendment(s), all as by law provided; and which amendment(s) is/are attached hereto marked Item(s) One , and hereby made a part hereof; and

WHEREAS the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said amendment(s), all as by law provided; and

WHEREAS the Woodbury County Board of Supervisors has concluded that the said amendment(s) to the aforesaid Zoning and Subdivision Ordinance should be made;

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid Zoning and Subdivision Ordinance is amended as shown on said Item(s) One .

IT IS FURTHER RESOLVED that these amendment(s) to said Ordinance shall be in full force and affect from and after its passage, approval and publication, and that the County Auditor shall cause this Ordinance to be published in the Sioux City journal and be recorded in the office of the Woodbury County Recorder.

WOODBURY COUNTY BOARD OF SUPERVISORS

ITEM ONE (1)

Pursuant to Section 335 of the Code of Iowa, 1993, the Woodbury County Board of Supervisors will hold a public hearing to amend the Woodbury County Zoning and Subdivision Ordinance and/or Map for the Unincorporated Area of Woodbury County, Iowa, as follow:

Amendment to rezone from the AG (Agricultural) District to the AR (Agricultural Residential) District for a tract located in part of the SE1/4 and of the S1/2 of the NE1/4 Lying East of U.S. Highway 75 as now located, excepting therefrom that part of the SE1/4 of the NE1/4 lying East of the old Sergeant Bluff and Salix Road, all in Section 16T87N, R47W of the 5th P.M. in the County of Woodbury State of Iowa.

Motion by Burnight second by Clausen to approve an agreement with Wellmark to use Prompt Associates Inc. Services. Carried 4-0.

Motion by Clausen second by Burnight to comply with the Mental Health Parity Act. Carried 4-0.

Motion by Welte second by Batcheller to approve the contribution of $20,000. to the SHIP Initiative. Carried 4-0.

Motion by Batcheller second by Burnight to approve and authorize the Chairman to sign an endorsement of the local option sales tax referendum for school infrastructure. Carried 4-0. Copy filed.

Motion by Burnight second by Clausen to approve a petition for abating delinquent taxes for Parcels # 565920, #566055 and 6566070 for the Florence Crittenton Home. Carried 4-0.

Motion by Clausen second by Batcheller to approve and authorize a resolution for abating delinquent taxes for Parcels #565920, #566055, and 566070 for the Florence Crittenton Center. Carried 4-0.

RESOLUTION APPROVIING ABATEMENT OF DELINQUENT TAXES

WHEREAS, the Florence Crittenton Home is a nonprofit organization, and is the owner of real state located at 3901 Green Ave., Sioux City, Iowa, and legally described as follows:

WHEREAS, the above-stated property has accumulated delinquent taxes as the organization did not acquire the property until September 6, 1996 and was not eligible to file for a tax exemption for the 1996 assessment year, thus resulting in taxes payable September 30, 1997 and March 31, 1998, being delinquent and,

WHEREAS, the Florence Crittenton Home has petitioned the Woodbury County Board of Supervisors, through the means of a letter, for abatement of said delinquent taxes pursuant to Iowa Code section 427.8 (1991 Supplement), and

WHEREAS, the property is used for charitable purposes by the titleholder which is a 501(C)(3) tax exempt non-profit organization, therefore, the Board of Supervisors sees that good cause exists for the abatement of these taxes;

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the delinquent taxes accumulated on the above property and hereby directs the Woodbury County Treasurer to delete these delinquent taxes from the tax records.

SO RESOLVED this 16th day of June, 1998.

Motion by Clausen second by Batcheller to approve a budget of $2,000 for the County Employee Picnic. Carried 4-0.


Motion by Clausen second by Burnight to go into Executive Session per Iowa Code Section 21.5 Carried 4-0 on roll call vote.

Motion by Clausen second by Batcheller to go out of Executive Session. Carried 4-0 on roll call vote.

Motion by Batcheller second by Burnight to approve the payment of the judgement against Woodbury County in Christopherson vs. Woodbury County. Carried 4-0.

The Board adjourned the meeting until June 23, 1998.
