May 12, 1998 FORTY-SEVENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 12, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator and Patrick F. Gill, County Auditor/Board Secretary, and Ann Long, Assistant Attorney.
The Claims were approved as presented.
Meeting called to order.
Motion by Burnight second by Batcheller to approve the minutes of the regular Board Minutes of May 5, 1998 as submitted. Carried 4-0. Welte abstained.
The Board approved the appointment of Craig S. Wisniewski, temporary Engineering Aide, Secondary Roads, @$7.50/hr., effective 5/13/98, not to exceed 120 days. Copy filed.
The Board approved the separation of Karrie S. Kelly, Assistant County Attorney, County Attorney, effective 5/29/98. Copy filed.
There was a consensus that J.D. Pellersels of Human Resources will bring projected costs and a job description for a safety officer to the Board for consideration.
Mr. Batcheller left at 10:25 A.M.
Motion by Boykin second by Clausen to approve a resolution by setting a public hearing for Sale of Mobile Home to Dale and Mary Bakke only. Carried 4-0.
RESOLUTION #9051
NOTICE OF MOBILE HOME SALE
WHEREAS Woodbury County, Iowa is the owner under a tax title of a certain mobile home described as follows:
A 1971 White/Gold Marlette Mobile Home, VIN #K14370FB610411, 938.0 square feet, last located at 2440 280th Street. City of Hornick, Woodbury County, Iowa
WHEREAS, it is the desire of the Board of Supervisors of Woodbury County to place the aforesaid mobile home back on the tax rolls, and
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
That a public hearing on the aforesaid proposal shall be held on the 26th day of May, 1998, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
That said Board proposes to sell the said mobile home to Dale E. and Mary D. Bakke only on the 26th day of May, 1998, immediately following the closing of the public hearing.

That said Board proposes to sell the said mobile home to Dale E. and Mary D. Bakke only for the amount of $218.00, plus transfer of Title fees.
That this resolution, preceded by the caption Notice of Mobile Home Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Burnight second by Boykin to accept the bid of Record Printing for printing stationary with the County Logo on it. Carried 4-0.
Motion by Clausen second by Boykin refer preliminary plats for B-Glovers Country Addition to the Zoning Commission for recommendation. Carried 4-0.
Motion by Clausen second by Boykin to close the public hearing for proposed amendment to the Zoning Ordinance. Carried 4-0.
Motion by Clausen second by Burnight to accept the recommendation of the Zoning Commission and adopt amendments to the Woodbury County Zoning Ordinance. Carried 4-0.
RESOLUTION NO. 9052
WHEREAS the Board of Supervisors of Woodbury County, Iowa has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorded in the Office of the Woodbury County Recorder, in Book 1263, page 9; and
WHEREAS the Board of Supervisors has received a report in respect to amending said Ordinance from the Woodbury County Zoning Commission which held hearing(s) on said amendment(s), all as by law provided; and which amendment(s) is/are attached hereto marked Item(s) ONE, TWO, THREE, and hereby made a part hereof; and
WHEREAS the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said amendment(s), all as by law provided; and
WHEREAS the Woodbury County Board of Supervisors has concluded that the said amendment(s) to the aforesaid Zoning and Subdivision Ordinance should be made;
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid Zoning and Subdivision Ordinance is amended as shown on said Item(s) ONE, TWO, THREE.

IT IS FURTHER RESOLVED that these amendment(s) to said Ordinance shall be in full force and effect from and after its passage, approval and publication, and that the County Auditor shall cause this ordinance to be published in the Sioux City Journal and be recorded in the office of the Woodbury County Recorder.

Charles Corbett, representing Jack Cook Farms presented to the Board final plats for Shadeland Country Estates Subdivision.
Garret Anfinson on 220th St. appeared to voice concerns about drainage and increased traffic on 220th Street.
George Johnson on 220th St. spoke in favor of the subdivision.
Beth Hickey on 220th St. spoke in opposition to the hard surface road.
Harland Smith on 220th St. spoke in opposition because of drainage problems.
Robert Cook believes there is no drainage problem.
Vonda Anfinson on 220th St. spoke in opposition to a hard surface road.
Dave Hickey on 220th St. voiced concerns about a hard surface road.
Consensus was to delay action until more information is gathered. (2 wks.)
Motion by Boykin second by Clausen to authorize the Chairman to sign an agreement with City of Correctionville to use Secondary Road Department equipment. Carried 4-0. Copy filed.
Motion by Burnight second by Boykin to authorize the Chairman to sign Utility Accommodation Permit submitted by Lance & Kelly Heimsoth. Carried 4-0. Copy filed.
Motion by Burnight second by Clausen to authorize the Chairman to sign proposal for Site Monitoring by CMS, Inc., Stuart, IA of underground storage tanks at County maintenance facilities. Carried 4-0. Copy filed.
Motion by Boykin second by Clausen to authorize the Chairman to sign Equipment Lease with Schumacher Trucking. Carried 4-0. Copy filed.
Motion by Boykin second by Clausen to receive for signatures a Resolution designating sections of roads to be temporarily closed for 1998 Construction Projects. Carried 4-0.
RESOLUTION NO. 9053
BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 1997, as amended, that the following highways or sections of highways described and shown on Exhibits A and B respectively, attached hereto and by this reference made a part hereof, will become temporarily closed for a period not exceeding one hundred sixty (160) days for construction, re-construction, and/or maintenance and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway or section of highway, and on said highway where intersected by other highways, reading Road Closed. Said described highways shall become closed effective upon erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

Len Bechtold addressed the Board with a request for abatement of penalty and interest on delinquent taxes.
Motion by Welte second by Boykin to extend the time for the Indian Center to stay in the building for 90 days. Carried 4-0.
Don Trometer, Sioux City Risk Manager discussed the procedure to begin County Stop Loss Liability Insurance.
Motion by Boykin second by Clausen to award a change order contract to Enviro Safe Air for lead point abatement to be paid for out of the contract contingency. Carried 4-0.
Motion by Boykin second by Burnight to go into Executive Session per Iowa Code Section 21.5(1) (c). Carried 4-0 on roll call vote.
Motion by Clausen second by Boykin to go out of Executive Session. Carried 4-0 on roll call vote.
The Board received the quarterly report from Commission of Veteran Affairs. Copy filed.
The Board received the County Recorders report of fees collected from 1/1/98 thru 3/31/98. Copy filed.
The Board adjourned the meeting until May 19, 1998.
