APRIL 14, 1998 FORTY-THIRD MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 14, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen and Welte. Burnight absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Diane Swoboda Peterson, Recorder Deputy, Don Nelson, WCICC Director and Ann Long, Assistant County Attorney.
Meeting called to order.
The Claims were approved as presented.
Motion by Batcheller second by Boykin to approve the minutes of the regular Board Minutes of April 7, 1998 amended to include the change of David Geib to Darrell Gieb on item 102 as submitted. Carried 4-0.
The Board approved the transfer of Everett D. Neal, Mapping Coordinator/Deputy, County Auditor/Recorder, @$33,600/year, effective 4/20/98, Appointed position. Employee is transferring from County Assessor Department to County Auditor/Recorder. Copy filed.
The Board approved the reclassification of Randi D. Campbell, Clerk/typist, County Sheriff, @$9.65/hr., effective 4/22/98, per AFSCME Courthouse contract agreement, from Grade 3, Step 4 to Grade 3, Step 5. Copy filed.
The Board approved the reclassification of Sydney C. Engle, Legal Secretary III, County Attorney, @$11.63/hr., effective 4/23/98, per AFSCME Courthouse Contract agreement, from Grade 6, Step 3 to Grade 6, Step 4. Copy filed.
The Board approved the reinstatement of Robert E. Aspleaf, Sr. Deputy, County Sheriff, @$17.03/hr., effective 4/15/98. Copy filed.
The Public Hearing and sale of Real Estate Parcel #213840 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.
Motion by Boykin second by Clausen to close the Public Hearing on the sale of Real Estate Parcel #213840, as there was no one present wishing to be heard on said sale. Carried 4-0.
Chairman called for bids on Parcel #213840. There were no bids.
Motion by Boykin second by Batcheller to set the Public Hearing and Sale of Real Estate Parcel #036120 on April 28, 1998 at 10:15 A.M. Carried 4-0.
RESOLUTION #9043
NOTICE OF PROPERTY SALE
Parcel # 036120
WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:
North Twenty-Three Feet (23) Lot Three (3) in Block One Hundred (118) of the Sioux City East Addition, City of Sioux City
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 28th day of April, 1998, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said board proposes to sell the said parcel of real estate at a public auction to be held on the 28th day of April, 1998, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $161.00 plus recording fees.
4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Boykin to refer the Letting of the Three Motor Graders to the County Engineer for recommendation. Carried 4-0. Copy filed.

The Public Hearing for Joan Hopkins rezoning request was held at 10:30 A.M. The Chairman called on anyone wishing to be heard on the request.
Shelly Malcom, Zoning Department, recommended the rezoning request for Joan Hopkins.
Motion by Boykin second by Clausen to close the public Hearing for Joan Hopkins rezoning request. Carried 3-0.
Motion by Clausen second by Boykin to approve the request of Joan Hopkins rezoning request. Carried 3-0.
RESOLUTION NO.9044
WHEREAS the Board of Supervisors of Woodbury County, Iowa, has enacted a Zoning and Subdivision Ordinance on January 23, 1971, by Resolution No. 5714, being recorded in the Office of the Woodbury County Recorder, in Book 1263, page 9; and
WHEREAS the Board of Supervisors has received a report in respect to amending said Ordinance from the Woodbury County Zoning Commission which held hearing(s) on said amendment(s), all as by law provided; and which amendment(s) is/are attached hereto marked Item(s) One, and hereby made a part hereof; and
WHEREAS the Woodbury County Board of Supervisors has received said report, studied and considered the same, and has held hearings on said amendment(s), all as by law provided; and
WHEREAS the Woodbury County Board of Supervisors has concluded that the said amendment(s) to the aforesaid Zoning and Subdivision Ordinance should be made;
NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, duly assembled, that the aforesaid Zoning and Subdivision Ordinance is amended as shown on said Item(s) One.
IT IS FURTHER RESOLVED that these amendment(s) to said Ordinance shall be in full force and effect from and after its passage, approval and publication, and that the County Auditor shall cause this Ordinance to be published in the Sioux City Journal and be recorded in the office of the Woodbury County Recorder.

There was discussion regarding individual departments reviewing monthly phone bills and signing off on them.
Jeff Reese, Tax Research Counsel, discussed the overcrowding of the jail and requested this situation be priority.
Motion by Clausen second by Boykin to go into Executive Session per Iowa Code Section 21.5(1)(i). Carried 3-0 on roll call vote.
Motion by Boykin second by Clausen to go out of Executive Session. Carried 3-0 on roll call vote.
Motion by Clausen second by Boykin to go into Executive Session per Iowa Code Section 21.5 (1)(a). Carried 3-0 on roll call vote.
Motion by Clausen second by Boykin to go out of Executive Session. Carried 3-0 on roll call vote.
Motion by Clausen second by Boykin to deny the request of an employee to overturn the decision made on a medical claim. Carried 3-0.
Motion by Clausen second by Boykin to go into Executive Session per Iowa Code Section 21.5(1)(a). Carried 3-0 on roll call vote.
Motion by Clausen second by Welte to go out of Executive Session. Carried 3-0 on roll call vote.
Motion by Clausen second by Boykin have the County Attorney review a claim for medical services and provide a recommendation for further action. Carried 3-0.
The Board approved the Sheriffs Civil Division report for the 3rd quarter ending 3/31/98. Copy filed.
The Board approved the Auditors Quarterly Report for the 3rd quarter ending 3/31/98. Copy filed.
The Board adjourned the meeting until April 21, 1998.
