MARCH 24, 1998 FORTIETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 24, 1998 at 9:00 A.M. Board members present were Batcheller Boykin Burnight and Welte. Clausen was absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary.
Meeting called to order.
The Claims were approved as presented.
Motion by Batcheller second by Boykin to approve regular Board Minutes of March 17, 1998 amended to include Mr. Batcheller arriving at 8:45 A.M. Carried 4-0.
Motion by Burnight second by Batcheller to approve the minutes of Executive Session #2 of March 17, 1998 as submitted. Carried 3-0. Boykin abstained.
Motion by Batcheller second by Burnight to approve the minutes of Executive Session #3 of March 17,1998 as submitted. Carried 4-0.
Motion by Burnight second by Batcheller to approve the minutes of Executive Session #4 of March 17, 1998 as submitted. Carried 4-0.
Motion by Batcheller second by Burnight to approve the minutes of Executive Session #5 of March 17, 1998 as submitted. Carried 4-0.
Motion by Boykin second by Batcheller to set the Public Hearing and Sale of Real Estate Parcel #045570, #344520, & #344280 to the City of Sioux City for $1.00 on April 7th at 10:15 A.M.

NOTICE OF PROPERTY SALE
Parcel # 045570
WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:
Lot Eight (8) in Block Forty-five (45) of the Middle Sioux City Addition, City of Sioux City, Woodbury County, Iowa
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 7th day of April, 1998, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. To correct the service of Notice of Expiration, the said Board proposes to sell the said parcel of real estate on the 7th day of April, 1998, immediately following the closing of the public hearing, to the City of Sioux City, Iowa only per Code of Iowa 331.36(3).
3. That said Board proposes to sell the said real estate to the City of Sioux City, Iowa, only for consideration of $1.00 previously paid by City of Sioux City and Received by Woodbury County, Iowa, for the Quit Claim Deed for the above mentioned parcel # 045570.
4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

RESOLUTION # 9031
RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Elaine J. Menefee, as joint titleholder of real estate located at 2525 S. Martha Street, Sioux City, Woodbury County Iowa, and legally described as follows:

Lot Seven (7) block One (1), Oak Park Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Elaine J. Menefee as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9 and
WHEREAS, the Board of Supervisors recognized from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.
SO RESOLVED this 24th day of March, 1998.

The Board approved the reclassification of Catherine J. Derochie, Legal Secretary III, County Attorney, @$10.82/hr., effective 4/6/98, Per AFSCME Courthouse Contract from Grade 6, Step 1 to Grade 6, Step 2. Copy filed.
The Board approved the appointment of Bradley J. Gatzemeyer, F/T Youth Worker, Juvenile Detention, @$9.69/hr., effective 3/25/98, Job vacancy posted: 2/10/98. Entry level salary: $9.69/hr. Copy filed.
Motion by Batcheller second by Boykin to set public hearings for the approval and submission of the MR Management Plan at 10:45 A.M. on March 31, 1998 and the approval and submission of the MI Management Plan at 11:00 A.M. on March 31, 1998. Carried 4-0.
The Board reviewed and discussed Secondary Roads Department proposed construction improvement program for FY 00/01, 01/02 and 02/03. There was discussion of a bridge near Danbury that was inadvertently left off. It was agreed that it should be included.
Motion by Batcheller second by Boykin to approve the plans for Project L-EWP98(2)--73-97. Carried 4-0.
Motion by Boykin second by Burnight to authorize the Chairman to sign a permit requested for use of County Highway Right-of-Way for underground tile line facility submitted by Donna Steiner. Carried 4-0. Copy filed.
There was a discussion of a proposed policy and procedure for road closures. There was a consensus to proceed with formulating these policies and procedures..
Motion by Boykin second by Burnight to approve the application for a Class A Liquor License for the White Horse Mounted Patrol Club. Carried 4-0. Copy filed.
Motion by Boykin second by Burnight to authorize the Chairman to sign an authorization of Norwest Bank in Sioux City as a depository for the Woodbury County Agricultural Extension Funds. Carried 4-0.
Motion by Boykin second by Burnight to approve paying the expenses of a consultant to discuss a proposed Stop-Loss policy for the liability fund. Carried 4-0.
Dale Erickson, the Lawton-Bronson School District Transportation Director addressed the Board with a concern about rural property owners whose driveways drain into county gravel roads.
Motion by Boykin second by Burnight to go into Executive Session per Iowa Code Section 21.5 (1)(c). Carried 4-0 on roll call vote.
Motion by Boykin second by Batcheller to go out of Executive Session. Carried 4-0 on roll call vote.
The Board adjourned the meeting until March 31, 1998.
